Iowa man Jerry Burns, 66, is on trial as the suspect in the 1979 stabbing murder of Michelle Martinko, an 18-year-old high school student. Jury selection began on Monday and continued into Tuesday.
Here’s what you need to know about the case.
Burns’s trial was moved from Linn County, Iowa to Scott County, Iowa given the high-profile nature of this case. Martinko’s brutal murder remained unsolved for decades. But then, on Oct. 29, 2018, police carried out an operation similar the one that California authorities used to track down the Golden State Killer suspect.
Burns left a straw on table at a Pizza Ranch establishment and authorities seized this discarded DNA evidence covertly. They compared it to a blood sample recovered at the crime scene that had been uploaded to a genealogy database and partially profiled.
Authorities determined that the discarded DNA evidence was a match to the blood found on Martinko’s dress. The judge has allowed the straw to be used as evidence at trial.
Martinko was “repeatedly” stabbed in the face and chest in her family’s car outside of the Westdale Mall on December 19, 1979. Evidence showed that she fought back. Martinko went to the mall that day to buy a winter coat, but never returned home. There was no evidence of a robbery or sexual assault.
Burns was arrested on December 19, 2018-39 years later.
The defendant has pleaded not guilty to first-degree murder. Investigators say Burns “claimed he did not have any recollection of committing this crime,” but could not explain why his DNA showed up at the crime scene.

The story is fascinating........ this isnt evidence. These are known facts, the evidence will be the strength of the dna markers, and the way it was obtained, was it blood or just dna. ???????.

I haven’t watched this entire trial, but my question is this....Were the Police watching this Suspect, after all these years? And finally were able to get a straw for DNA?

@@ssha2612 years of dna matching and coming eventually highlights suspects. All 3 were brothers. So they reopened the case, 2 bros gave dna, jerry didnt. So they followed him for dna evidence, and now we are here.....

Why are the Attorneys always seated in Iowa ? Seems different ..maybe i should watch more trials but are they not supposed to stand and address the court and witness?

@@sharonbentley8612 yeah thats what i thought ..i watched a diff trial in Iowa the farmer that stuck his wife with a pitch fork , forgot his at this second but they sit down all through that trial as well , was strange to see that .. I was born and raised in Iowa but haven't veen back in 30 years .. But im going yo check out other trials and see if they sit.i. not sure why i pick that up in Iowa trials ? Am i being picky or is it really a thing ? Im not sure yet .. But i do seem to notice it there fir some reason 😎

this is quite a small courtroom aswell, as in the area between witness and attorneys, like there isnt even that pedestal thing that you see a lot of them standing at while questioning,

This is the fifth witness in a row, Mr. Bergen, who is basically just repeating what the previous four witnesses said. The knew her from choir, she saw them at the mall and they talked to her and they left just before 9 when the mall closed. Why did they need to repeat that five times? Well, he did add that she was with a group of people instead of alone which is what the other four said.

John Allen I think the purpose is to humanize Michelle more and make her relatable and real. When that many years have gone by since the death, it’s easy to see the victim as a statistic or some ghost in the past. I think the prosecution is doing a good job by bringing up all these witnesses to her humanity.

If he is convicted, it will be interesting to hear the victim impact statements-assuming there are some, because it has been so long since Michelle’s death- .Usually we hear about short term impact. This case would provide us with long term impact statements.

It was so long ago, if they only had one or two people talking about her whereabouts that night, the jury ,isn’t think they could be mistaken. Instead, we have a number of people recalling the same details, thereby solidifying the timeline.

honestly given the accused is a "random stranger" id question whether he may have commited other murders in the area that are unsolved from that time? although i presume the police would have already checked similar cases in the area, its got a 70s serial killer feel to it, maybe ive watched too many documentarys (just finished Mindhunter aswell) but teen college student alone at night in carpark.....

exactly. I think it's the only way to prove she was where she was. they have no video and the more people who say it, witness it the more weight it has compared to just one or two people. it does become monotonous though

It would have been better if they digitized the aerial view of the mall rather than have everyone and their pet calf gather around it. Can't see nor hear the witness. I guess the state attorney's office runs on a whopping budget of $97.52. Get up to 2020 technology Iowa!

exactly. the reason they're able to remember what she was wearing, where they were and all the details is bc they were questioned over and over about it and then refreshed on their past interviews before this court date.

The mall is crowded with Christmas shoppers. A beautiful young girl is there, walking around the mall alone, over-dressed and showing a wad of cash around. This would attract the attention of predators in the mall. Was Jerry Burns a predator? Could there have been other predators in the mall that night?

this is heavily repetitive, what are they giving us that we didnt find out from the 1st witness, 5 character witnesses is totally unnecessary, i thought 1st witness did enough, id have the boyfriend to confirm the 1st witness recollection as it was so long ago, they really need to get to the forensics

She probably is wearing her hair naturally curly/wavy just the way God intended. Why should we as women fight with and straighten or curl our hair? To please people like you? She has used a styling product and has a great haircut. Shame on you for shaming someone you know nothing about.

This case is just for our entertainment.We know she was slain between 9pm and 4am and found in her car at the mall. Why are the prosecution asking the same questions to the witnesses. All this information must be taken as read due to the police activity at the time. What is in question is , whos DNA is on her dress and gearstick. The DNA links the defendant, wholly or partly to the crime. How can a jury convict on DNA alone.

We all know what happened. If its his dma fine, but its only science that puts his dna there. Steven avery case. Planted dna. It happens.
