I was sued by Mudland and discovered from one of your videos they violated my rights according to 15 USC 1692g. I filed a complaint with the CFPB and BBB and they didn't show up for court. I was a little disappointed that the judge didn't dismiss the case but continued it for 60 days. Hopefully they will dismiss it all together

I was looking for a validation letter and sent one but got contacted by the creditor with no information or validation. But they wanted me to validate information, which I didn't do. I just want all this off my credit 2014 and 2017 is a long time.

Anything from 2014 should be gone from your credit unless it's a bankruptcy, and even then, you should only have one year left at most.

If you were sued by a third-party, tell them that you want the original contract with your signature and have it copied at a notary Republic and send it to you certified mail. Do everything through emails or letters. They do not have these documents they cannot collect.

If they're garnishing you, they've already sued you and won. (And, sadly, you lost). Every state has different laws about garnishment so unless you're in Florida, I probably can't tell you the right thing to do-you'd need to speak with a lawyer in your state. What if your collection letter is based on fraud or from not following a company guideline or a state law? I don't remember where I read this, but there's a way to turn/reverse the debt amount back on to the collector...???

I still get calls 9 years after the statute of limitations ran its course. It ran out in 2015 a few times a year I will get calls for a brief period. Mine was never reported to the credit bureau not even in the beginning

Unfortunately, we don’t have a referral for an Oregon lawyer, and we do not practice there either. You should be able to search for a lawyer who does “FDCPA“ or “debt defense“ work.

In the meantime, save every letter and log every phone call you get from them. Every time a debt collector contacts you, it’s a potential violation for them, meaning possibly money and exoneration for you.

Missing the court date is catastrophic. The court has now decided that you owe the debt and the debt collector has the right to take money from you. Payment is a great defense, but unless the lawsuit is dismissed, you need to defend. Also, that might be a debt collection violation if you’re being sued for debt you’ve already paid.

I am being garnished from midland now and they are reporting on my credit report a high balance when it is a lower balance can I dispute this on my credit report and have the garnishment stop.

If you were being garnished, that means you’ve probably already lost a judgment, which means a court has already decided how much you owe. You need to fix that problem first, because if you don’t, the credit report isn’t going to matter. So I found out that LVNV just filed a summons on 7/26/23 and previous to that I got a letter stating that Resurgent is their servicing agent to collect-it’s all confusing! Back to the summons…I haven’t even been served nor hasn’t been mailed to me. I found out about all this because they called my Dad with a file number and I looked into it. My Dad stated it started with the alphabet “CV” and so he thought it might stand for civil case? I looked into the clerk of court website in the Florida county I preside in,and it shows it was filed under LVNV and it gave a summons for the second week of September. My question is, if they never serve this summons by mail or in person is it a valid summons and should I respond back and ask for a settlement before this summons date? And is there a timeline of when there supposed to serve it? It all seems pretty fast. I’m pretty confused and have never dealt with this kind of situation before.

Collection Agency LNV funding asked for my dads email so they could send him a letter saying it isn’t his debt . The guy he talked to said it would take a couple days to send because it goes to a different department! Talked to them on Wednesday 04/19/22 if we don’t get the letter by Friday 04/21/22 he’s going to counter sue.

What if you disagree with the amounts on a debt? I have disputed the amount with the credit card before eventually they charged it off and sent it to Midland. However, the reason I was disputing the amount was almost all of it originated from late fees due to me not being able to pay the amount as I had lost my card and they wouldn't send one (needed a card to be able to get through their phone tree to pay the debt). The amount is less than a thousand yet I just received a final legal notice email from them. Not sure if they're actually planning on suing me or trying to scare me. In any case I do not agree with those amounts at all as its mostly late fees like I mentioned.

Hi there I have a question. I just got a letter that I'm being sued for 1600.00 from a payment plan catalog company. I had a few attorneys contact me as they saw I had a lawsuit going on about helping me with my case. I asked what their fee was it came out to the same as what I was told I owed from the debt collector who bought out my debt from a closed company. Is it worth still having the attorney in which I still have a hard time to pay or should I go ahead n my own? Btw the collector is lvnv.

If you’re already in court you should get a lawyer in your state immediately. Frozen bank accounts are a sign you’re already in deep trouble.

I live in Alaska and I called so many lawyers & they all turned me down bc of conflict of interests (represents debt collection agencies or they don’t deal with debt collections) I’m being sued by LVNV for 5K. If Midland put a lien on my home and then also garnished wages, is there anything I can do? Garnishment came AFTER I had already put a 90-day notice in with my employer and they only got money from my last paycheck. Is there anything I can do at this point? I have already requested documentation that the original debt (credit one) was mine with signatures, the documentation they they purchased my information from Credit One, documentation of my written consent for my information to be sold, and how much the purchased my information for. I have not heard anything back. Is there anything I can do at this point besides paying it? And how do I get it removed from my credit report? I'm in Kentucky. Thank you!

On your comment on our Texas video, I responded that you should call Bill right away. For anyone else he’s wondering, the mere fact that they’ve attached statements to your lawsuit doesn’t bother us at all. There are still lots of ways to beat these court cases, and it’s going to depend on exactly what they claim and how they are attacking you.

I was sued by midland and currently have an active writ of garnishment in which they are taking 25% of my pay. However, twice already Midland has dissolved the writ of garnishment. I am afraid they are going to send me another notice to garnish my wages for a higher amount than the previous two they have served in the past. Is this legal for them to do?

Good video and bravo on the responses. Being sued by LVNV in the state of Tennessee for an old Credit One bill. I dont dispute that I owe Credit One but my issue is i have NEVER heard of or recieved any type of communication, call or written from LVNV until i got their summons. I have sent an answer to the summons and denied everything in which they sent me a years worth of credit card statements. I'm hesitant to try and pay them this debt because of what i explained. Is it worth it to try to validate the debt or ask for a bill of sale from all the "creditors" they state its been sold too?

I have a court date in August in Miami,FL with TD Bank(Target credit card) I am the head of household with 2 dependents(children). Will I be able to tell the judge I am unable to afford settling this debt right now? I really do not have any extra money to pay this debt.

Hi. Six or seven years ago my dentist's office told me to open a credit card (the applications were on their front desk) so I could pay for an emergency crown. I did, but defaulted on the charge, and Midland bought the debt. They sued and got a default judgment against me, but cannot collect because I have no income and nothing in the bank - I've been my mother's full-time caregiver for many years now. Recently, Midland sent me an "Interrogatory," asking tons of personal info, including SS number; I did not respond. Since they already sued, what can they do to me for not responding to the Interrogatory? Could I use it to my advantage if I did respond?

If you don't respond, the judge can enter an order of contempt and punish you. This is a favorite tactic of debt collectors to squeeze money out of otherwise uncollectible people. Talk to a lawyer in your state right away.

Almost. After seven years, it comes off the credit report. After some different period of time (every state is different) they can't sue you because it's beyond the statute of limitations.

What happens if I have a default judgement that's years old and have 35$ weekly payments but cannot pay because I have nothing- no house, no job, nothing in the bank? Can a judge still enforce a 35 payment? What do I do?

If it's a court-ordered payment, then the court could enforce it if it thinks you could pay. If it's just an agreement you have with the judgment creditor, then it depends on what the terms of your agreement say.

Every state has different laws about garnishment. In Florida, a debt collector can only garnish wages after winning a lawsuit against you.

just tell them you have no knowledge of the debt. They have to be able to prove it is your debt. If the amount you owe isn't that much...they will not take you to trial and will dismiss it. It won't be worth their while.

Generally, if they filed a lawsuit (at least in Florida) they've already decided it's enough to take you to trial. Most bills of sale no longer have this language but it’s definitely worth looking for. And unless you’re already in litigation, getting a “complete chain of title” is unlikely in most states. Maybe Tennessee is different.

If they get a judgment against you, they might follow you around until the judgment is paid with interest. Even if you don't work and have no money, they could be a total pain in your backside.

I sent Midland a dispute letter. A week later they sent documentation. Everything was correct except a copy of the charge off letter had a wrong date and a mistake in my address. I didn’t hear from them again until a year later. This time it was a letter from a law firm in my state. I’m sending a dispute letter to the law firm-do I point out the mistakes or keep quiet about it and see if they send the same documentation? I feel like I could use the mistakes to my advantage.

I have been sued in 2020 left on my door. For a quad. I was in understanding that they were all paid for. Then they said it was a charge off. I have signed lien offs for accounts. How can I owe when they were all bought at same time but not paid off at same time. But as I said I have lien off account doc. They have g ot judgement and garnishment against me. I have no knowledge how to do this nor money. Can you tell me what to do? Do I go write a letter to judge. 2008 paid off 1 in 2017 and one in i think 2018 those are the ones I'm being sued off for. That was 2 quads I had 3 in total. 1 on 1 account and 2 on other account. It was a huge mess from start since I didn't know I was buying with a credit card in firs/ place. But I paid them all off. Please help as I've never contacted them since I don't know what to do.

If there’s a judgment against you that’s a problem that probably requires a lawyer to solve. The entry of judgment cuts off your right to dispute a debt.

Ok, i got a letter saying Midland is suing me for 3 separate credit cards at once: comenity, credit one and the bank of Missouri in the total ot $12k. It was sent certified mail. The letter is literally on plain paper, basic debt info, lawyer info. Court info with docket info as well. It's does not have a court seal nor does it have an actual signature of the lawyer or court clerkz they're both only typed. I called the court directly to verify thr valitiy of th docket number and case since this letter looks incredibly fake with a "You are being sued"" in the header of the docket paper, but the clerk in fact was able to find it in the system and said it's a real case. Can i beat this simply based on there being no official court seal, filing date or a single signature? If so, what should i do next?

The fourth amendment protects us from unreasonable search and seizure, without a court order or warrant. Once they get a judgment, that’s the court order they need.

If it's really time-barred, and they're trying to collect from you, that's probably a violation of federal law, and you may be able to sue. BUT if you're getting garnished, that probably means they've gotten a judgment and it's NOT time barred because they already won in court.

That’s one way to do it…. But for most people, bankruptcy is more expensive, more time consuming, more embarrassing, and more disastrous for your credit. Unless you’re VERY deep in debt, bankruptcy is like dropping a nuclear bomb to kill a cockroach. Extreme, and the cockroach might still survive.

Midland got a judgment against me in Virginia when I wasn't a resident of Virginia and the debt was not originated in Virginia. I was and am a resident of Illinois at the time. Would I be able to get the judgment vacated? The Illinois statute of limitations has expired on the debt.

In a case like that, it sounds like the judgment isn't valid, and you can get it vacated. You'd probably need the help of a Virginia lawyer to prove the service was invalid, and possibly even file suit against Midland for trying to collect on it.

When the collection company bought the debt, LVNV, they placed it back on my report, with a new date on it. Is that legal? Does that mean that if that collection company sells the debt, which by now is time-barred under Georgia's statute of limitations on debt, will it reappear with a new date? Thank you for your legal knowledge. I'm confused. It also now says the account is open. It was charged off in 2016.

As long as the "date of first delinquency" doesn't change, it's probably legal-you're probably looking at the "open date" which is just the date the debt collector bought it back. And Georgia's time bar has nothing to do with credit reports. That's federal law, and it's a seven year window from the date you first missed the payment-the "date of first delinquency"

The answer is in the video: it’s actually the best time to try to settle. You are likely to spend less money total overall (meaning you’ll spend less, including everything) if you talk to a lawyer who knows what they’re doing.

So yes, there is, a method and it's not something we can really explain in a comment or even in a full video. But here's the key to successful negotiation: the other side has to respect you or fear you. If they don't, you're not going to get as good a settlement as if they do.
