Just disgusting by the landlord. Then if AMC rights the ship and decides to leave the mall and then they landlord has to find a new tenant for that space. Everyone is in a predicament so they miss a month and they want to do this? So wrong

Here's the thing, a company that I worked for didn't pay their rent. They went bankrupt. The landlord did not get paid by the curator because there was a long line of creditors and the landlord went almost bankrupt himself. You know who did get paid? The owner of the company. A year before the bankruptcy he doubled his management fee, and he put his wife and two of his children on the pay roll at inflated salaries. Now, because he did this when the company was solvent, this was technically not illegal and proving mismanagement is difficult. Now let's look at this: AMC has cut back on paying their senior management: "Their cash payouts will be shaved by 15% and other compensation will be tweaked too. Aron (the CEO) said during a post-earnings conference call that it’s a $1.6 million hit for him personally over three years. Adam M. Aron made 9.5 million in 2018. But he is willing to give up 0.5 million a year to help save the company...

I see the pic and I live by the area no one mostly goes there . And it’s not even a mall it’s a Plaza trust me if that movie theater shuts it’s not gonna be missed. You got a planet fitness you have a Hooters basically the place is on a strip. The real mall is up the street called Westland mall . It’s not popular the real mall with 2 movie theaters a bowling Ali and a game works and much more is in Doral and there is another movie theater in Doral as well in Cityplace.

HPTRK Kreed like they say if the bank wants there money they will fight you for it. If you don’t have knowledge about the Justice system your practically screwed. Like Jhon said you could fight it and claim a natural disaster but do you know the judge will throw you under the bus. The reason for that is everyone is gonna be saying the same thing.

I suspect the mall owners believe AMC will go into bankruptcy and thus only get pennies on the dollar that's owed to them, especially after AMC got that 500 million cash infusion. Thus they are preemptively suing them to extract what they can before any bankruptcy proceedings.

Movie theaters like big mall stores have their own doors. They could open if they chose to without the mall being open, like when a movie is playing at midnight even tho the mall is closed.

@@chivasdeguadalajara Actually that is only some theaters, as the AMC in the capital of Florida, requires you to go through the mall to access the facility. When 9/11 took place, they were not going to close although other businesses had shit it down for the day.....but they finally were forced to contact their workers not to come to work because the mall forced their hand by not opening at all and locking down the doors to get inside the mall.

Erin has a valid point. The AMC I frequent is within a mall, I do usually stop by other stores and purchase things when I am there. If it weren't for the theater though, I am 99% sure I wouldn't be going to the mall often.

I know not all landlords are bad, but seeing how some of them (both retail and home landlords) have behaved and acted during this pandemic has been utterly abhorrent. Landlords and renting should be abolished in general.

Just saw a post today about a toys r us in London Ontario being shut down by the landlord for failure to pay rent. They put a notice on the front door with the amount owing for everyone to see. Pretty crappy

I think when AMC got that loan, the sharks smelled blood in the water and is making sure they get theirs. That's the only possible reason why they would think AMC can pay them over $7 million when they can't even pay rent.

If AMC files bankruptcy and closes that location. That is a really big space to lease out. Most malls I see and know of, really struggle just to feel a small boutique store in the mall. Department stores and movie theaters are twice as hard to lease out.

Along 22nd Street in the west suburbs of Chicago where I used to temp all I saw were shopping malls and smaller centers. Yorktown, Oakbrook, and maybe North Riverside Park will survive this. Everything else I'm not sure about.

I used to work for a business located in a shabby building on Wilshire Blvd in LA. We took up a whole floor and our rent was around $20,000 a month. I don't completely understand why the trend is towards fancier theaters with stadium seating and high ticket prices. Stadium seating is expensive to build. Why not offer movie-goers an alternative with less fancy theaters and ticket prices under $10. Apparently it doesn't work that way except with second-run theaters. Incidentally, second-run theaters have to use digital projection so the projection quality is almost the same as first-run theaters.

Back in 2016 I worked in a mall movie theater that was owned by Regal Cinemas. I remember on holidays when the mall would be shutdown for the day and we would have to have a janitor come in to let one of my managers in so they could prop a door open so we could resume normal operations. If the AMC at that mall was set up similar they might be able to prove that even if AMC was open with the mall getting closed there wouldn't be a janitor to unlock the doors for normal operations and they might be able to get out of this mess.

My guess is the Mall isn't getting money from many of the tenants and they don't want to forgive any of them. Before the pandemic most malls were in trouble. With everyone ordering stuff online with stay at home, things are going to get worse.

Because AMC breached the lease, they can not only get the full lease payment from AMC but the lease ends and property leased to someone else. AND pays but can't use.

Suppose the landlord did win. Here's the future scenario. 1st) AMC moves out - but another theater company will never move in because they're afraid of what will happen to them in a similar crisis. 2nd) The smaller retailers will lose income and not renew their lease because they're afraid of how of the landlord will treat them in the future. 3rd) New retailers will not want to move in because they know what happened with AMC and they're afraid of how the landlord will treat them. 4th) We see the mall as one of those "dead mall" videos on KZfaq.

MANY malls around the country rely MAINLY on the movie theaters to bring people just in through the door. Half of our commercial suppliers send us force majeures, Erin is 100% right there.

@@Kinshasa9200 REITs are not your typical equity stock. They follow different rules. When you buy an REIT you're not buying ownership of the real estate property. While REITs technically could buy back their own shares it makes zero sense for them to do so since they already own everything.

Australian government has brought in protection for business and private tennents,also protections for landlords. to try to get us through. Even so there are cases of malls or shopping centres as we call them, have shown similar attitude towards tennents. This is disgusting to me.

The thing is, they have to sue for that amount now, and be the first ones to get payment out of AMC before they go bust. If they wait, and then AMC goes bust 2 months down the road, when they've got nothing left in the bank, the mall owner is stuffed...

Could be the bank(s) behind the Florida mall(s) be pushing the landlord or maybe even the landlord's insurer? However, 52,000 x 12 is not 7.2 million dollars. There must be a considerable amount of damages and attorney fees in that total! Perhaps the lease had just been renewed for 5 years? Even so that is still an extra $4 million? I think that when Erin said "oh Florida" that says it all. To badly paraphrase a famous quote, compromise is a dish best served to suit all parties. In other words, do not spend cash that you do not have for legal services you do not need.

I'm not sure how any of this works but how about instead of suing them why don't they rework the contract and have AMC pay $70k a month oppose to $50K when the country opens back up.

Sounds like an opportunity cost sort of argument. Using the car leasing argument John could say that he could have leased out the car for a year, but the fact that the person is monopolizing the car then they cant get their money back. Crazy. Good luck who else could tent out that space now?

I seen an article AMC paid them 15 % in good faith. It's a disgusting move by the Landlord's. Could landlord's request government assistance? What about the entertainment industry coming in as saving Knight. Production companies and Actors unite to save theaters. We all miss you on the Big screen.

I think the Mall's thinking is that theaters are NOT going to recover and streaming is the way to go. And so they want to get their money now or risk never seeing it. And like most people are saying. That's a dick move.

If you default on your mortgage the bank can foreclose on your house. The threat of losing your home often gets the defaulter to try harder to find the money to pay the mortgage. Maybe sell the pony ... er ...car and take the bus. I have a feeling the mall owner is not just suing AMC. Probably everybody who does not pay up on time. Look at the mall owners' point of view. If he does not get his 7.2 million while AMC have 500 million credit he may never see any money at all.

At first, I was thinking those landlords are stupid. The moment you said 7.2M, I was wondering, what if AMC declared Bankruptcy? But then, I'm wondering, what if they already decided the mall was likely to permanently close. They already know what is happening, and are trying to reap as much profit as they can before they do.

Don’t worry that’s not even a mall it’s a plaza and the only thing that’s holding that place is Hooters, Planet Fitnesses and Walmart. The real mall is Dolphin Mall and they have 2 movie theaters .

I don't understand how AMC was coming back....the 2 AMC theaters have been on decline for the past decade. Nobody goes there because their matinee ticket prices are still $8 and regular tickets are $15 where as the other theaters by me (Emagine & MJR) have matinee prices at $5 and regular tickets at $10. Also AMC have the same terrible stiff chairs and old projectors that don't have good quality and they also charge insane prices for food and beverages. They also charge you $5 for refills on popcorn and $3 for a refill on a drink where as the other theaters don't charge you anything and have amazing quality projectors as well as the reclining seats. I'm honestly surprised to hear AMC is coming back because I thought they died ages ago.

This is a messed up situation, for sure. Although, wouldn't the mall owner(s) also owe someone for something? Such as, a bank for any loans they might have. Or, at the very least , for taxes owed. I don't know how all that works, but it's just a thought. Or maybe it's just straight greed.

Why are people so shortsighted..great you got your years rent 7 million plus..that's one year. My local AMC theater has been at my local mall since 2003. That's 17 years of constant rent..first of all imagine punishing a 17 year old tenant..who till now paid on time..for 17 years? Not only is that a way to drive away a 17 year old tenant but the lost of future rent. Trust me if they get their 7 plus million it will be the last bit of money they get from AMC..they will not renew their lease and will leave a giant pit in the middle of the mall.

The landlords prob think if they collect the 52million for the remainder of the lease and amc goes out of business as a result they can then rent the space to next suckers and bleed them too for the same period of time

Yes but the utility companies aren't cutting off utilities for missed payments or suing people for the utility bill. I've gotten so many letter and emails from American Water and PSEG saying they understand the situation and have waived late fees etc. So if landlords aren't getting penalized, why r they punishing their tenants? Because if that tenant can't pay and moves, how do they expect to find another one in this current crisis. I guarantee no1 will be shopping around for new apartments when they can't pay rent. They would rather stay where they r and continue trying to pay off their current landlord (if they r a reasonable person)

Are they singling out amc? What about the rest of the tenants? Are they suing everyone? If they are only suing amc it seems to me that amc can counter saying they are the only one being sued. I’m not a lawyer so I don’t know but that would be my defense.

Before shitting on the landlord too hard, keep in mind that AMC has spent over $1B in the last 5 years buying back shares to increase their shareholders' equity and $200M doing so at the end of February, after we already saw how bad the situation could get in other countries. All that money could have been used responsibly to pay off some of their debts instead of artificially increasing shareholders' wealth.

Just for clarification here, AMC is being sued for the full 1-year payment right? Meaning after this AMC will no longer rent at that mall? So if AMC declares bankruptcy will they still open all their locations? And if not, then shouldn't this be a reasonable move to get the 1 year full payment? Sorry i have no idea how this all works. I'm hoping AMC will come back strong because I have stock in the company. But I understand things are rough for everyone but this lawsuit from this Florida landlord seems like a bad move even though I understand it. Because if AMC comes back what is this landlord going to do when AMC lease is up and they don't renew with you because you sued them? You have this huge commercial space that is specifically designed for a movie theater and how hard is it going to be for you to get another tenant to pay you $52,000 a month? This pandemic is unprecedented and it's something we have to adjust to and everyone is affected by it in this country and around the world. Even if they file for bankruptcy and come out of bankruptcy they're still going to give you $52,000 a month even though you missed out on the rent before the bankruptcy. It would hurt if I was a landlord not getting that $52,000 a month but in the long run if AMC comes back and they will remember those who stood with them, then more than likely they'll be tenants there as long as people go see movies and then you can guarantee that $52,000 a month and a slight increase in the next couple of years once they get on their feet and you both can prosper and rest easy. To have a tenant like AMC Theaters is something most landlords would dream of having and holding onto with a death grip. Florida sure makes you scratch your head.

Great the landlord helps to send AMC out of business, who do they think is going to fill that big empty space. Unless these mall owners just want a bunch of empty storefronts after the lockdown ends they better work with their tenants to help them survive.

This may just be a matter of PROCESS to cover their bases from a legal perspective....even if they know they won't receive any rent anytime soon, or if they already have plans to negotiate with AMC later. If they don't take the official action now it may make it more difficult to take additional actions later. I don't think they're trying to be dicks...they're just trying to follow the legal process to a "T" in order to protect themselves.

This is pretty shameful. And a little tricky. But under these circumstances, that is a really shitty move on the landlords part. Might not be such a good idea squeezing more money out of the theater. They need to be able to comeback somehow. How are they if assholes do that? That's not logical. I'm no lawyer or landlord but this virus is hurting everyone financially. Fact. No matter what anyone says. Here's a thought. How bout giving them a little pass and like John said. Actually talk it out. Just a thought. Lol
