In this episode, we explain lack of testamentary capacity as a basis for invalidating a will in #Illinois #WillContests, and #Probate #Litigation, including the test for whether a testator has the requisite mental capacity to execute a will. In order to execute a valid will, the person creating the will or trust (“the testator”) must have the mental capacity to understand the ramifications of the act of executing the will or trust.
