Judge Luttig: 'No end in sight' on democracy perils

Judge J. Michael Luttig, the former Federal Appeals judge for the Fourth Circuit, helped prevent Donald Trump from overturning the election on January 6th 2021 with a series of tweets. He’s since been outspoken about the perils facing our democracy. With the news of Trump’s indictment members of the GOP are “circling of the wagons to protect the former president,” said Judge Luttig. “Their now unified and continuing insistence that the former president won the 2020 presidential election, and that January 6 was nothing to be concerned about.” Now, As we watch the GOP abandon all pretense of operating under the rule of law - of operating with democratic values - this conversation feels more prescient than ever.

Judge Ludig's True service to the nation, IMO, is slamming Theocratic Judge Aileen Cannon's biased and unlawful ruling in which she tried to grant Trump a Special Council to delay the case of the classified documents he stole. She belongs back in the clerking business and a strong rebuke from the ABA.

No, it isn't. It is to be expected that the one who is being investigated claims to be innocent. There is no need to trash the courts, the opposition, and the media. Trump believes that every person and institution that does not favor him is corrupt and needs to be defeated. His supporters are following his lead. Many Republican leaders are afraid of Trump's base and afraid to challenge his view of the world.

As well as it has served us all, we now live in a day and age where a better option exists. Government by AI. No longer will people have to voice their concerns in order for actions to be taken as those concerns will have been predicted and prevented. No longer will concerns about corruption or partisanship get in the way of progress. No longer will the people be held back by the short term thinking of politicians running for re-election. If AG Garland didn't have the guts to act quickly, why on earth didn't he appoint a Special Counsel, as soon as he realised he wasn't up to the job, 2 years ago? Now we're coming up to the election, adding extra pressure on Jack Smith. He will be tough, but Garland has severely handicapped him with such a short time to act in. There were other good prosecutors around, but Garland made the ludicrous statement that he didn't want the investigation to appear "political"!! What else could it be, since it was about the political actions of Trump and his fellow criminals?

Regardless of your politics, we need to all stand against the MAGAtes trying to subvert democracy and destroy this country on a fundamental level. I have always thought that the indictments would come in this order: NY, GA, Federal Government. The first 2 will show his criminality and moral weakness in their full spectrum, the last his unforgivable and bone deep betrayal of this country and everyone who lives here, including those he claims to love, the "poorly educated people". Once the federal indictment is filed then Donald J. Trump will be moved to DC and there he will be confined for the duration of however long it takes to reach the conclusion of his trial. There is no changing the truth of what he has done. Even in the deepest recesses of their souls many of those who continue to support him know that he has used them in whatever way he could to obtain what he wanted. Trying to hide from it will serve them no purpose except to be branded as accomplices to his perfidy. The anger and self-disgust they will feel when they realize the truth of their foolishness and the extent of their betrayal will be hard to deal with but they will overcome it and become the better for understanding that they were all of them deceived. They will understand that it was not "the other" that Donald J. Trump convinced them was the enemy of this country, but Donald J. Trump himself.

How about expelling the judges that lied during their confirmation hearing along with anyone married to an insurrectionist and anyone who talks about their "faith" directing their decisions? Biden should then expand the court and make it clear it is retaliation for McConnell's racist dirty trick--they thought it was so funny to block Obama from nominating a justice, then having a deranged half wit nominate three justices who disgrace the court with their presence on it. Biden should protect US democracy by using his power to pre-emptively make Republican power grabs impossible. Start with changing the rules on presidential pardons so that someone can't be pardoned if they're guilty but they are a friend of the president, which is not what the pardon power is supposed to be used for. It's supposed to be used to establish justice and free wrongly convicted prisoners or those imprisoned as a result of politicized law enforcement and courts.

Was there truly a choice about which indictment comes first? NY has been trying to get him for 50 years! Republicans will "protect" Trump because otherwise they lose everything. Let them lose it. As they say, build back better. We need two healthy parties and we don't have that right now.

I'm not sure I agree with Luttig's argument that it is unfortunate the hush money indictment is first. Obviously it's not the most pressing, or the most significant, or the most necessary. But I think that it may in fact be for the best, for the state of our society. The Republican outrage is so overheated and so counter-factual, it just doesn't leave them anywhere to go when more serious indictments come along, and while it may put more pressure on Smith and Willis in some ways, it takes the pressure off them in many other ways and is instructive.

I agree with you. This is a good case to break the ice. It also draws attention away from what Fanni Willis and Jack Smith are doing. Chronologically, it makes sense to start with the first crime. This happened before he was president. Fanni Willis and Jack Smith with the coup/insurrection cases happened while he was president. The records case carries his crime spree into the post presidency period.

If Pence always knew that he had no authority to change the electoral college vote, why was he seeking advice from you, sir? If you had advised him that there was a way out for him, would he have stuck by his convictions or explore the alternatives? I strongly believe that he was looking for any iota of chance that he could do what Trump wanted, and if your advice had provided him with that chance, he would have taken it. Evil men thrive when good men sit by and do nothing. But for your candid advice, it could have been a different story today. Thank you, sir.

Judge Luttig is a national treasure. However, I must point out the NY charges are happening first because the statute of limitations is about to run out. We didn't want these charges first, but you don't always get what you want 😢

I can understand why Judge Luttig believes the first charge should have been related to the insurrection. However, the NY case may help the other cases by revealing connections that will secure convictions in those pending cases. Lots of RICO going on, man!

Judge Luttig is correct the the 1/6 charge is more important. But Rep. Swalwell's also correct that this shows there's no improper interagency coordination. Also, the trial itself may go first on the federal charges.

Right on. I couldn't quite follow his point. Almost by definition whatever a president did to be the first to be indicted would be "beneath the nation" and "unbecoming of the United States" and generally be a sordid (criminal) affair.
