Hi Sir, very well explained. As you have said that with example.. In my situation, I m a home buyer booked my flat in 2012 under subvention plan and bank paid directly to the builder total loan amount. The builder paid interest amount to bank directly upto 2016.Now builder sold the same flat to some other buyer and no response made to me in several attempts. I have approached consumer forum but builder not responding since 2years. As per NCLT code, i can file a case aganist builder to recover money n close my bank loan.

Sir,I want to know that whether Dues of Govt organization like Employees State Insurance Corporation (contribution under The ESI Act,1948)Can be settled by this act By NCLT or any person .Suppose, a company has to huge dues of ESI Corporation and case has been filed before NCLT and NCLT has liquidated the company by its order,then who will pay the dues of ESI Act?? Hi, Very nicely elaborated about Insolvency. My question is - A corporate debtor who filled insolvency under section 10 and proceeding are on, simultaneously financial/operational creditors filled sec 138 case & some civil case for recovery against directors . As per current act all criminal proceeding will be continue and civil will be on stay. My question is if COC decide to go for liquidation then in this case what will happen of sec 138 cases ? Will all parties who are in COC or not will accept the haircut and withdraw their cases or if they don't accept the haircut then what will happen ? If company is liquidated then also these cases will be continue ?

सर् जी अगर कंपनी liqudity मे चली जाती है तो एम्प्लॉइये को उसके हिसाब मे किया मिलेगा जबकि irp ने insolvency मे जाने के बाद एम्प्लॉइये को 9 महीने तक सैलरी नही दी।

I paid 30 lakhs through Rtgs advance to a limited company to receive stock for business. Due to some reasons I decided to withdraw from the business and asked for my money back. Even after repeated reminders they are not responding properly. Can I approach NCLT regarding this case? If not what is the best course of action?

Koushal Agarwal you can file paetition under section 7 & 8 of IBC given your debt is not disputed.

You may approach NCLT for recovery of dues ..you may be financial or operational creditors. NCLT is the forum u should approach
