I cannot believe that DUIs are considered a misdemeanor ! Considering a vehicle could be a potential lethal weapon, it should be a felony. Lives could be lost.

DUIs are still more punishment then someone gets selling fentanyl to anyone especially kids. DUIs are also more punishable then kidnapping even when added charges like to commit harm or exploit for sex etc etc. kidnapping isn't a crime anymore let alone major one in most states now.

Unless it's high BAC (.15/.16 or above?) or combo with drugs, the first is usually a misdemeanor and you can avoid jail depending on state laws. Unfortunately, given that I've seen headlines for 6th DUI and 10th DUI, you either get sober after the first, or your life is forefit. Once you get to 4 or 5, let alone 10 it's driving without a license/insurance anyway. The fines for misdimeanor DUI are still more punishment than a lot of auto theft suspects are getting in my state.

I think they corrected it to 0.084 because if you reach 0.50 you would be unconscious or comatose due to alcohol poisoning.

When a drunk driver rolls their car, it's not an "accident". We use the word accident far too much, this is a "negligent". "I was drunk and had a negligent". A drunken crash isn't an oopsie poopsie. Pathetic.

Just because she’s at work doesn’t mean she wasn’t drinking at work. I’ve had more than one person do that at the hospital. Or come into work intoxicated. They get pulled from patient care immediately.

There is absolutely no reason that a young woman has a need to be out drink8ng and rolling their car at 4:30 AM. I wonder what type of doctors note allows her to mess with the scram or drink. She needs to be remanded, immediately.

"The defense would stipulate to 0.84, your honor." Uh... no. She'd be dead. She wouldn't have been able to open the door or start the vehicle. She would have been catatonic well before that. I get that people have a hard time with percentages and that she probably meant "0.084," but this is on the record and accuracy matters. She just said her client was 10 times more intoxicated than she actually was. Some states have increased penalties depending on how high over the limit the person is.

Never drink and Drive. I have done it "only" once before. It was late at night. That does not justify driving drunk. Everyone round me has a chance to be harmed by me because I'm doing something Im not supposed to do. Someone's love one. It's not fair to the public.

0.08 percent BAC is the legal max for driving, I went back 3 times and heard 0,84 at the 2:17 mark. Either that is a SERIOUS mis-quote from the PD and not corrected by anyone or this chick is lucky to be alive. If that was the exact limit, why in the world would any prosecutor plea that down?

A high school friend of mine actually had a BAC of .41. Thankfully, we got him to the hospital in the nick of time. Yes, he was unconscious when we took him in. We tried to warn him but he ignored us and consumed a nearly full bottle of Ever clear (190 proof). I just never really got into being fall-down sloppy puking drunk. It's just not fun

I don't drink and drive so I honestly don't know how much impairment .084 is, but when I was a young man, 0.1 was the limit. Also, people roll cars because they just suck at driving and not impaired at all.

LOL this is the same public defender assigned to defend the moron who zoomed into court to show he was driving with his license was suspended & in fact he never had one for 25 years. This guy then went out after embarrassing himself to get a paid lawyer whom he then embarrasses again by lying about having a license & having yet another driving on a suspended license charge in another county. She clearly is always assigned the winner cases.

A SCRAM (Secure Continuous Remote Alcohol Monitoring) tether, also known as an alcohol tether or SCRAM bracelet, is a device that monitors a person's alcohol consumption after a DUI conviction. It's a non-invasive way to detect alcohol by sampling a person's sweat for alcohol excreted transdermally (through the skin). The device is about the size of a deck of cards and is attached to the subject's leg or ankle with a rubber band.

A SCRAM bracelet, short for Secure Continuous Remote Alcohol Monitor, is a lightweight ankle bracelet (approx. 8 oz) designed to keep track of the wearer's blood alcohol concentration through measuring his or her perspiration every thirty minutes.

Why does she have to pay all those costs but when we're falsely arrested we don't get back a penny for our lawyer fees? Laws need changed.

She needs to realize that she has a potentially fatal disease called alcoholism. She's lucky they didn't take her away from the accident scene in a body bag. A blood alcohol level as high as reported on her was enough to make her stop breathing. She needs immediate intervention.

She has no disease called alcoholism. That is not a disease. She didn't wake up one day and suddenly become a drunk like someone with a real disease does. She took the first drink and continued to drink. It's no disease. That is an excuse meant to give them an out so they can claim they aren't responsible.

I gotta disagree with you on this one Judge Simpson. I realize that she screwed up once already but when they o those software updates, there's a million and one different things that go wrong with them. The Android 13 update last year caused my lenovo tablet to completely factory reset!! I'm sure a SCRAM bracelet's update is significantly more complex.

LOL, nah, she didn't 'screw up' she *consciously chose to drink* knowing she'd go to jail. That's not a screw up, that's thinking you can cheat the system, and I highly doubt that the update did anything.

The judge seems biased against this Defense Attorney, I have watched a bunch of his cases and he is extremely difficult with her clients.

What a silly thing to say. If you have two violations in Judge Simpson's court, you're going to jail period. Maybe if there's one rule breaking, you might get away with it, and even then the chances are slim, depends on context. The lawyer said it was too early in the morning for her to get drunk. When the judge pointed out the accident happened early in the morning, it was over.
