सर दिनांक 22/05/2021 को परिवाद कोर्ट मे द्रज है उस पर HEARING चालू है उसके बाद तीन महीने बाद दिनांक 22/09/2021 को थाने से F. I. R दर्ज होता है परिवाद और F. I. R का मैटर सेम है तो पिछला F. I. R हाईकोर्ट से क्रेस हो सकता है

केस लिस्ट नहीं होना, केस में जल्दी सुनवाई ना होना, केस में बहुत देरी होना, केस लिस्ट होने के बाद भी तारीखे पड़ना वगैरा-वगैरा इन सब बातों से हम वकील भी परेशान हैं। लगता है यह स्थिति सारे देश में है। आज की तारीख में ना मेरे पास इसका सोल्यूशन है और लगता है ना किसी और के पास। जैसी भी है स्थिति को स्वीकार करके उसके अंदर जो जो कर सकते वह करते रहिए और आशा करते रहिए कि आपकी केस जल्दी हो जाएगी। आपके लिए और मेरे सभी व्यूवर्स के लिए प्रार्थना करने के अलावा मेरे हाथ में कुछ भी नहीं है। ‌🙏🏼 ऐसा लगता है कि आपका मामला अदालत में लंबित है, यानी आपके पास एक वकील भी है। तो परिस्थितियों में अपने वकील से पूछना सबसे अच्छा है।

376, 504,3/4 धारा में fir हुई... फिर पुलिस ने case झूठा पाकर केस में fr लगा दी....जिसने case किया था उसने affidavit दे दिया है कि उसने गुस्से में आकर fir दर्ज करा दी थी और कोर्ट में कहा कि पुलिस द्वारा लगायी गयी fr स्वीकर की जाये.. पर अब judge सहाब fr accept नहीं कर रहे हैं...क्या vadiya की माँ 482 के लिए हाई कोर्ट जा सकती है या वादी को जाना होगा

हैलो सर, मैं उत्तर प्रदेश से हूँ और वन दरोग़ा के पद पर कार्यरत हूँ, कुछ दिन पहले मैंने एक वीडियो बलिया के sp को tag करते हुए शेयर किया था जिसमे एक दरोग़ा और सिपाही बिना हेलमेट मोटरसाइकिल चला रहे है, साथ ही मुख्यमंत्री हेल्पलाइन पर शिकायत भी की थी, उसके बाद वो लोग मुझसे नाराज़ हो गये थे और पिछले मैंने मुझे दोनों ने पकड़ के धारा 323, 332, 504, 506 353 लगाकर चलान कर दिया! और जब मुझे कोर्ट ले गये और मैंने जज साहब को सारी बात बतायी तो मुझे तुरंत जमानत मिल गई! फ़िलहाल पुलिस चार्जशीट बना रही हैं, और मेरी cross fir नहीं लिख रही हैं! क्या मेरी fir हाई कोर्ट जाने पर Quash होने के चांस हैं? कृपया मार्ग दर्शन करे! 🙏

For quashing of FIR there is a test laid down by the supreme court in the famous case of Bhajanlal. Only if that test is satisfied your FIR can be quashed. Sir i have a question, mere against bank ne sec 34, 420, 409 lagaya hai ek education loan sanction karne ko lekr, loan was closed on 11th oct 2022. Bank file case against me on 5th Jan 2023. Reason ye hai ki education loan ka paisa institute ko paisa nahi transfer ho rha tha customer k account se, isliye mere account me lekr maine institute ko pay kar diya. Loan repay hokar with interest band bhi ho chuka hai.

sir 156(3)के तहत पुलिस ने fir कर दिया गया है किन्तु fir के आठ माह के बावजूद आज तक investigator police officer DSP stsc police station ने closure report पेश नही किया हैजबकि शिकायत फ़र्जी पाया गया कोई evidence नही मिला क्या किया जाये ताकि police जल्दी closure खात्मा खारीजी report court मे पेश करे क्या fir के आधार पर प्रस्तावित आरोपी को police arrest कर सकती है जबकि investigator को investigation मे कोई evidence नही मिला शिकायत फ़र्जी पाया गया है

एफ आय आर क्वॉशिंग की टेस्ट क्या होती है यह मैंने इस वीडियो में और दूसरे वीडियोस में भी समझाया हुआ है। वीडियो को फिर से देख पहले वह टेस्ट समझ लीजिए और उसके बाद अपना खुद का f.i.r. पढ़िए और देखिए एक ही क्या आपका f.i.r. वह टेस्ट सेटिस्फाई करता है या नहीं। एफ आई आर सच है या झूठ है इससे ज्यादा यह देखना होता है कि क्या f.i.r. यह क्वाश करने की टेस्ट सेटिस्फाई करते हैं या नहीं। ‌ अगर वह टेस्ट पास करते हैं तो एफ आई आर क्वाश करने लायक बनता है।‌ अगर नहीं तो नहीं। केवल झूठ होने से f.i.r. ऑटोमेटिकली क्वाश होने लायक नहीं बनता। अगर f.i.r. झूठ है और क्वाश करने लायक नहीं है, तो ट्रायल के दरमियान कंप्लेनेंट साइड पहले तो यह बात साबित ही नहीं कर सकेगी। और साथ ही में आप उसका झूठापन अपने डिफेंस में साबित कर सकोगे। ऐसी संभावनाएं पैदा हो जाती है। और वहां आपको एडवांटेज मिल सकता है। कृपया इसे अपने केस की लीगल एडवाइज ना माने। यह एक जनरल मार्गदर्शन है। ‌ मैंने जो कुछ कहा वह मुझे जो आपने प्रश्न में लिखा है उस भरोसे सुझा। हो सकता है डिस्कशन के दरमियान और पेपर एग्जामीन करने के बाद कोई और बात भी सोच सकते हैं। इसलिए मेरा सुझाव यह है आपसे कि आप प्रत्यक्ष मिलकर किसी वकील की राय लीजिए और उसके अनुसार चलिए।

Agar joudiciry change honor police zero FIR darj nahi karte hue agar FIR darj karke case bana de 376 ka to kiya es ground par FIR quasesh ho sakta hai Exple jaise agar ghatna A judicial me hui hai to kiya B judicial ki police FIR darj karke B judicial me chargesheet bana sakti hai kiya

Hello sir, My family had a little property related argument with my relatives. In between argument, they(relatives) tried to assault my grandfather but mistakenly one of them(relative) got slipped and fell on ground and had his leg broken. They manipulated that incident, gave wrong information to police and lodged a false FIR(IPC 307) on 4 members of my family, even 2 of them were not present there. We went to police station and requested police to take complaint but those relatives are very strong on financial grounds and have very good sources in policing system and so police denied our request and accepted theirs. Interestingly, Investigation officer of that station said that they can't take our complaint because they are being told by their respective DIG, SP and DSP to not take any complaint from our side. Please advise on this matter. Thank you

Hello if the things have gone to this extent then in my opinion you should approach the high court by filing a criminal writ petition for a direction against the police authorities for registering FIR given that your report makes out a cognizable offence. There is a famous case of Supreme Court in the case of Lalita Kumari where in the Supreme Court has issued guidelines to the police to register FIR whenever a cognizable offence is made out in a report lodged with the police station i.e.the first information report. According to law if you want to approach High Court in a matter like this where the police have failed to perform their duty of registering the FIR even when a cognizable offence is being made out then you have to first exhaust the remedies which are available to you under the code of criminal procedure under sections 154 subsection 3 and section 156 subsection 3. so it is quite likely that if you approach the High Court then the High Court may say that you should first exhaust the remedy under section 156 (3) of CRPC. Now I am not aware of the final aspects of your situation so it is advisable to contact a local lawyer who is an expert in that subject and act according to his advice. ----------------------------------------------------------------------------------------------------------------------- *Adv. What you say appears to be prima facie correct...but still it appears to me to be arguable by the prosecution side...... To arrive at a proper opinion case papers may be required to be examined... Better it is to take advice of a good lawyer of your choice by showing him all the case papers and by consulting him.
