I've see so many older people who will lose pensions and benefits if they marry forcing oldsters to "live in sin" If they live together without making it legal. Adding to Gen Li, marriage is not a govt institution unless you choose to make it one. You can have an unrecorded wedding that should absolutely count in the eyes of God, based on what the Bible says. Following govt policies that (purposely or not) have you living in sin, especially for financial purposes!, is choosing sin--there is no excuse.

@XFizzlepop-Berrytwist
@XFizzlepop-Berrytwist 4 жыл бұрын
Sihinta S Well, I imagine that you should probably do a post nup every year, or two, so that the courts have documented records that are recent, in the event a divorce happens. And Pre nups are not being held up in court because things change a lot when you get married. One thing is that child support isnt a thing that is included in a prenup, and even if one person waives a right to child support, or you try to include it, it may not exactly be legal? Depending on state and federal laws. The best thing you can do with a Pre nup, is that you have your attorney, and your partner has theirs, and you sign it in front of of a judge. That will give it a better chance of holding up in court. Another reason why a prenup might be thrown out, is that ALL assets have to be disclosed, from trusts, to bank accounts, if even one thing was not included, it could be seen as trying to hide your assets from your partner. There are a few other things, but, if you want your pre nup to hold weight, do your research, be extremely careful, and take as many steps as you can to make it more official, and talk to your lawyer.

It wasn't clear to me what her intentions or motives were for asking about a pre-nup. Was it to protect her assets or figuring a way to get his. She did say he had a much higher net worth than she did.

Prenups? Aren't they worthless? Haven't they been nullified, voided, invalidated, and otherwise made to no effect in so many jurisdictions, even when the 2 considered them fair & acceptable at the time of signing? Why waste money on lawyers when courts will later act like the paper never existed?

@@rickm6076 It does make sense to have regular amendments to keep provisions up-to-date, I guess. But at the same time, that does also sound like extra income to the lawyers, too.

They definitely should have attorneys and get a prenup. If he outlives her he could exclude her children an vise versa. My grandpa remarried and step grandma ignored his wishes when he passed. She gutted the house before the family came over the next day. She had Moving trucks and gave everything he’d promised his daughters to her kids. The one saving grace is he had stock in his and his daughters name. She couldn’t take that so she reluctantly turned that over. She then went to live with her daughter that told her she could live in a resort like senior citizens community for free on public assistance. Her mistake is Washington state contacted California and found she had a home in her name. She was ordered to pay over $80k in rent and a lien was placed on the home. She had quit claimed it to her daughter but that was after she filed for assistance and claimed she was broke. At the time the house was sold for $150k. If she’d waited a couple years the housing market recovered and it sold for $400k 3 years later. The stock wasn’t worth much that was give to my aunts and mom. But now the stock that just sat collecting dividends is worth more than $150k to each daughter. Karma knocked the evil step grandma out. Now she’s broke and living with her daughter that was on welfare all along. She doesn’t get benefits because she was caught fraudulently filing for benefits.

No, no, no. If they live in a house he buys, title should be in his name. He can grant her a life estate. That gives her the right to occupy the house after his death, as well as the duty to maintain it and pay the property taxes. When she passes away, the house would pass according to his will.

Why a will? Illinois is a TOD state for houses and POD's work for bank accounts. Let the survivors fight over the misc junk. Probably a good idea to just give most of the jewelry and other useless stuff to the kids NOW so you can spend the rest of your life having fun instead of taking care of this stuff.

Johnny Five well the courts act in the best interest of the child. I’ve never heard such BS in my life. If they really cared about the child then they would have given the father 50% custody. But as usual I’m assuming that the feminzazi courts bared the father from the kids life. Statistically speaking, child raised without a strong father figure to guide them make up 70% of them prison population and they get worse grades in school. Shows just how they act in the best interest of the child.

I got a reply from a person called Anthony h and it shows on my inbox but not in this comment thread. I don’t think its a good idea to get more people in prison. Its a drain on tax payers. What i was saying is that its better for a father to teach their sons and daughters how to become productive members of society. That’s why a father should be involved in kids lives when ever possible. It really pisses my off that the family courts ban kids from interacting with their kids. Then those kind grow up to be drug dealers and school dropouts. Well shame on the courts that claim to act in the best interest of the child when in reality they want the children to grow up to be drug dealers

@@ericaspeare2175 Very much so. We don't live in the 50s any more. No contract should be entered into where dissolution can occur with so many open ends as marriage. Termination should be very well detailed before you enter into it so you know exactly where both parties stand.
