This video is a detailed discussion on the remedy of mandamus and the conditions that have to be satisfied before the remedy is granted.
It is important to note the following which, though relevant, have not been mentioned in the video:
First, since the remedy of mandamus is a discretionary one, the Court is entitled to look at the entire circumstances of the case to determine whether to grant the remedy or not.
For this reason, when the Court identifies that there has been an unreasonable delay on the part of the Applicant, the remedy of mandamus may not be granted.
In Ghana, Order 55 rule 3 of the High Court Civil Procedure Rules, 2004 (C.I. 47) reads as follows:
"An application for judicial review shall be made not later than six months from the date of the occurrence of the event giving grounds for the making of the application."
What this means is that an Applicant who fails to comply with this timeline may be denied any remedy in an application for judicial review in the nature of mandamus.
