SUMMARY:
During the Fall 2020 semester, all students residing on the UIUC (University of Illinois at Urbana Champaign) campus were required to complete COVID-19 saliva testing twice a week. At the start of the semester, I was unable to receive saliva testing because of a dry mouth condition. During this time, I took on my own transmission-preventing measures, including: taking all my courses and extracurricular activities entirely online, significantly limiting my in-person interactions, and following all COVID safety protocols (masking and socially distancing). I have substantive evidence that I never caught nor spread COVID-19.
One month into the semester, I was sent one warning and then was shortly charged with COVID-19 Testing Noncompliance. This prompted me to quickly learn how to extract saliva despite my dry mouth condition, and I also reached out to the University's health center for further guidance. Starting October 4th, I was able to develop and maintain a biweekly testing schedule until the day I left campus in late November. I explained my situation in full to my University case coordinator.
On October 16th, the Subcommittee on Student Conduct found me guilty of COVID-19 Testing Noncompliance, and applied the following sanctions: dismissal from the University for one year, trespass notice physically banning me from University property, and a petition letter for readmission and petition requirements including academic or work experience, 70 hours of mandated service, and a 1500-word research paper on the topic of COVID-19 transmission, spread, and mitigating risk. I submitted an appeal on the ground that the dismissal sanction was not appropriate for my violation. This appeal was denied.

Hey, UIUC Student here. The university's response to covid and covid testing has been abysmal, and to top it off they can't seem to figure out if they want in person or online classes yet. This case in particular showcases everything wrong with the management. It is beyond infuriating to hear this story, but sadly consistent with UIUC's response to covid overall. Often within a few weeks they would pass stringent testing requirements only to repeal them a few weeks later, and to top it off, still have the gall to charge full price for this pseudo-college experience. I am honestly throughly disappointed with University Management, but what can I do? I believe many students just put their head down and go along with whatever new protocol that Chancellor Jones decides to release today.

I go to UIC. Really annoyed by the universities failure to provide a hybrid experience. We’re adults allow us to choose how we want to receive our education.

Pretty much, there's such a 'you're with us or against us' mentality that to have complaints or concerns with anything related to the COVID handling process will often get you an entirely different tone from people. That tone ranges from a dismissive "oh, it'll be over soon this is just how things are", to an aggressive or accusatory "why are you questioning what's supposed to help keep us safe?" mentality. Like many of us aren't paying out of pocket to be here...

Damn I didn't know you were one of the people on reddit last year when I read all about this in a post. My friends and I at UIUC were wondering who that was and assumed that they just didn't care about covid. Really sorry to hear about how all of this went down.

Honestly this just sounds like UIUC is a massive government backed advance fee scheme. Have you talked to anyone about any possible legal action? I have no idea what laws, if any, surround the process of dismissals from universities, but it couldn't hurt to explore your options.

I see a pattern with many of these cases. Although the universities are intending to prioritize safety over anything else, they unintentionally start to stray away from the health and safety of the people and more on the ‘wrongdoings’ or rules that were technically broken. In your case, you proved the fact that you did not spread the virus, which is the main goal, right? Health and safety. That could be the end because you ultimately did your duty to keep everyone safe despite you not being able to report your saliva test promptly. But, alas, it wasn’t the end. But hey, as some believe and many have heard, “everything happens for a reason.” I wish the best for you, your family, and your future. Good luck out there.

@Thawne, I don’t think victim blaming is the route you want to take here. If someone is raised in a society which teaches them that to succeed they need to go to college, is it any surprise that they feel like they have to attend. I understand that the US has a huge problem with its education system, but replaying to victims of the cycle with copy and pasta comments isn’t gonna convince them of anything. Instead try empathising with their situation and talk about how the colleges are the ones screwing them over rather than saying it’s all their fault for doing what they were taught to do.

watched you since the mineplex days. crazy that this ended up happening to you, i have also gone through my college disciplinary action system and it was a disorganized pain. i feel as if you should take legal action with this situation. i wish you the best of luck with whatever decision you make moving forward with education or work.

From listening to this video it would seem that the UIUC needs to revamp it's policies regarding Covid-19 testing (especially with regards to methods of testing). It almost sounds like they do this so as to remove people they consider not worth the time to help. It's digusting! You should have been given help regarding this situation!

Hey ish, I just saw this video after seeing the new social experiment videos, which by the way are amazing! I too have gotten in trouble this year for noncompliance with COVID-19 testing in a similar fashion from university. It is completely ridiculous and I want u to know that my hopes and prayers are with u. Someone else is in your shoes. I hope you are doing well now and u deserve all the best. I think you should take legal actions towards the university, they should be way nicer to students like you and not throw you out because of some not cool COVID-19 Test that you couldn't do because of reasonable argument that you said. That is just not cool to see, I hope you find a new university or school that will treat you better. Good luck.

If I'm being honest, the punishment is absolutely ridiculous. I am a History minor, and I understand that justice systems are supposed to look at if you did the charges or not, but that is still a monumental overreaction to the charges. If I could give any advice, I do not believe that university is worth attending if you ever try to go back or if they try to get you to come back. If you truly like the college and want to attend it again, go right ahead, but this event should reveal the true nature of this college. I hope you can get past this and are able to succeed and do what you love. Good luck with the road ahead, and we will stand behind whatever path you go down.

You really think violating the bi-weekly testing policy 16 times for a month straight was not an overreaction, despite the amount of times he was warned and where he literally stated he was wrong? He was just negligent and refuses to admit that what he already recognizes was the wrong course of action is what caused his punishment.

I think while you did fail to compile, They failed to not only notify of such issue even if it was simply a "technical error" (they should be watching to make sure its working correct not hoping its working correctly especially if its such an urgent email like that) and they also failed to state alternatives for the testing. I don't see how the student that is the one that gets kicked out when its if anything really the schools failures to communicate and verify their own systems are working correctly. And then on top of that the ones that collect are also the ones that decide whether or not to remove that student and essentially save money for themselves (maybe that's just be though). While yes you didn't test for a few weeks, you eventually did and you even verified you didn't have it previously, I feel they didn't even think for a second about letting you off with a warning I feel they just wanted a reason to throw you out. I'll make sure I avoid that school once I get out of community college if I need another school. Even something as simple as like a "hey, what's up you haven't tested this week" or something should of been asked by someone from staff.

Wow glad I didn't end up going to UIUC when I was making my decision years ago. Graduated mid-pandemic and at my existing university had a few scares with missing some testing in my final semester but I can't imagine just being told "Hey, you're out" for some miscommunication.

Honestly, I agree that it is 100% appropriate for a school to require testing as often as they see necessary to protect their students and faculty, but they cannot disregard health conditions. There certainly should have been alternatives to the saliva test that they offered. Certainly this has to be against the Americans with Disabilities Act, right?

I didn't have time to watch the video, but wow. It never ceases to amaze how awful universities can be because of people that simply do not care. Educators are supposed to teach and accommodate so people can grow up to be the best version of themselves they can be, but basically every university experience I have had was awful, less the few people that were actually normal human beings and had sympathy.

Hey there, Pitt student here, we had a very brutal system here as well. All student who were not vaccinated by the week before finals could not take their finals and could not register for classes the next semester until getting vaccinated or a very strict waiver which forced you to get tested once a week every Monday. Sorry what happened to you, that sucks.

With how strict they are acting on COVID guidelines, why wouldn't they have promoted or encouraged nasal swab tests. It seems to be more reliable and more readily available back then and now. Seems harsh for something that is unclear and hard to judge.

After watching this video in full I have a million thoughts, but unlike you neither the patience nor skill to put them all into the writing of a single comment. Thus I'm going to keep this as a few bullet points: - Based on your telling and the provided evidence, your case is definitely valid. I'm not a lawyer but maybe there is potential for a class action lawsuit? Either way the effort to which you go to stay unbiased in all of this is admirable. - I'm happy that you did manage to turn away from that event to go forward with a new path keep your optimism. - You're a star, and you'll make a badass lawyer/politician some day.

You know it would still have been bullshit, but at least understandable bullshit for them to have punished you while you were still violating the policy strict punishment to ensure everyone else follows it. for them to take this action after you fixed the issue would be like a cop arresting you 3 weeks after you fixed your broken headlight

As everyone now knows, the covid-19 pandemic was handled extremely poorly. the testing and vaccination was also done poorly, and due to fear mongering and outright disinformation, the situation resulted in ridiculous punishments for behavior that failed to constitute even a misdemeanor. As such these individuals who in my own opinion were not, well meaning or even good people was mean spirited and punitive to the extreme. These people deserve to be held accountable and should receive the exact same treatment they accorded others in an accumulative manner. This might sound harsh but individuals in a position of power should be expected to meet the highest standard of behavior in the execution of their duties, and not encouraged to act capriciously. I believe this may be summed up in the phrase. "Let the punishment fit the crime"

I have only just found you through your most recent 1k player social experiment which was entertaining in a gaming setting. A college degree in the USA is utterly pointless unless you want to pursue a traditional degree like medical or law. I am not going to watch the entire video, but if you aren't pursing traditional degrees you have done yourself a favor. As someone in IT, I gained an associates. Pursued certifications and now make more than most of my peers. 100k for a paper is worthless. Investing in experience and knowledge in specifics is far more valuable. Take care, pursue your dreams and screw the noise.

I really hope you took disciplinary action against the university, this is horrible. Perhaps even go so far as a lawsuit. Thats horrible practice and terrible communication. I am thankful my university was not like this during the pandemic, but it's disheartening and infuriating to know that you had to go through all that.

I haven’t watched the video and just read the description. If the mouth condition was documented, this is a easy win lawsuit. If its not, then there is not much that can be done.

strike systems that have timers on how often you can break rules ... have to have some better way of spacing things out ... cause like i had a similar problem with my youtube channel ... back in the day , 1 strike lasted 2 weeks, then 2nd 3 months then 3rd was ban.... i got 2 strikes in like a week , that was fair enough (just to note ... what i got strikes for would not actually broken the rules of current youtube rules) .... what wasn't fair was .... my 3rd strike was of a video .... i made 3 months prior .... now if they struck me .... when i released it ... i wouldent have been banned .... they suddnly decided that as i have 2 strikes now .... that was the best time to go over things i had made months ago and catch me out.

While it's conceivable that you did the wrong thing by not seeking out other forms of testing, there's no way you could have expected that since the form of testing they were demanding was the one you were familiar with. The University is completely at fault for not providing you (and every other student) with clear and easy to find information on alternative testing methods. Instead, they let you stand around and waste time trying to produce enough saliva, when they could have instructed you toward an alternative course of action. That is their failure (among many), not yours. And they are at fault for not providing you with a line of contact with a case worker that would allow you to effectively communicate back and forth. (It seems like they didn't want to hear your side of things, they just wanted you to hear their side.) In addition, the University is at fault for their delayed communication and the fact that they didn't give you much to go on in the first emails. Instead of giving you clear guidelines on what to do to remedy the situation, they just wanted to chastise you. All in all, as much as it may be true that you didn't do exactly the right thing or take the best course of action, UIUC is effectively at fault here. In the grand scheme of things, it should be remembered that this is just a single case in the bigger picture of the reality that corporations and institutions were ill-prepared and poorly handled the covid-19 pandemic. The vast majority of companies, institutions, and governments dealt with the pandemic very poorly. And that's putting things nicely. Overall, the only one who deserves disciplinary action is the university itself. Shame on them. You say they're a respected institution, but frankly they have no respect from me. Nor does any university, as it has been sufficiently proven to any sane individual that the university system in the U.S. is morally bankrupt and seeks to exploit people for the sake of making profits.

All of this could have been avoided by him contacting the damn health center. He even recognizes that as an option. It was clear. Why didn't he talk with his Resident Assistant? His Resident Director? Send an email to the health center? Literally any person with authority? But he didn't do any of that because of hypotheticals he came up with that he admits was wrong. That's just negligence. He violated the policy 16 times and was warned multiple times. Even when he was told he needed to immediately go get tested, he decided not to thinking his case coordinator WOULD call him when the email stated that they "MAY call" him, or "IF they call" him. He's just negligent and refuses to accept it. If he ever decided to pursue legal action, he would lose. HE clearly doesn't have any grounds for a disability considering he meets none of the three criteria under the ADA to be considered disabled.

@@sigalius The people at the testing center are most likely hired students. You clearly overestimate how much people in any process have authority/information at any step of a process model. Regardless, that does not disbar him from contacting the health center.

About Law umm not a lawyer but how is this not breaking title 9 or ADA. Like they had medical issues. You had dry mouth. I was a thermal screener. If you had an endoscopy you would have to have diarrhea to clean out the system. I still let them pass. If they got tested since the symptoms started or contact then I would let them pass. Why didn't the person at the front when you were given the sample ask you why it was empty. Like I said not a lawyer but still that institution broke at least ADA.

I think you got lucky, you did not know about that nasal swab test. I had to take COVID-19 nasal swab test over a year ago. This was a horrible experience. I thought, the tester was reaching my brain. Both my eyes were watering. I can't imagine doing it twice a week.

As much as I sympathize with your 'condition' as someone with Sjogren's, not reaching out to the university to coordinate how you could be in compliance given your struggles is so painstakingly obvious as the course of action, your decision not to do so was simply negligent. You can't predicate your negligence on hypotheticals of what the school might do if you reached out either. Further, the email that you show about being contacted clearly shows, 'you MAY be contacted', and 'IF you are contacted', and you acted as if it was a given you'd be contacted. You were straight up wrong multiple times and you admit the thinking was faulty. Calling it faulty is sugar coating it. That is negligence. You failed to take proper care in upholding what was your end of a contract, and you did so multiple times. And just given the number of instances in which your thinking was (to your own admission) 'faulty', and the number of times that you were contacted and warned of a potential violation, regardless how ambiguous that was, you just displayed pure negligence by doing everything but what should have been done to uphold your duty of care to meet your own obligations. That's just negligence. In any real world scenario where you'd have any fiduciary duty to uphold a contract, something like this **would** be negligence. And for your whole spiel about how you're not the type of person to violate these rules, well, justice is blind, and you do not need a mens rea to commit and offense of a rule or law. You clearly violated the policy. You violated 16 times by skipping 16 tests. I think the sanction was appropriate considering the safety of the community was at stake, and the fiduciary duty the school had to uphold for every other student in ensuring COVID did not spread.

One point I haven't seen in the comments: I think you may be hurting your case by including elaborate descriptions of your COVID-responsible behavior during the time you weren't complying with the testing requirements. It can come across as an attempt to reduce the validity of the testing regimen, made worse by the irrelevance to the question of why you weren't complying.

For me, after you mention you have a condition that prevents you from generating excess saliva, why did not not contact your GP/Physician immediately for confirmation of this and pursue other avenues for testing? All in all, it seems this video is like a lackluster excuse for your dismissal. You had clear, fair medical grounds to make a case before letting it get to a dismissal stage, I dont understand why you let it spiral out of control. In any case, your best option is to seek legal advice, gather evidence of this condition and have your legal rep. present the University with the documentation and have all contact go via your legal rep. It will cost you money, no doubt about it, but can you put a price tag on your education, especially given how you handled this initially? I wish you the best of luck and I must admit, what they expect from you to attempt readmission is an absolute farce.
