This whole fiasco does show one important thing, Romaine is completely deluded.. And should probably seek help to bring him back down to earth. Also, if you're going to file a lawsuit.. don't ask for an utterly ludicrous amount of money over what, basically, equates to someone doing their fucking job.

I really, really used to love Sterling's videos because they were well written and objective and could even convince a stick-in-the-mud like me to change my opinions on a matter I felt strongly about. Now, Sterling's all just venom and swearing. I get passion for a topic you feel strongly about, but now it just feels like they're trying to get views with shock value over what they're saying or something... Edit: and that 'if you dont like it just leave' attitude? How many people do you think have said that to Sterling over their many rants? No, I wont be doing that because I respected their work too much to give up on them just yet.

We have this C++ gug at our place and one of the new guys said to him to use something that was not very fitting, instead of agreeing and shutting him up, both went into an argument and we all watched them fight like dog for 2 hours straight when his friend gave him a clue and he finally said "You're right, now let's not use your idea"

I love how they actually thought that was a big "gotcha" moment, that that was actually a coherent argument of any sort. The arrogance of it, as if a lowly cretin like Romine speaks for the entirety of the games industry. It's almost impressive just how deluded these assholes were. Jim pities them, but I pity their families more. Imagine having idiots like those in your family...imagine one of them being your parent. Oh, those poor people.

Well, it's more that it's well established law in the US that an opinion generally cannot have falsity. I equally cannot establish the falsity of whether the sky is a pretty shade of blue or whether Taco Bell is great. In the US, falsity is required for a defamation claim (or libel, or slander, or their variations) because of the First Amendment.

givingtnt I think the world deserves to know what legally constitutes as "all the popcorn in the world" and if it can be quantified. Does it include kettle corn, microwave popcorn and cinema popcorn machine? Does it include even corn meant for popping, but not popped yet? Does it account for market fluctuations where there is more of a need for boiled corn rather than popped using corn made for popping for boiling? By God, this needs to be adressed!

You might want to stay away from the whole "interview" if that bit if cringe was too much for you; there was multiple times where I ended up yelling at my monitor because Romine had no fucking clue what he was talking about outside of his argument of Jim Sterling; Notably he's 35, "works" in nerd culture but doesn't know what MST3k or Rifftrax is and specifically makes points to say stuff like that doesn't exist? Are you fucking real? But he took the time to try to Dox Jim by saying he's vaguely related to some random author he shares a last name with.

I think you make a point that is worth hearing because it shows Jim holds his principles higher than his wallet. Most people would have taken what your lawyer would be recommending, to go after the guy and at least get the money you pumped into paying for lawyers. Obviously he never read up on the "Consumer Review Fairness Act" which pretty much legally protects critics. (It is also why copyright claims on youtube game reviews are also illegal) Pretty much, if it ever went to court, he would have to bend the knee to the US Justice system and receive his spanking.

You are right, but I just want to point out that KZfaq's expressed purpose is not "Consumer Review" and the copyright claim system is in place to protect from copyright Infringement- mostly to cover Google's ass- so yes people cannot be silenced from review of products, but no the copyright system on KZfaq is not illegal because the intent is for companies to claim their copyright has been infringed. Which is why the argument you more regularly hear about is that KZfaqs copyright system is unfair because it has no accountability on the side of those frivolously making the accusation, all the accountability is on the producer of content even if the content is following the law, and KZfaq does nothing to protect it's content creators who are completely in the right when following fair use. The way the system is misused could be construed as silencing fair review, but you would have to prove it was done for that purpose rather than the purpose of protecting copyright which thus far most KZfaqrs cannot afford to do.

Let`s be honest: James doesn`t likely have any money. I have to imagine this is what Jim`s lawyers told him - don`t bother trying to get our legal fees from this guy, he doesn`t have the means to pay & you`ll just end up having to deal with him longer than you have to. I also get the sense from what Jim was saying that his lawyer talked Jim into being merciful. Lawyers spend a lot of time watching ugly retribution play out and watching `bad` people get absolutely crushed, and I have to imagine they come to understand that this is nothing to delight over. James sounds like, for all of his terrible qualities, someone who is sad & desperate. It probably does the world no favors to make him yet more miserable.

youtube has... when has anyone ever seen youtube proactively defend a creator against fraudulent DMCA claims? Having followed Sterling since traditional games media days to own thing to now - they are the happiest they've ever been - Stephanie & wrestling have changed the content for the better, seems so so so so much happier. Found themselves - this was the period when having seen the industry for what it is, left out of disgust & kept doing it with patreon supporters to not be beholden to ad revenue or sponsors.... but the backlash & consequences of that move were non trivial. That stress/burden/anger showed often in the content. it's in youtube's financial interest to keep this out of court - they are not steam here - steam was a third party that also told digital homacide yeahhhhh fuck yourselves to protect users. youtube as a matter of documented policy is protecting an individual who continues to commit perjury - granted one has to prove the claims are knowingly false - but feel that if gilson continues to push - that's what a good lawyer would go after & was hinted at in the "yes notice we're keeping a journal" - if genuine DMCA claims & not targeted harassment would have been bulk filed because the issue is the infringing content not the existence of a creator who makes you mad. end of day - It's Jim Fucking Sterling, Son. if sony and youtube don't intervene to stop gilson to protect themselves - shit could get interesting

It's now been five years since this video was uploaded, and it's still highly entertaining to go back to. If Romine got his way, we'd now be able to watch these videos again. I don't know what Digital Homocide are doing these days, but I hope they realize they weren't defeated by Jim Sterling; they were defeated by themselves. All Jim did was what they had to do in response to a lawsuit, while Digital Homocide smeared their own name and became infamous, wasted hours of time and money throwing tantrums, and blamed Jim for all of it. Kudos to Jim for handling this situation as well as they did, but I think they'd agree with me that basically all of DigiHom's problems were entirely self-inflicted. If the Romine brothers could handle criticism this whole mess would never happen

Eh, as I said in another thread--not such a big deal if you have your First Amendment chops. Defamation requires falsity, and usually an opinion cannot have falsity. So just madlib in whatever funny opinion you want there. I equally cannot prove who whether Avatar is the most overrated film in the history of mankind, nor whether Jim Carey is now, or ever was, at all funny. Admittedly, the number of attorneys with even passing competence with the 1A is depressingly a small sum. (See what I did there?)

Except Jim won. The actual evil person here. Jim is not some saint. He instigates fights and then cries he is the victim when the devs defend themselves. If Jim stuck to professional reviews instead of slandering everyone involved he would be as legit as IGN, but thats not what he does.
