Thanks David, great question. The finance clause is required when requiring funding from a bank or lender. If you are buying the property outright with cash, then this clause wouldn't be required. It would be wise to consult with a solicitor or conveyancer to ensure they review the contract plus include the relevant clauses to protect you.

Hey Larissa, great question. "Under Offer" means someone else has the property under contract, and it is still conditional to them meeting their finance and building and pest clauses. In other words, the contract could still possibly fall over if their finance falls through or there are problems with the building and pest - so the property isn't quite sold yet. From the other perspective - lets say if you had got the property - if you had your offer accepted and signed your contract subject to 14 days finance +14 days building and pest the property would be "under offer" while you are in your 14 days finance/building and pest window. Your contract is still conditional upon you being happy with your finance and building and pest. Once you are satisfied with your finance and building and pest, you move to make the contract unconditional - this is also called "under contract" meaning you are locked in to settlement. That sucks that you missed out on the property you loved, sorry to hear that stay in touch with the agent you never know what can happen! Generally we are finding in a situation where there are multiple offers on the 1 property, having sharper clauses, such as a shorter finance clause can be the difference between having the offer accepted and not. This isn't always the case, however, might be the 1% that gets it across the line.
