International Court rules China's claims in South China Sea illegal | DW News

Some 20-33% of global trade by sea passes through the South China Sea. It is also home to rich fishing grounds.
Located in Southeast Asia, the South China Sea is claimed almost in its entirety by China, through what it calls the nine-dash line. China has over time militarized many low-lying islands and coral reefs in the area. But five years ago today, an international court effectively ruled Chinese claims to be illegal. Particularly in regards to Scarborough shoal, a low-lying rocky outcrop that, according to the court, falls within the Philippines’ territory.
The binding ruling by the Hague-based Permanent Court of Arbitration was in response to the Philippines taking China to court. But China refused to acknowledge the verdict. As a result, Filipino fishermen to this day are prevented from accessing the coveted fishing areas there.

Why do you think the western powers are always "liberating" resource rich countries but ignores those without resources in genuine need of assistance? Why do you think NATO exists? Why do you think every country has a military? Why do you think yankville built their entire economy around military conflict? What do you think the conceptual point of sanctions, embargoes and tariffs are? lol, wake up champ geopolitics is still very much about military domination for resources and as resource scarcity increases that will only increase. Do you know there have been a series of wars fought over sand since 2010? They fight over the sand because only particular types of sand can be mined for building and it's only found in limited places so everyone wants to control it.

The last 10% are almost all "rice and wine" friend or leeches just interested in china's money or support to the ruling government. The only strong friend china has is Russia because they both have a long history together and they both have issues with the usa. I think renaming the "south china sea" is a good place to start. Calling the region "south china sea" is like implying that it's China's or belongs to china which is the root of the issue.

I think this would not make any difference at all. The name "South China Sea" is internationally recognized and used as a common term for navigation for centuries. The name was given by the Europeans since hundreds of years ago when they started coming to this part of the world. The Europeans naming it "South China Sea" does go to show its recognition of the major cultural and political power in the 15th & 16th century at the time when they came. Countries like Malaysia, Philippines, Indonesia, Vietnam did not even exist then, so how can they lay any historical claim to it? The various kingdoms occupying the South East Asian lands paid annual (or other periodic) tributes to the Emperor of China. Chinese junks did dominate the seas then. If we want to go by duration of usage and control, it is plain why China made its claim. This of course does not sit well with modern politics when everyone wants a piece of it because of the economic and military advantages. The 9-dash (previously 11-dash) line is not new. It was drawn almost 100 years ago based on older documents. Neither was it a secret. Taiwan claims the same too, except it covers an even bigger area with 11-dash. A number of the islands in the South China Sea were declared to be returned to China by Japan after WW2. There was no real issue until the modern institutions of UNCLOS in 1982 - when old concepts cannot sit well with new concepts.

@@freeworld88888 It's comical (and absurd) that a country can say, "we have a map with 9 dashes on it" and therefore we claim ALL of the sea in the area apart from the coastline right next to their many neighbours. With that logic, any country can draw a map, put dashes on it (is 9 a magic number, or can it be any number of dashes?... and do dashes have to be on the map or can it just be lines?), and then claim any territory they want - as you can see now, that would be beyond comical, and absurd. - And so if Taiwan or Vietnam make a make of Asia, and draw dashes all the way around China, can they then claim China as their own?

Yeah, having their name in it definitely isn't helping matters. Should probably name it something more like "The Polynesian Sea", since much of the polynesians came from roughly that area over history. Or something like that. China has such little claim over that body of water it's not even funny. Historically, they techincally originate from inland further than they claim in modern texts. If I understand correctly. This basically means that while the ancient peoples that China conquered might have had sea access at one point, 'China' itself did not. China is quoted here because ultimately it would have gone by a different name back then, but I don't know it.

The problem is that if the Philippines get the islands back they know the West will be demanding preferential terms for US companies to exploit the oil, and pay up for protection fee. Philippino fishermen have no say. The Philippines will again be a colony of the US. The Philippines cannot be like Saudi where the US prop up a dictatorship and suppress the masses. The Americans will support a Philipino dictatorship to protect the interests of their oil companies and military establishments. You see it everywhere in the world.

I live in Texas. Not many people know this, but we have been part of Portugal, Spain, France, Mexico, Republic of Texas, The Confederate States of America, and finally the U.S. Historical claim could even be offered to native people, but at some point you simply have to recognize that ownership history has little to nothing to do with land. DW should stop propagating misinformation. The so called permanent court of arbitration is not an international court. It is just a private arbitration setup that is based in the Hague . It is not linked to the UN. It provides a venue, administrative and secretarial services for parties seeking arbitration. China did not want to participate in the arbitration as it infringed on some terms in UNCLOS. Philippines then went ahead with an arbitrary arbitration which is non binding and nonsensical as there is no such thing as arbitrary arbitration.

They didn't really think it through when they filed that case and now people are warmongering and these Filipinos with deep colonial mentality are calling for the US to protect them. Not in the traditional sense, it provides services of arbitral tribunal to resolve disputes that arise out of international agreements between member states, international organizations or private parties though. Either way, you do not need to be a judge or legally trained person to see on first glance that there is something really wrong with the claims made using the Nine Dash line, it is straight up bullying.

It's called South China Sea because it's a sea south of China, not bec it's a sea of CHina. China was a very poor country back then and purely agricultural. It was never a maritime country. Also, the south china sea was used not bec China owns it but bec China is the biggest country and most distinct or well-known country in that regions so it was used as a reference, not bec China owns it. Even early 20th century maps didn't show they're part of China, while old Philippine and even 16th century old European maps show they're part of the Philippines. Besides, geographcally speaking, they're much nearer Philippines than China. Also, China is the obvious thief here. Just look around you, it has many territorial disputes with all of its neighbors. So the China corona virus producer is the real thief here. The world knows that fact. Before you claim things that aren't yours, make sure you claim your own China COrona virus, a lot of you even kept on denying it.

that arbitration and its 'ruling' was problematic (ie. japanese anti-china head judge who assembled like minded panelist judges, legal team for the philippines was linked to pres. obama, manila paid the 30 million dollars price tag/expenses, the judges themselves gave a 'ruling' that ran counter to their own decisions in other similar cases, etc.) that even the UN and ICJ gave a press conference to distance themselves from this politicized arbitration/ruling. even the EU and ASEAN distanced themselves from this 'ruling.' also, u.s. and japan themselves had in the past rejected international arbitration rulings against them (illegal military intervention in south america, whaling)... so it's hypocritical that china is being asked to accept the above dubious 'ruling.' people should read more about the details rather than completely relying on the sensationalist one-sided headlines. i am not anti-china nor anti-u.s., but a legal procedure should always have neutral key elements processing a (or to let a) natural outcome/decision be made possible. in this case, everything was biased, with not even some impartiality present, from the outset. it's no wonder china could not, and will never, abide by it. no common sense country/party in china's shoes could/will, i am sure. even the ICJ specifically pointed out some of the problems and inconsistencies with this arbitration and its 'ruling.' hence this 'ruling' has no legally binding power nor can it be enforced because the foundation of its judgment-making processes is totally suspect. it is, in essence, a 'farce of a ruling' that experienced global/international legal experts cannot honestly and professionally call it as an 'uncontaminated' judgment.

On the islands of South China Sea, ancient Chinese relics like temples, coins, porcelains, china artifacts and clay makings were found. These relics are ancient Chinese because at their same time, no other countries reached the same smelting or china/porcelain/pottery making skills. Only China could do that. This is one evidence Chinese lived on the islands. China owns the 9 dash area of South China Sea. UN and most countries admit this fact. For example, it was US warships that carried China soldiers cruising that sea in 1946 to declare China sovereignty over there.

From what I can see based on China's action. Everyday they trained their military forces inside and outside of the south china sea while simultaneously trespassing it's borders. If Taiwan got occupied by China then Japan and South Korea will have a big economic problem and may also be occupied due to the influence or military intimidation. Once they occupied the big 3 they may start to spread influence and slowly occupying the whole Asia and it will be a very, very problematic for its rivals to stop them. In conclusion Taiwan's Independence is a very, very important role against China's action in the future of Asia.

@@nunyabiznes33 I think it depends on China's action if they want to make a diplomatic or aggressive stance on both sides which will be a harder part of the decision of the US and its allies. If they occupied Taiwan, there will be restrictions which will cause economic trade to collapse and US military reinforcement access will have to enter Taiwan.
