Hey Cheryl! Your daughters ex husband's credit and debt shouldn't be a factor in her refinance, as long as the divorce is completely finalized. If it was still in process and she was applying for an FHA loan in a community property state, then it could be a factor, but that's not the case here. As long as she meets credit and income requirements on her own, there shouldn't be an issue. The quit claim deed is the typical way to remove someone from title but he would have to sign for it to take effect. But, she should be able to have the court enforce the order. And the title company would typically prepare this to be signed at closing by her ex if she does proceed with the refinance. He would still have to sign though. You and your husband could certainly be non occupying co borrowers and help her qualify if her income isn't enough to qualify on it's own. But her ex is still going to have to sign off.

Thank you for this video. My daughter recently finalized her divorce. The judge ordered that she refinance the home and pay her ex a sum of money. He also ordered that her ex “immediately “ execute a quit claim deed to my daughter; however he refuses sign the quit claim. She was told by the mortgage company that she does not qualify for refinance and this is primarily because of her ex husband’s credit, and debt. The final decree states that if she can’t refinance, the house needs to be put on the market. Does she have to move forward with selling the home if he refuses to sign the quit claim deed? Also is there a way for her to remove his name off the mortgage (he never paid one penny of the mortgage, down payment or closing), prior to refinancing, (her credit will be better) then adding my husband and I on the mortgage, so she is able to refinance under divorce terms, and remain in her home with her children? She lives in Georgia.

Thank you for the video. I’m feeling a little trapped in my situation. I am a single Dad with temp custody (4 years now, final coming soon Thank God) of both of my special needs kids. Long story short I was desperate to get my ex (never married) out of the house years ago because of the craziness I would come home to and needed a safe space for my kids. So I paid her to leave and helped get her home after we both agreed she would take me off her loan. Now in order to trap me she refuses to refinance and take me off her house. I love that my kids are in a more peaceful place without her at the home but I ultimately had to make a tough choice to get them out of that volatile situation.
