If a neighbor's tree falls into your yard damaging the fence, who is responsible for removing the tree and repairing the fence? What if the neighbor's tree fell on your home or vehicles? we had a cluster of 7 trees fall onto our home about 5 years ago. The neighbors trees, across my fence. The good news. No damage to our home. The bad news: my homeowners would only pay IF there was damage to our home. For removal, it was all on us. Now, IF we had given our neighbor written notice that we were concerned about these trees, then he would have had responsibility for removal. We had not known to do that. Thus, it was our payment to cover - $4000. We have now written letters to 2 of our neighbors (we're in an old neighborhood with lots of older trees along property lines).

Thank you for the feedback and for background on a similar scenario you went through. I’m not certain if the written notices would technically have reversed the responsibility for cleanup. Unless the trees were in poor health, I don’t believe a written notice of concern from a neighbor would make a difference. That said, I suppose an attorney may be able to fight the insurance company on your behalf after an event where prior written notice was given. Then again, I am not an attorney. Thank you again!
