Louisiana drone pilot James Benson was wrongfully arrested for flying his drone by an irate neighbor. He's prepared to take his case all the way to the Louisiana Supreme Court if necessary.
UPDATE:
Hey Ken. We had to file for a time extension because they are lagging on getting us the court transcripts, that’s the only way we are allowed to get a extension, my go fund me has done really really well and now have enough to pay the lawyer for everything but the us Supreme Court , we hope it doesn’t go that far .. so now we just wait . Thank you for your help.

My drone hit a tree and fell into the water recycling yard it was private property I told the caretaker and he opened the gates and helped me find my drone I came back the next day with a 6 pack of beers and thanked him....I live in Australia

The neighbor (deputy Matt Henderson and wife Erin Henderson) and the judge (Bruce Hampton) should be arrested for being Class A Morons. SAD that a deputy and a judge have NO CLUE about the law.

He was probably growing pot or something and was paranoid you saw something and he full on attacked. Happened to my family once. My 5 year old daughter asked the lady next door about the blue lights she could see from her bedroom window at night. We had no idea why she was so crazy and furious with us.

Listening to his case....I’m not convinced that he actually did anything wrong. Sounds like a neighbor that is property line paranoid. Take it to the Supreme Court. Sounds to me like a case of bad neighbor. Aerial photography is a valid operation. The horizon and anything else within sight that is aesthetically pleasing is fair game. It’s our world and we choose a Birdseye perspective. The paranoid egoists that hate drones will invariably behave bad. We handle them on a case by case basis. I’m sure that cop that charged him in this case was definitely looking to make a name for himself. I’d bet he even plans to run for local sheriff someday? A crime is what happens when harm is caused to another person or property. No crime was committed in this case. I’m truly not convinced that any laws were broken either.

In 1977, while speaking to the American Bar Association, Chief Justice Warren Burger said that 90% of all trial lawyers are incompetent. Can you imagine, 90%! What do you think your chances are of finding effective counsel for your defense thumbing through the yellow pages? How many people do you know who can afford to retain F. Lee Bailey for their defense? Burger's statement alarmed me. After giving his statement a great deal of thought, I came to the conclusion that if a person were going to represent himself in a lawsuit, the first thing that he had to do was learn enough about law to become incompetent, then he would be equal to at least 90% of all the trial lawyers he would encounter in court. What Burger didn't say, is that all trial judges come from the ranks of the trial lawyers. Logic would dictate then, that 90% of the judges are incompetent too.

When a helicopter or airplane flies over that numbnut’s property and someone on that vehicle happens to take a picture, what happens then? Seriously. This is all that happened technically. I bet I could see more on Google Maps or Google Earth of numbnut’s property than this gentleman’s drone ever saw. What a bunch of bullshit.

By the judge's logic in this case...I guess someone flying inside a commercial plane and looking down on this Sheriff neighbor's yard would be guilty of illegal surveillance if they just so happened to look out the window and down onto his property (or take a picture with a cell phone cam)? Ridiculous and should be thrown out/dismissed...then Mr. Benson should file a USC 42 section 1983 lawsuit afterward, recovering all of his legal fees as well as additional damages he incurred as a result of being arrested and jailed for a perfectly legal activity. Better not look at this neighbor's house from Google Maps or Bing, that could be considered surveillance based on the ridiculous precedent that judge just doled out.

I’m from the UK but all you USA drone owners have a rally around this property and fly your drones. This ruling has set a president which could affect future encounters it must be sorted. If something happened locally to me I would organise a rally. We must be proactive in cases like this. All USA based You Tube drone channels should get together as well.

RE: A homeowner’s expectation of privacy. A homeowner has a legal expectation of privacy inside their house, or anywhere on their property that is fenced in/ covered space with a “privacy fence”. Neighbors, or for that matter, police do no need a permit, or search warrant to take pictures of the property, including the backyard.

As I understand things( and I am not a lawyer) legally licensed and registered drones are aircraft, unmanned but still an aircraft. There is no difference between a drone using a camera than a helicopter shooting aerial photos or from a small plane. As the property owner does not own the airspace there is no trespass. In NC they mandate you must have on your person, in writing, permission to use the property you are taking off and landing on else you are trespassing...this includes public property, you must have written permission from the govt to take off or land in a road, park, etc.

I didn't think real estate ownership included air rights. You can own all the land you want, but you don't own any of the air that's above it. This is a surprising case..

First off, I enjoy your videos. This one hits close to home. About 3 weeks ago, my neighbor called the police on me for flying my drone in general in Gladstone, MO. Making a long story short, the police officer defended my rights to fly a drone. I was able to show him the identification number with the FAA (which helped) and then said "go ahead and fly the drone." I proceeded to tell him I was signed up to take the 107 test but got cancelled because of the pandemic. I have since asked all my neighbors if they had any issues and they all said NO ISSUE. However, I do make it a point to avoid this neighbors house and do respect his views. So, on a second note, I have really enjoyed your videos and consider you to be a tremendous asset to the drone community. I miss Tennessee since I went to the Optometry School in Memphis. This is after I sent the Sheriff the letter I received back from the FAA telling me it was a Federal crime to shoot a drone down. I think they might have done some training! One could only hope! I am watching this video and I just want to scream!! James, I am SOOOO sorry this happened to you. OMG, how stupid can just ONE deputy be. I can say this because I ave been a sheriff's deputy in California for 40 years. I want and NEED you to now that not ALL deputies are this stupid. If I could find an email for this deputy, I would send him and the prosecutor and "nice" email . This absolutely floors me. PLEASE continue your quest in the justice you deserve. I wish you much luck and support from the California Deputies who "do have a brain" Good luck!!

I thought the police can't enforce drone laws because it's outside of there jurisdiction and it falls under FAA to police it. In other words a cop has to call an FAA agent to enforce whether there was a violation or not. Also you don't own the airspace above your house so it technically can't be trespassing.

I saw people in Huntington Beach, during the protests, flying over the protestors, the police, and the people on the beach, at very low altitude (3 of them at the same time). CHP uses them now too to spot lane violations during rush hour. Initially I thought it was someone getting some traffic footage and not knowing the rules.

Should have brought an FAA rep as a witness. Once your in the air, unless you are marked as a no fly zone, everywhere is open ground. As I read it, no one has jurisdiction over what we look at in each you’re off the ground.

Years ago there were model rockets that have a camera on them and take pictures as the parachute deploys and takes pictures of the ground. That includes every property it can see. I don't recall anyone being arrested for using those.

Wow, Being from Louisiana I would think they had more sense than this. They completely overstepped their jurisdiction. All Charges should have been dropped. The owner does not own the air space over the property, and if he was so high up, it would not be considered spying either. He needs to take this to the lousisana supreme court.

Exactly, sometimes, those ropes hanging off the basket has dragged across our roof a few times. They were that low! 🤣🤷‍♂️ We didn’t freak out, but the people in the balloon did. This is in Napa btw.

I fly commercially for mapping and maybe I can add something to this conversation. Im not sure what drone he was flying, but 2 years ago it was likely no better than a Phantom 4 Pro. So, another point to make in your defense is that at 400 feet the Ground Sampling Distance (how big a single pixel is at that altitude) is 1.3 inches per pixel for something like a Phantom 4 Pro. For a Phantom 3 Pro it would be 2.1 inches per pixel. When mapping, I lose enough resolution at just 200 feet that I cant read the license plate on the raised hatchback of my Subaru while on a job site. Hard to claim you were doing surveillance if you cant see anything in usable detail at that altitude other than the general disposition of property and structures. Yes you could see a person but without enough detail to see what they were doing. While better than commercially available satellite imagery it isn't as great as many would think. If your lawyer wants more information on that drop a comment and I will be glad to reach out to him and fill him in on how that is calculated and backed up by science :)

From what I understand FARs are not laws, they’re regulations and the FAA can only take action against your pilot certificate.. as far him going beyond VLOS being “illegal”.

I thought the air was FAA territory, local police have no jurisdiction. Also, the air is a public space. I don't get arrested for taking pictures from a helicopter or airplane while I'm flying over private property. News or police helicopters don't get in trouble for filming over private property. Hell, there are helicopter tours that fly over private property and people take pictures. WTF!!! I'm sorry this happened to the fella, but I do hope this sets new precedence with the FAA and drone laws. I mean if i have to register my drone as an aircraft then it needs to treated as such.

First I'll say that I've had some really good experiences with some cops. Very nice, helpful and eager to help (normal humans), but I have also had some bad experiences (totally disrespectful, control freek, A-holes) so it sounds like this was a muscle flexing, power tripping Creep that probably shouldn't even be a cop...

I was actually looking for that to post. You beat me to it. A sheriff's deputy / municipal / county court has no authority to regulate where a drone is flown. It's a power reserved to the Federal Government through the FAA. If it flies in the sky its area of use is governed completely by the FAA. from 1" above the ground and up.

The FAA made it clear that only they control the National Airspace, however municipalities may make designations as to landing and take off areas. This case simply does not fall within the boundries of violating any legal provisions setforth. How this even made it to a courtroom is a concern to every uav operator / Remote pilot in control or command. Waiting to see what Rupprecht Law, who states this is his area of expertise, has to say on the subject.

😲🤣WOW I was going to send this to Ken after I called my 2nd cousin and asked if it was ok for me to give his name and number out to the plaintiff. I haven't seen Johnathan since we were at his grandfather's funeral, my uncle. I knew he was in law school but just found out this is his expertise. Good to know someone has connected you to Rupprecht Law. Now since I'm an owner and am going to get my license it's good to know my 2nd cousin is the drone Lawyer to go to. I'm sure there's others, maybe rare, but of course I'll use my cousin. And his 1st cousin, my 2nd, told me he's got a book about the in's and out's of drone rules and regs. Good to know even for me.

so if he was charged with "trespassing", wouldnt that set a legal president that if the government wants to use a drone "or a satellite"(which is a really really expensive drone in essence) and look onto your property then if they do so they would have to have a search warrant to do so?

I do not understand this case. It is legal to film anything the eyes can see from public space. Class G airspace is a public space. If I overflew anywhere in my Cessna I could photograph anything on the ground. Surveillance implies intent. What did the prosecution use to prove intent?

I say we vote in a new law, all cameras are aloud in court. Holds them accountable. See how many get to walk, how many get cault up in the system

I fly around my neighborhood, not over. We have almost a 100 acres of forest on 3 sides of my neighborhood. I noticed that on the next door app that people in my community were commenting on the drones seen flying around. I told them that it was me, that I was getting sunrises and sunsets, started posting the pictures on the nextdoor app. I even offered to anyone to show them the limits of my m2p as far as the ability to spy on them, which is nill. And over time many in the community look forward to my sunset shots. My point, take the time to educate those who are fearful or dont understand the technology. MSM DOSENT PAINT A POSITIVE PICTURE OF US!

Lets see Google can take pictures, zoom in, NASA.can zoom in.on your privacy. Satellites recording your cell phones . but gonna supress this man. Now im ok not flying over residential. It is probably best to repect your neighbors. I fly over woods, rivers,privet land. land that i have permission or own or leases.

This has me kinda freaked!! I have thousands of dollars invested in drones, equipment, training, getting my "pilot's license", plus aerial footage is a big part of not only my advertising business, also my real estate business! It seems from watching a couple Ken's videos on arrests that there's virtually NO PLACE we can fly with out being arrested or at the least harassed. I'm diligent about flying in what I think are "safe" places with permission but this kind of stuff is making me rethink the whole thing. No this one but another Ken video showed the guy getting arrested for flying in a PUBLIC PARK!! WTF? I fly in the park all the time. I'll donate to the cause but this is all a bunch of BS!!

There are no federal laws against flying a drone over private property as the FAA only regulates airspace above 400 feet. However, some areas have passed local or state laws to prohibit drones over private properties. Before navigating a drone over a residence, pilots should check local laws and regulations. ... also i do remember reading land owners do no own any airspace over private property

This is wrong.This gentleman did no wrong for flying his drone.He clearly did not spy on anyone.Flying drones is a recreational hobby enjoyed by many including myself.I support you sir and will pray for you sir.🙏👍✈✈👀. What would they say about someone flying over their property with a Helicopter and took video while doing it? The FAA air space is not owned by any individual. It's no different with a drone other than the Helicopter needs to be above 500 ft. and the drone needs to be under 400 ft. They both run under FAA rules. You can't shoot a drone down either, it's a Federal law and is no different than shooting down a Helicopter, you will go to jail.

If surveillance can be proven , and I don't know how you would do that, probably need to document through photos or witnesses, on some repetitive basis, the quadcopter operator could have a problem.

I just went through a neighbor calling the police saying I was spying. I offered my registration and license, as well as them being able to view my videos. They said not needed and everything was okay.

Sorry to hear about what happened to this guy. Welcome to our legal system at work...there are more issues with our legal system than people realize. Last time I checked the FAA owns the airspace. Not any local or state agency. End of story! Always sad to hear things like this happening...can only imagine the legal costs. There are some states I will never fly in...

hey ken!!! I know youre probaably not going to see this but after watching that I want to share a little story I had not even a week ago. Ill admit your passion and dedication rubbed off on my a little and I decided to upgrade my Phantom 3 standard after 7 years to a mavic air 2. best decision ever btw. anyway. I went to this lake in virginia where I met a dad and a son, the son was about 13 and SUPER interested in drones. I suppose his extended family was there and while the child was restless to see what I was doing, others in his family, which i wont name, was not as fond. The kid knew the name of my drone just from the controller, he knew every in and out but didn't even own one!! he explained to his dad that it had a 3 axis camera, a 30+ minute flight time, could record at all different types of resolutions, etc. Anyway. After a long conversation and SHOWING his father and his extended family the drone, how it worked, why it's an invaluable tool, and even letting them take a peek at the live feed on my ipad, they all came around. I let the kid control the direction of the drone and point the gimbal, they saw it was easy and fun to fly, and they even asked if they could get a from the air selfie on the beach of the lake that I could send them. Which i happily agreed to. Just goes to show that with a TINY bit of exposure and 10 brief minutes to explain, you can 180 a familys POV with
