Our event on 27 April 2017 was designed to assist criminal lawyers identify where their clients may have a claim against the police or another investigating or prosecution body.
If you would like a copy of the notes and the slides which accompany this presentation, please email events@doughtystreet.co.uk
Home Office statistics indicate there were almost 900,000 arrests in England and Wales in the year to 31 March 2016. But the IPCC tells us that over 34,000 complaints, comprising almost 65,000 allegations, were made against the police over a similar period.
Whilst many of those who come in to contact with the police are dealt with even-handedly, some egregious examples of police misconduct still hit the headlines. And even in less high-profile cases, clients may still wish to know how they can challenge a search warrant, contest the police’s retention of their data or property, seek remedy for a malicious prosecution or mistreatment during arrest or detention, or whether there may be an action for damages after an acquittal or a successful appeal.
So what should criminal lawyers do when they suspect police misconduct in their client’s case may give rise to a civil claim? Criminal barristers at Doughty Street Chambers have long benefited from being able to call upon the expertise of colleagues in our actions against the police and public authorities team, ranked alone in Band 1 by Chambers and Partners. Together they present a seminar designed to give criminal lawyers some practical tips and advice on how to spot and pursue a civil claim against the police, and the remedies which may be available for their clients.
AGENDA:
The kinds of claims available (civil damages claims judicial review, etc) and how claims can be funded;
Where to find relevant procedural rules and key law;
The basics on how to make valid claims of false imprisonment and malicious prosecution;
An introduction to claims arising from police searches, seizures and retention of property, and how to challenge search warrants.

Wrongful conviction is a horrendous abuse of human rights all involved should be facing a lengthy custodial sentence and many prosecutors should be disbarred and charged not just the police.

This happened to my friend, would love your thoughts on the situation! Mate got arrested for throwing a carton of juice across the room that was alleged to have accidentally hit her mother 😅 no injury of course, and the mother said that it had hit her, but by accident, the police who have a strange prejudice towards my friend arrested her and not only charged her, it went through the courts ! The cps actually went through with it, the case in court twice 😮before being dropped or her found not guilty by the judge… it caused a lot of stress and emotional damage for my friend, as funny and stupid as it is…. Any chance that she could bring a case against the police 👮‍♀️??? Not sure 🤔 the average tax payer would’ve wanted to fund the whole investigation and court proceedings!!! Tbh, should maybe go to the press, or, I’ll get her on for an interview for social media. DUE TO the local police department being unreasonably nasty toward my friend, they also arrested her for dropping a boxed quiche on the floor in anger with her mother, the two then bumped heads by accident… these disgusting London police arrested her and CHARGED her for that too! … it’s sick that this is not a joke.. bloody sounds like one ☝️ to those who don’t know how much the cops can abuse their powers when they take a disliking to somebody 😮 anybody want to help take this further??

Attorney rights is a right. Preliminary hearing rights with a discovery. A right to fire and hire a Attorney and speedy trial rights violated. A Writ of habeas corpus should have never been suspended. Thank God I have a chance to pursue a 1983
