Not in the state of Florida if the taxes aren't paid by the owner the house or property goes up for auction, the initial invest gets their money back plus the investment. Or if no one bids on it at auction that is the only way the investor gets the property. These things are different state to state. and county by county

Caution: This is not a sale of real property. It is a lien for the amount of delinquent taxes plus interest and other fees. Contact with property owners initiated by certificate owners to encourage payment at any time is not recommended. Contact or behavior of a certificate holder deemed unfair or deceptive may result in criminal prosecution. An "Action to Foreclose" filed in the Superior Court three years from the sale date is the only method to compel payment.

Im reading in Palm Beach County Florida that holding a lien certificate does not mean the holder will receive title to the property - the property goes to the highest bidder ? My question then is does the tax lien holder still get paid ? I would think so.

How about when the Tax assessor sells the property for more than the taxes owed, but does not remit the original owner the difference but just pockets the difference as in Michigan and now Massachusetts? Which amount is owed the tax amount or the actual amoint given to the State?
@JasmineGee
@JasmineGee 2 жыл бұрын
Actually there is a such thing as surplus funds in Florida. Not sure if it’s the same for MI & MA. Once they sell the home at auction, the original owner of the property is due to the excess. But the catch is, you only have 120 days to claim the excess. If not, the county retains the funds forever.

Hi, I might be a few years too late to ask. But what if the property doesn't have anything built on it? If the property is just a small fenced up lot, and nobody lives on it, is it smart to pay for their delinquent taxes? what would be the downside of this particular scenario?

I have paid the property taxes on land left to my deceased Father and all his deceased siblings for the past seven years. Is it possible for me to obtain ownership of this land now?
@alexanderk7422
@alexanderk7422 6 жыл бұрын
Miss Elmyra... Is it possible to obtain ownership?...That depends. if you were simply paying the taxes (and can prove it) you may have a legitimate claim but you don't own property yet... The problem is that you were keeping the property in good standing with the local municipality so, in their eyes, whom ever the previous owner was is also in good standing albeit deceased. If you physically have the deed and your fathers death certificate as well as all receipts for paid taxes under your name... you have a good shot at having ownership transferred to you. My suggestion is to talk to a local attorney because these procedure vary greatly depending on where you live. Be careful! People get extremely shady when it comes to real property in which ownership is up for debate.

In Texas real property statutes provide several ways in which a property can be conveyed to an heir when the previous owner died inteste (without a will). One way is to use a Small Estate Affidavit. Another way is to use an Affidavit of Heirship. However, that Affidavit of Heirship may take up to 5 years before the property can be conveyed to the heir. You should check your local County Clerk or website to see if your State provides such legal remedies for your situation. Hope everything works out for you.

Well things went sour we left and left the trailer there. A year later I went to pay my personal property tax and they said well you own for a trailer for X amount. I said no ma'am we dont iwn it. The trailer never had a title only a bill of sale and filled her in on the story. Well after an hour of argument they finally determined I didnt own anything. This is a sticky situation because depending on who is paying for Grandma to be in the nursing and whose name is on the deed along with how long their name is on the deed, that property could go to the state regardless. If Medicaid is paying for her nursing home and her name is on the house, they could take ownership since they covered her stay in the nursing home. If she switched it to someone else's name, there is a 5 year(?) Period that if she passes away, Medicaid/the state could come take ownership of the house. I recommend getting with a lawyer and discussing the specifics

Property taxes should be called once a year rent. Reason for this is if you have to pay someone to live somewhere that is rent. I don't know anything that i actually own that i have to pay once a year to keep. This does not apply to my clothes, my TV or my ps4 or anything else i own. Honestly i don't own a house because i pay rent. But does the supposed home owner's actually own their home ? Answer no they do not. Property tax is by default unjust.

The government will always be the actual owner. Your fighting over who gets to be the Tenant. The original property owner was killed and the property stolen. The Government. The tenant is sold(actually rented) this property. They think they own it. The reason the government put a tenant on the property is because if the property is not income producing (taxes) it is a liability. Now the deal is sweeter for the government than it is for a Landlord. A Landlord is still the first renter. They will insure, maintain, and pay the taxes. They will pass on the expenses to the tenant. The government being the ultimate owner just collects the rent while everyone else pays and does all the work. You can’t win. We are all tax slaves on a big tax farm.

Please help I lived with my common law since 1988 and now he died in March 2018 and now the family sold the house and his niece promised me $50,000 and $10,000 relocation fee for the Taxes and Mortgage and fire insurance I paid for years. Yet when Louie got on Disablity cause he could not work anymore I been paying the Mortgage and taxes for years(Since around 2010). I got proof payed it through the Banks. Now they changed everything and told me they would give me only $2,000 to relocate. And said the lawyer said she had no right to offer me that much cause Louie's son who is in prison for a drive by shooting and the say. I was told he has no rights as long as he is in prison. It is the reason they sold the House(Cash only) cause no Will. Probate Courts told Niece who has power of attorney has a small window of opportunity to sell. Or it goes back into Probate. The son in prison will never consent to the money she offered. California does not acknowledge Common-law. They only gave 3 days to move out. Heard a Friend says his brother stopped payment on Mortgage He paid it off and moved in. Paid on it for years then his brother took it to court to get house back. Courts would not give him house back cause his brother paid taxes for years.What can I do? 3 days is not a lot of time for my son and I to relocate our selfs. Please your advice is much appreciated. My son and I are on Disbality and price of living in California is very high. They are actually throwing us in the streets. With $2,000 relocation fee when in reality it is much more. We were to stay here for 6 years and pay mortgage until he gets out of prison. But it all changed.
