I don't think anybody has said that it will NOT qualify in the future, but they are still just in the very beginning steps.... They're saying that it doesn't qualify YET, because they are still waiting for the lab results to come back that will be used as proof and evidence, in order to bring those charges and have a proof evident hearing to therefore make it eligible at that time.

She was physically fighting back, grasping at any defense in hopes of preventing death. That is textbook psychological torture.
