Social media comments made by JK Rowling challenging Scotland's new hate crime law are not being treated as criminal, Police Scotland has said.
The Harry Potter author described several transgender women as men, including convicted prisoners, trans activists and other public figures.
The new law creates a new crime of "stirring up hatred" relating to protected characteristics.

@@JohnSmith-fz1wh Real crimes are too difficult for them. Far easier to follow up twitter comments and tiktoks than get out and do the hard work of tracking down actual criminals committing physical crimes. Keeps their Solved cases ratio up when reporting crime stats.

Girl arrested and convicted for writing racial slur on interwebs. The words were part of JZ rap lyrics. JZ goes on stage at Glastonbury and says the same thing to thousands and thousands of people. JZ not even questioned by police. Precedents don't count in societies with two tier policing

My car was vandalised in Aberdeen. I saw them do it, I took a photo of the people and their vehicle. The police, after finally getting through to them, went to the registered keeper of their car. They denied it and the case was closed. Truly pathetic. But let’s get arrested and charged for a bloody tweet. I’m ashamed

Right. A lot of conversation has been around enforcing trans-ideology and removing women as a protected group. But this law is also an end run around the UKs long standing anti-blasphemy laws that say you can't be prosecuted for saying something that someone else considers blasphemous (last prosecution was in 1697). This has been a complaint of muslims in the UK who feel that any criticism of Islam, drawing an image of Muhammad, etc is a hate-crime against their religion. So now the muslim First Minister has pushed through this law that could be used to criminalize any criticism of Islam.

That's not quite correct. It based on case law so it's good that the precedent was set here to not convict her, this will hopefully inform future decisions but I'm not holding breath

@nUmBskulLL a statement by the scottish police is not a case and therefore doesnt set a precedent. There is no case law established. The UN Special Rapporteur recommends that any law prohibiting 'hate speech' must ensure that 'no one is penalised for true statements' and that 'no one should be subject to prior censorship.' Under the terms of this Scottish 'law', simply speaking in facts could result in a person being investigated by the police and all the trouble that brings to an individual and even a conviction. For the first time, it is possible, under this 'law', simply giving an opinion in your own home could be a crime.

She used heavy irony precicely calling them "woman" and "delicate flower", and"she" but stating their criminal record. At least we know that there wont be criminal charges for using irony. For now. @@paullegend6798 Hate speech are vocalised actions specifically targeting protected characteristics. These characteristics are either unchangable, or not up to the standards of others to change. Your allowed to say “I don’t believe trans women are women”, you would be wrong, but it’s within your freedoms to say that openly. However, as soon as you start saying that on an individual basis, that’s when your infringing on the identity and rights of that person. There’s also something called ‘responsibility of influence’, where if you say something indirect to a group of people, you have to make sure that they don’t act on that, because again can lead to rights of oþer being violated because you essentially told them to. It’s not confusing, it’s not hard. All you have to do is not be bigoted and hateful.

No, freedom of speech has limits. Like the old example of screaming CROWD in a theatre on fire. Some speech can be problematic, and so some light regulation is required. Social media companies should be made accountable for everything published on their platform. Like a web hosting service would be liable for hosting terrorism training stuff

That is not how the law works, in criminal cases legal precedents can only be set by how laws are interpreted in actual legal prosecutions. This is just a meaningless statement by the police. They will use these laws against a regular citizen at the drop of a hat, the entire reason they have not gone after JK is she has the profile and financial resources to make a large percentage of the public aware of how the law is being applied and also this being the first prosecution a legal precedent would be set by this case. Much easier to get the legal precedent they want against Joe Bloggs with a public defender. Vague speech laws such as this have been used to prosecute countless people for years in the UK. This is just more of the status quo

@blabla5938 while I understand that many issues get sensationalized without any real threat, I don't believe that is the case in this issue. In my own country of Canada, a man was imprisoned for 6 months for misgendering his child by refusing to call them their preferred pronoun. People have been fired and forced to pay fines and do community service for 150 hours for posting song lyrics that were considered offensive in the UK. There IS recent precedent for this type of insanity. While perspective is great, we must not get complacent.

In Scotland law the act says it must be abuse or threats that scare a "reasonable person". That is a common idea in Scots law.

I wonder if the Scottish Government have considered the effect this new law may have on tourism. For example would Edinburgh Fringe Festival be treading a thin line on legality? I suspect tourism in Scotland will take a huge knock as people will not choose to go a place where they are unsure of what they can actually say with impunity.

That depends on what the politicians, the police, the prosecution and the judge want it to do. They don't want it to make someone like JK Rowling necessarily liable; she's too powerful. They do want it to be able to make people guilty if it suits them (authorities).

This whole discussion seems so pointlessly circular, here's my understanding 1. The SNP propose a new law that is intended to make the prosecution of hate speech easier by bringing Scottish law closer in line with English and Welsh law. 2. A news cycle begins to generate outrage about wild hypothesised implementations of said law. 3. The law is passed with stringent protections for private speech and personal opinion, as well as putting in place stringent proof required to demonstrate intent and reasonable interpretation as incitement to credible violence. 4. JK Rowling attempts to break the law taking no account of the protections for her private or personal speech and makes no threats of violence nor any demonstrable incitement to violence. Merely indicated a personal bigotry. 5. Since she had not broken the law there is (obviously) no requirement to prosecute and as such police Scotland (when pressed by journalists) release a statement saying that there is no crime committed and so there will be no prosecution. 6. Rishi Sunak jumps on the band wagon and seems to suggest that he will never reintroduce the existing and already extant protections against hate speech targeting any group that demonstrates credible threats of violence, or credible incitement to violence; on account of those being the very laws that the SNP had initially intended to bring Scottish law closer in line with. So if that is broadly correct and I have not been lead up the garden path, then this is a whole lot of nothing.

It’s absolutely no accident this law is being introduced on a Muslim’s watch. A big part of this is about not criticising Islam. As a lifelong agnostic, I have very little time for _any_ organised religion. However, the thing that should be said is that I feel zero threat from any organised religion, bar one. If I were a public figure and publicly castigated Jesus, or Moses, or Krishna, or Buddha, or the Flying Spaghetti Monster, it’s very likely nothing would happen to me. If I publicly slagged off Muhammad, it’s quite likely there’d be a backlash and I’d be watching my back for the rest of my life. _That’s_ the difference. Just ask Salman Rushdie or the Batley teacher who, btw, didn’t even _criticise_ Muhammad; he just showed a damn picture! Imagine living in a society where certain people are so offended by a cartoon, they threaten death to the person who showed it! If certain people are so ‘offended’ by a cartoon, then it’s time to question the belief, not the cartoon. (Similarly, if certain other people are so ‘offended’ by someone suggesting they might not be biologically what they claim they are, it’s time to question the belief, not the questioner). It seems Islam is so trigger-sensitive it can’t take honest criticism, when it’s just a bunch of manmade ideas like all the rest. Never let _anyone_ tell you it’s ‘racist’ or a ‘hate-crime’ to criticise Islam; it’s just some manmade ideas. These ideas are held by people of multifarious races. Here in the UK (and elsewhere), if you’re a public figure and suggest Islam isn’t all that and directly criticise Muhammad, then your life could very well be in danger. _That’s_ the difference. Significant elements of Islam in 2024 - hell, this stuff goes back to at least 1989 and ‘The Satanic Verses’ - are as intolerant of those who question it as general Christianity was before the Reformation/Enlightenment.

Naturally insulting any persons religion, culture or persons choices is going to cause people to become defensive and attack you back, that is just human nature. Plenty of people of different religions often debate and critique each other's religions, including Islam with intelligent and thought out talking points and it goes without a hitch. If you are rude and disrespectful about peoples cultures, traditions and beliefs then people will take you as a bigot and ignore you at best or punch you in your mouth at worst. There is no doubt this law could be used by some as a weapon but as long as there is some common sense used and you are not being a outright trouble maker or poop stirrer then you will be fine.
