Friday 13th really was a bad day for the Backpacking Community. The High Court ruled that Wild Camping in Dartmoor National Park is illegal. There has been an ongoing case between Dartmoor National Park Authority and Alexander Darwall over wild camping in dartmoor.
The interpretation of 'open air recreation' has been the centre of the argument. Although wild camping in not specifically stated in the Act of 1985 it has always been assumed wild camping is legal in Dartmoor. Unfortunately this is no longer because Darwall's Team argued wild camping is not open air recreation and wild camping should have been stated in the legislation.

This is unfair because the wording is general on purpose so as to encompass all open air activities, not just walking, hiking, horse riding, picnics, etc. Everyone knows a wild camp is recreation.
The judgement may prompt over Dartmoor National Park land owners to follow suit. The judgement could also make other land owners in our national parks think twice of turning a blind eye to backpacking and wild camping in england.
For me, I will continue to support the Dartmoor National Park Authority and groups such as The Starts Are For Everyone.
It should be noted that Alexander Darwall owns 4,000 of the 86,000 acre Dartmoor National Park. Other landowners may not require permission but until this is official it should be assumed that permission is required so as not to break any laws.
I will also continue to wild camp just as I have been following these principles:
Leave No Trace
Pitch Late
Leave Early
Pitch away from footpaths and animals
Pitch about the highest fell wall
Take all rubbish away with me
It is very disappointing and I really hope the ruling is overturned.

So what? They have done well, they deserve the fruits of their labor. Possibly they risked financial ruin at points. You are only looking at the end results, you don't know what it took to get there.

I wild camped in Colorado last year. Many, many, many people leave trash, empty beer cans, booze bottles, even old grills, old camper cushions, trashed tents scattered around designated and undesignated sites. I talked to a Forest Service ranger and she said they will soon be instituting a reservation system and it will now cost $ to camp in previously free areas. Once again the stoopid few have ruined it for the many.

See, I’d understand if that’s what it was like in Dartmoor but people respectfully camp. I don’t see they’ve given the land owner any reason to take this to Court.

I would carry on regardless where ever in the UK and like you said Andy, arrive late, leave early, out of site and out of mind and take all the litter you find home with you. The people who light BBQ's need sorting out first and the litter louts need hefty fines like a £1000

My heart bleeds for my brother and sister fellow wild campers in the UK. Your rights are surely being slowly eroded. "Circle the wagons" don't be bullied by the arrogant rich landowners. I was shocked at how much of England was privately owned. Last year I hiked a large portion of the Sandstone Trail... so much of it was through private fields. Come to Poland, we have so many forests and areas that are owned by the State - where many areas allow wild camping.

It’s a civil matter, the police won’t get involved unless there’s a possible breach of the peace. Carry on camping but leave no trace.

Unfortunately, the land in Britain is overseen in a bureaucratic manner. Nothing is truly "wild". This is a hangover from the feudal era and massively classist systems we had in place for hundreds of years. Landowners /lords/knights etc who owned the land and serfs / peasants who got to stay on that land if they helped work it. However, as long as you're savvy, you can still wild camp in most national parks. It's just not "technically legal", yet, unless you are in plain sight of a farmers house etc, chances are you will go completely unnoticed. I wild camp regularly and have had no issues. There is no way, for example, that Dartmoor landowners can oversee every part of the park and prevent people camping. It's too big and they're never gonna go to that effort.

In Australia the National Parks are crown land so owned by the public. Crazy that National Parks could be owned by private individuals to me.

Aussie here as well and I had no idea that national parks in UK weren't government owned land. Still, more and more it's being stopped in Australia as well. Most of the popular spots are now banning 'dispersed camping' and setting up hiking trails with paid hiking in camps at silly and restrictive prices. If you want to do the Grampians Peaks trial it's $47 a night. Public land should be for everyone and hiking should be something everyone can enjoy, not just those that can afford it.

@@gavanmitchell9095 My experience is its a bit like Andy here says if you are hiking and setup a tent late and pack up early no one will know really anyway. Maybe the bigger tourist areas are different but I try to avoid. Local NP I have a couple spots can hike into not well marked or old tracks and camp no one would know but technically not allowed to dispersed camp. It is a worry what Parks are doing in Vic though with a few of the parks and walks. Alpine and Wilderness Coast a worry to me.

@@iamapopsicle9457 Yeah, and even the Walls of Jerusalem National Park in Tassie are fending off investors from helicopter in cabins. Heavier hiked areas they may be, but that's also what's accessible for families at times. There's a lot of money grabbing going on, and I'm not convinced it's going back into conservation or preserving the parks. But yes, I'm sure you can be gone without anyone knowing you were there. It's just a shame it has to be that way in a lot of places.

Mr Darwall should now make it clear where his particular 4,000 acres are & fence it off + put up signs stating the use of the land, because if he doesn't, people won't know if they're on his land or not & so any prosecution would be impossible.

@@mendyviola Dartmoor is a peat bog (essentially). There are no trees. Mr Darwall would need to plant trees, then paint stripes on them.

The last thing that is wanted is fencing on open Moorland,,there are trails crossing the land and archaeological stones and remaining artefacts ,,I'm, as I've said before going to continue wild camping

If wild camping isn't a recreational activity, what is it? I've been to Dartmoor wild camping a few times, in order to "reset". It worked wonders for my mental health to get away for a couple of days. Apart from a few other backpackers, no one would even know I'd been there. Now that's been taken away from me by greed and wealth. How the Darwalls can sleep at night being this conceited is truly beyond me.

Though I will always respect the land, I have very little respect for the landed gentry and the vast swathes of land that they own. I will continue to wild camp responsibly wherever I like. My only self imposed rules are to leave no trace and do no harm.

Who owns the peak district then? Ive been all over there and some parts are very beautiful yet also very remote, I cant imagine anyone finding me up there and saying "You can't sleep there its mine..." lol

With wild camping becoming very popular the last few years, I can see the worries of land owners because with mass interest you will get the idiots that leave rubbish everywhere, would it not be better for the owner to set up a small payment for a permit to wild camp , then use that money to keep the landscape healthy and clean,

Is it public land or private land ? You would assume a national park was the 'property of the nation'...aka public. This is why you can not sell public land to private owrnership and or enterprise. Even those pertaining to be public bodies, while claiming private ownership on the public behalf. Also if it was public land as a national park...who sold it via theft of public property ?

Arrive late, leave early has become a culture in the rest of England and Wales. But not for us on Dartmoor, where up until now you could get up when it stopped raining, decide to stay another night or move onto the next tor and spend a week on the moor. And all without once having to look over your shoulder and worry about lights.

Living in England makes me feel out of place and unwelcome. I've lived here all my life, but how unpopular my opinion is, that all land is shared land. How can anybody own a view? - Monarch of the Glen episode 1. Mistreating the land should be a criminal offence, but walking on it and camping on it safely and responsibility should not be.

The ruling is perverse and I will be ignoring it. To even suggest Wild Camping is not 'recreation' is ridiculous. The Wild Camping guidelines, leave no trace etc are good enough and I suspect most people have no idea I have been there. Its the elitist land owners that are the problem. We need a Right to Roam Law. I was in Sweden during the summer, you can pitch up pretty much were you want, nobody bats an eyelid. For the Law to be upheld it needs consent or obedience, this ruling should get neither.

Keep on camping, if the rules on wild camping changed in Scotland I would just ignore it and do it anyway, I always have a small fire, I make a point if it actually, but I always put it out and have it covered so you wouldn't even know. I don't know why people put up with this kind of rubbish, the - 1% get to make up all the rules and take up all the land, and the +99% get almost nothing? I think not.

Hi why can't they give a piece of land for hikers to travel to leave a box or something for us to put some money in to say thank you let us show them we respect their land do some compromising people have mental health issues and the way it eases some is buy hiking and camping its depriving our wishes I hope this gets resolved both sides.

It's stupid that wildcamping isn't legal across the board. It's great for the local economy and let's face it its a big money maker for the big retailers too. Could you see rab selling all those down filled sleeping bags for people going on a average campsite in the summer holidays ? I don't think so.

I am from Slovenia (Central Europe) where people have the right of roaming and pick the „fruits of nature“ (max 2 kg pp) independently the land is private of the government. Wild camping is illegal everywhere but not prosecuted unless it is in the National park - the fee is very high - about half a year's salary. My experience traveling around the world is that wild camping is illegal in all national parks which are with legal international status. Now the definition of wild camping... what is it? To oversleep, setting the tent, setting the open fire...?

It wouldn’t bother me if they introduced a license to Wild camp, like fishing. If you get caught Wildcamping without a license then you’re fined. This way true Wildcampers would still have access and would also appreciate the basics.. leave no trace. Personally I can’t see much change, for example I can’t see the Police driving an hour and half to Wasdale and hiking two hours to ask you to move on. 😂 You’re right tho Andy, leave no trace/have no fires, everything should be okay.

get a class-action appeal with the national-trust also get a petition going to support the national-trust appeal and wild-camping to be in a similar law and manner to in scotland us true wild-campers clean-up after those that don't care about leave no-trace what will the land owners do then clean up the rubbish themselves...?? who needs over four-thousand [4000] acres anyway...?? our almighty-creator did not give us land for others to steal away from us how many acres of the land doe the bible say we should be able to have each...?? is that not a fair amount of land and reduces any excess for greed...??

Ive wild camped for years and will continue to do so. Without upsetting landowners. I ask permission in nearly all cases. I make camp late at night and leave early. I dont 't light fires,leave any litter in fact you would know i have been there. So those like me will be able to continue. So what is the fuss. The only people you are fighting for is those that do not show any respect to the owner or the land. And land owners need the law on their side to protect themselves from the inconsiderate camper. Just let this one go.

Odd concept for National Park Land to be privately own for an American like myself to get a handle. Of course we have the Right Wing Conservatives here that would love to privative all public lands here. Madness.

No, no, it’s not over. Legally maybe, but for the majority of wild campers who respectfully camp around the country nothing changes.

People are forgetting the fact that wild camping is legal and probably never will be illegal. Trespassing is a civil matter in uk law, meaning that you cannot be arrested for it. As long as you are respectful of the property, leave if land owner ask you to and don’t damage anything (which would make it aggravated trespass which is a criminal offence) then there is nothing that can be done
