Notice Period is a tool for the benefit of the employer. It serves multi-faceted purposes, firstly it informs the employer of the will of such an employee of his desire to quit and while the notice period is being served, it gives the employer an opportunity to look for suitable replacements in the stead of the out-going employee. So Notice period basically is an intimation of the will of the employee to quit and thereby giving the employer enough time to look for suitable replacements.
Notice Period are necessary so as to ensure that the employer does not suffer because of the rash and negligent acts on part of the employee. Monetary penalties can be levied upon an employee if he decides to act rashly and ends up not serving the notice period. Also it is important to note that there is no mandatory notice period that an employee has to serve, there is no statutory provision providing for the same. It all emanates from the Employment/Service Contract.
If the Employment Contract specifically lays down the existence of a notice period in an organisation, then the same would have to be served before getting relieved from the duties. In such a case if the employee decides not to serve the notice period then either he can buyout his notice period that is a form of compensation to the company for the employee not being able to serve them for the mandatory time frame that he was supposed to or either if the company can show that they had incurred expenses for the hiring of such an employee and his rash action was that he decided to quit without serving the notice period then they can claim compensation in addition to the buyout from such an employee.
It is also not always necessary that an employee will be at the receiving end if he has quit before serving the notice period, he might not face any hassles for the same, in order be eligible for monetary compensation from the employee, the company must be able to show that they had incurred losses because of the acts of such an outgoing employee, and also the employment contract stating something to establish that end. It is the employment contract from which all the rights and duties of the term of employment emanate from and it is essential to abide by the terms of such a contract. Also it is always advisable to serve the notice period and then get relieved because it is only after that an outgoing employee is eligible for the full and final compensation, relieving letter and the experience letter, so in order to avail all of those benefits one should serve the stipulated notice period, in absence of which an employer can hold onto such benefits and in addition hold the employee liable for monetary compensation.

I have resigned in my company where I worked for 5 years as I got new opportunity in another company. My new company wants me to join in 45 days but my current company has notice period of 3 months. In my offer letter of current company where I am serving Notice period, the following clause is mentioned : 1. During probation or training period, your services will be liable for termination with a notice of fifteen days from either side without having to assign a reason. 15 days remuneration shall be payable by the party terminating the employment. 2. On confirmation, your services will be liable for termination on a one month notice or remuneration in lieu thereof, payable as per the company's rule. This offer letter was given to me in 2015 but in 2017 I(and everyone in company) was given a written notice that Notice period is revised to 3 months. So, am I eligible to pay the salary of the remaining days in case I do not wish to serve complete notice period? Can my current employer spoil my relieving letter or background verification in exchange as HR has verbally threatened me on call of which I have recording. I have completed 20 days on Notice period but if I serve complete 90 days, my next opportunity might be cancelled as next employer needs early joining. Please advise.

I resigned my job but haven’t go to office because of health reasons (accident) which happened 1 month before accident. I need to be bed rest for 1 year. So I applied resignation. At the time of resignation company said to serve 90 days. After completing the 90 days of notice period I asked for clearance certificate but company refused to provide as I haven’t serve notice period by Attending work. Whether notice period means to attend work or 90 days written notice is sufficient

I was a confirmed employee after my resignation company relieved me in 2 days and gave me the experience letter on the same day which I was relieved. now company after one year asking me to pay one month salary with a letter stating according to the appointment letter( there is no employement contract). in this case, what would you prefer to reply to the company

Hi i have worked 4 years (till 2020) for a medicine company named lupin limited. On march 2020 i came home for leave but cant go back to my work location due to lockdown imposed and border sealing of the state (sikkim) where I work. Also company stopped paying me any salary since march. So i decided to stop wasting my time and mailed them my resignation but they refused to give any response and threatened me to mark as absconding as I have not dome any notice period. Please help.

In employment contract there is only written 15 days notice given is mandatory or else 15 days salary will be deducted. My sister was not able to complete notice period due to serious hospitalisation of family member. Now, company demanding 8500/- which is never mentioned anywhere. I am working in US staffing company I am in probation period of 1st month. company had not given any specific kind of training instead of understanding of their software in which we have to work for them and I have signed an agreement of11th month. And if I leave, I have to pay them 50000 rupees. I am not comfortable with the work culture as well as the environment and I am not able to do the work in night shift. Now I want to leave the company.Is this bond is legal in the court? if I leave the company, Company may able to register case against me or not? Can i abscond or give my resign? Please reply.

Sir, In my appointment letter a condition is mentioned such as " Your service may be terminated with one month's notice or one month's salary in lieu thereof from either side for which neither side shall be required to assign any reason". On the basis of this point can I resign with immediate effect with refund of one month's salary? And what is the meaning of 'Salary' here? Only "Basic" or "Basic+ All others" or Gross Salary?Please share your valuable opinion with reference of any Section or Act which I can mentioned at the time of my resignation if required. I am a software developer working remotely for an organisation based out in Bangalore. I am currently serving my notice period of two months. I have already initiated my resignation email on 19th April but haven't received any acknowledgement or acceptance from concerned person thou i have even sent three reminders too. I have joined this organisation four months back. I have shared this scenario to my future organisation as well and they are ready to consider my joining without any documentation from my previous employer. For the past 1 year I'm working from home for my company and I had an argument with HR after that I send my resignation and asked what to do for my letter (experience latter) but they never responded and I was waiting for management response so I send 2nd letter for update and they did regarding my resignation but they accused me of Absconding in reality, they never send me any message or call or any official warning letter rather they change my office email id password, not responding to my mail and now telling me after explaining all things between me and HR as well why I took this decision in writing to the boss but Boss send mail "Mr. You send resign not notice you should be grateful I didn't ask for notice period compensation". but I never told them on any written document not even in my resignation I'm not going to serve so why are they making assumptions and making decisions without my consent what to do?

What if an employee served partial notice and offered the company to pay in lieu of remaining notice period and the same thing is also mentioned in the agreement that "if any person failed to serve full notice then he has to pay for the damages caused to company", then in that case, can a company hold his relieving or experience letter? Sir I have one question, I have resigned my position in my current company where there is 3 months notice period, it's just impossible to serve this notice period because my new recruiter cannot wait for 3 months. It's question of my career and life. But there nothing mentioned in offer letter regarding buy out or buy back option, even not mentioned any calculation. Inspite of this I agreed for paying 45 days whatever the amount and 45 days I serve my notice. I agreed to this because my HR told this. Another 45 days is Buy out option. What to do sometimes we may have to face such sick mindset people. Even they not valvued my 10 years of Service here.

Sir maine ek choti company join ki thi 7 dec 2018 ko. Na toh mujhe offer letter diya gaya aur na hi koi agreement sign karwaya gaya. Aur maine company isliye chor di kyonki mujhe time par travel expence nahi pay kiya gaya toh maine 23 dec ko com chor di

Sir me jis company me kaam karta hu usne muje offer letter diya tha usme likha tha ki 6 month probation period uske bad confirmation letter milega but sir 1 saal ho gaya hai muje letter nahi diya aur abhi muje job chodni hai to muje notice period bharna padega

Hi sir.. in my organisation is 3 month notice period but I just served one month then my previous employer cut my 2 month basic salary from my full n final settlement in that case can my company have to give me relieving letter and experience letter plz guid..

Yes if they cut penalty they will have to provide relieving. Were you in developer role ?

Sir, i am presently working in a PSU on regular basis. I have floated the resignation latter on 10th December 2018 and my last day of working is 9th march 2019 as in my organisation there is requirement of 3 months prior notice. But now I want to extend my last date of notice period i.e. 9th march 2019 to 31st may 2019. Is it legally possible??? Pl. share the format here for extension, if any. Thanking you

Sir mene exam diya tha govt organisation me job k lie....but final list me selected nhi hua....but kch month k bd company ne contingency (reserve) list nikali jisme mera naam aya or mra medical & DV hua.... 10 month tk koi news nhi aai....fr ek email aya ki apka contingency list se naam hta diya gya h....koi reason bhi nhi btaya.... Ese me mujhe kya krna chaie....? Ky iska court case bnega or ky mre favour me decision hga....?? Plz help sir

Sir. I m working as a contractual basis in central govt hospital . And selected for permanant post for same post and also got appointment letter . As written in our contract that we have to pay one month sellary if resign by 24 hr notice . But as I m joining in same institute is it also applicable to this situation?? Will I have to pay penalty ???

hello sir myself Vishal Sunil Chavan got ur profile from my friend aditya Sir i am in a situation where i need ur consulting . Sir i am Junior engineer trainee at Schneider electric ahmednagar plant . During this second wave of corona my family condition is not good i lost my grandfather and also my dad were serious in hospital also my mother and I were positive due to this i didn't go to my job at Ahmednagar as i taken leave and came to mumbai . Due to this i didn't go to job for 2 months and after seeing condition of my family i decided to resign from my job and i reported at my job and given resignation but the HR is saying to pay for 2 months and additional notice period salary which is 3 months salary is around 60k otherwise they will be absconding me and told me they can file police complaint for not paying but and i also don't sign any contract for that . I also reported to my job and given a proper resignation to my reporting manager but HR is telling me pay 60k . will they file police complaint against me am just a trainee worked for 6 months

Dismissal letter is experience letter . Company won't issue any other letter in case of dismissal/ termination. You can get your PF. It's your money. Log in to epfo website for details

Sir Maine koi contract sign nhi kita or new job Milne par without notice period chhod diya. Mera Gruitity baki hai kya company mujh par legal action le sakti hai

Hello I have worked with one company and when I got the better opportunity I approach HR for immediate resignation but they not agreed. I joined the next company leaving that company on immediate joining basis. But my last salary slip has notice period recovery deduction. Do I have a right to ask for a relieving letter?

Maine resignation de diya he, par notice period me kam nahi karna chahata hu, aur ab mai job me nahi ja raha hu, to compnay ne notice diya he ki 2 mahine notice me kam karo ya fir paisa jama karo, ager mai na paisa jama karu aur na hi mai notice me kam karu to mere against koi legal action company legi ya fir avoid kar dega....aur mai free ho jaunga. Mujhe 8 mahine se bahut buri tarike se tourture kar rahe the ealiye majburi me reaign dena pada. Ab mujhe bol rahe he ki paisa jama karo ya notice me kam karo, to please mujhe batawo ki kya ho skata he.

Mene 30 day ka notice Diya Tha our mey serve bhi kar ne ko ready Tha but company ne Mana Kiya Mera notice period our Mera trfer letter Diya but muze transfer hona possible nahi Tha tab company ne muze termination letter Diya. Me ab kaisa recovery karu Mera Experience letter and salary please guide me

Sir mera Manager bol raha hai ke tumhare wajese company ko crore rupee ka loss ho gaya hai. Isliye tum chorna cha rahe ho to chordo par tumhe release letter nahi milega. Hum bohot tension mai hai Sir mera future ka sawal hai hum is company mai 10 saal kam kiye par aaj tak humko ek worning letter bhi nahi mila ulta appreciation certificate mila. lakin aaj jab hum chor rahe hai or relese karne mai shirf 15 din baki hai to mere sath aisa ho raha hai.. plz assist sir.

@@chetandeverji3130 I'm also don't serve notice period due to Accidental illness but unfortunately one email comes to me . i have to pay 42000 for not serving notice period. I informed i have an accident but they call right an application with medical documents and send to our email than we make decision after but mostly you may have to pay? What I do brother?
