It has been 10 years since the Lahad Datu-standoff, where armed militia from Sulu invaded the Malaysian State of Sabah. The month-long confrontation left 71 dead and led to tightened security in Malaysia’s easternmost state.
More recently, individuals representing the Sulu Sultanate attempted to seize assets from Malaysian state-owned company, Petronas, claiming arrears for unpaid dues over the disputed territory.
As the Malaysian government challenged the seizure in court, their Filipino counterparts have said it will not interfere in the affair. The Sulu Sultanate, meanwhile, continue to press their claims over what they see as their ancestral lands. Could tensions lead to a repeat of the violence from 10 years ago?

If you say it is a rent, then where is the agreement between Sulu and Malaysia regarding the lease and payment? Why in the 1878 agreement do not mention Malaysia as a party to that agreement? Why in the receipts of payment which is in Sulu possession did not state the money is for the rent or related to the 1878 agreement? Giving away money is not an offence.

​@@jefferi78The Philippine President after Aquino was a mindanaoan with Sulu ties, thats why, despite after the standoff, the Philippine government has not given any repairations nor had reprimanded those who've done it, and the new administration seems to continue that.

What is a "Sultanate" without subjects? It's 2023, let people live as is democratically From what i've researched a strong majority wants to live as a malaysian or be independent Neither of which have connections to Filipino, maybe the only issue are family members/relatives between the two countries but that is an migration/civilian interaction issue not an issue related to land/creating policies Also say we found a rightful heir, rulers don't become a ruler without subjects. Having loyal subjects is a requirement. what do you think happens when the subjects no longer care about the "rightful heir"?

What undisputable proof do you have that Brunei give Sabah to Sulu? Bear in mind that Brunei (original owner) grant and cede North Borneo to British North Borneo Company on 29/12/1877.

@@markcuzjohnmercado1086 Any pro Sulu or PH claims on North Borneo, their primal source of reference will be the Sulu and British North Borneo Company (BNBC) agreement dated 22 January 1878. In this agreement, Sulu “lease” North Borneo to BNBC (Tausug version - missing during his majesty trip to Singapore) while the English version is “grant and cede”. This information will easily be cherry picked in any of their discussion or debate. But what they will not be revealed are those that can refute their claim. The followings are few of the information that had been kept secret: 1. The agreement between Sultan Brunei that grant and cede North Borneo to BNBC on 29 December 1877 which is 3 weeks earlier than the agreement between Sultan Sulu and BNBC (22 January 1878). This will deny that North Borneo was a gift to Sulu from Brunei. Now you show me an undisputable proof that Brunei (original owner) give Sabah to Sulu as a gift. 2. On 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain (Bases of Peace and Capitulation Agreement). 3. On the same day, 22 July 1878, Sultan Sulu wrote to Governor General of Philippines and Governor of Sulu terminating the 22/1/1878 agreement between Sulu Sultanate and BNBC. Thus, the agreement is null and void. 4. On 24th July 1878, Governor of Sulu wrote to BNBC concerning the Spanish sovereignty on Sulu and its dependencies including North Borneo and the termination of the 1878 agreement. 5. Governor General of Philippines wrote a letter on the same matter dated 20th August 1878 to the Spanish Government in Madrid. 6. Finally, the issues on the agreement between Sultan Sulu and BNBC and the status of North Borneo was settled through the Madrid Protocol (7th March 1885). North Borneo belongs to the British under this Protocol. 7. In addition, during the US colonization of PH, Carpenter Agreement (22/3/1915) was signed by the Sultanate of Sulu which relinquished its temporal sovereignty of Sulu and its dependencies. 8. Later, the 1930 Anglo-US border agreement acknowledge the boundary delimitation between PH and North Borneo that belongs to the British. Most of the above documents are kept either in Public Record Office (National Archives) in London or General Archives in Madrid. It can also be accessible from the Philippines Official Website with Spanish to English translation. Rebut my comment with facts and references. Not hearsay.

This became the basis by Sulu to enforce the ruling for all their claims in other courts such as in France, Luxembourg, and Netherlands. But this do not hold water as on 29th June 2021, Madrid Court retroactively invalidated his appointment, and nullified all his actions as a purported arbitrator. Later the Spanish Constitutional Court on 2nd February 2023 rejected the Sulu appeal to that annulment of Dr Stampa as an arbitrator. Thus, all court cases (including in France, Luxembourg, and Netherlands) that relate to Dr Stampa is null and void. Just like in Spain, the latest Sulu claim at Luxembourg court will face the same fate.

do we really think the sulu will run sabah if they succeed the claim? they abolish the last sulu institution and these people lost without a leaders. suluk community will be overwhelming by foreigners which overtake them in instance. look at their place in the phi country. poor af

@@markv1974 our ancestors in Luzon were Bornean too. It is written in the history of the Philippines that millenia ago ten bornean datus led by Datu Putih sailed out of Borneo to people this beautiful archipelago of ours. They settled first in Panay Island, where they bought the right to settle in the island to King Marikudo and Queen Maniwang-tiwang the land. Until now it's being celebrated that occasion, the Ati-atihan festivals. The remaining datus did the same with the rest of the archipelago. We are melayu people who came from nusantara (archipelago). Melayu people descendants were the Astronesians. Melayu or malays which they want to call themselves in the peninsular MalAysia came from Nasuntara not the other way around.

Surprised the documentary did not make any mention of Cobbold Commission (which is a significant historical event that led to the formation of Malaysia) and interviews with everyday Sabahans (not stateless) on their thoughts about the Sulu’s claims. People forget that Sabahans are legally Malaysians.

Malaysia is a construct created by the british to keep sukarno out. Sukarno was ready to integrate Borneo as soon as the British leaves. He has already taken up Riau which should have been returned to Johor. In short, Cobbold and all were nothing more than old british playbook. Propagandize the population and when the results are favorable advertise to the world. They did the same with UMNO. After UMNo won, they gave malaysia independence since UMNO was their puppet.

Sulu/PH need to resolve 2 legal aspects before making any claim on Sabah from Malaysia. Firstly, Sulu need to show undisputable proof that earlier, Brunei Sultanate give North Borneo to Sulu as a gift for assisting in the Brunei’s civil war. This is to rebuke the existence of 29/12/1877 agreement (consist of 4 agreements) signed by Brunei Sultanate that grant the whole of North Borneo to BNBC. These agreements exist and keep in the National Archives in London. The word “grant” been used, and it has never been challenged or protest by Brunei, even when the British turned Sabah into British Charter (1881), Protectorate (1888), Colony (1946) and finally incorporate into Malaysia in 1963. Secondly, let assume North Borneo belongs to Sulu. Sultanate of Sulu signed many agreements to relinquish its territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and Carpenter Agreement 1915 with the US. Later Spain and US relinquish North Borneo under the Madrid Protocol 1885 and Anglo-US Border Convention 1930 to the British respectively. At the end, Sulu has nothing. Rebut with facts and references. Not hearsay.

Later the Spanish Constitutional Court on 2nd February 2023 (3) rejected the Sulu appeal to that annulment of Dr Stampa as an arbitrator. Thus, all court cases (including in France, Luxembourg, and Netherlands) that relate to Dr Stampa is null and void. Just like court case in Spain (thrice), the latest Sulu claim (2nd) at Luxembourg court will face the same fate. In making an arbitration claim, you need to abide with the arbitration law of the country. To be recognize internationally, it needs to follow the New York Convention 1958. One of the prerequisites is that there must be an arbitration agreement or clause between the parties. Read Article 2 and 5 of the convention. Also read Section 4 of the PH Arbitration Law (RA 876) which has similar requirement. Do Sulu have an arbitration agreement or clause with Malaysia? Furthermore, Petronas shares in the joint venture projects (company based in Luxembourg) in Azerbaijan already been sold to Lukoil (Russian oil company) in February 2022. What to seize?

A arbitral ruling can't be single-handedly revoked by Spanish local court even though it is a Spanish Arbitral court (that is two different court under two different power) especially when some states recognized its ruling. Malaysia should file an appeal on each state who recognized the ruling to revoke it. Meaning, it would take time.

And if you want to go deeper the Malay side says they sold it and Philippine side says they leased it... Well you have to go back further when the Americans who originally obtained the agreement from the Sultan of Brunei (which BNBC would later administrate) and what it says.. a decade before the Sulu BNBC 1877-78 agreement In July 1865, the United States' Consul for Borneo, Mr. Claude Lee Moses, obtained from the Sultan of Brunei a concession which embraced most of the territory later to be administered by the British North Borneo Company ("BNBC"). Mr. Moses was unable to develop the concession himself and ceded the grant to the "American Trading Company" headed by the American Joseph Torrey with the backing of two Chinese businessmen from Hong Kong. With the financial situation of the company in a precarious situation, Mr. Torrey sought to convince the U.S. Government to take over the concession. When this proved unsuccessful, Mr. Torrey found new purchasers in the persons of the Consul-General of Austria-Hungary in Hong Kong, Baron von Overbeck, and the brothers Alfred and Edward Dent, two commercial agents who had founded the British company "Dent & Co." operating out of London and Shanghai. The new concession was an assignment of the original concession to the "AMERICAN COMPANY" (note the word company and the fact they were dealing with commercial agents and commercial interests, and it also is said the concession/agreement "embraced most of the territory of Brunei"... does that suggest Brunei sold most of their territory to America in an agreement which the British North Borneo Company would later administrate??? no it does not...) But what does "concession" mean in terms on commerce, commercial agents and companies? -the right to use land or other property for a specified purpose, granted by a government, company, or other controlling body. "new logging concessions" or - a commercial operation set up by agreement within the premises of a larger concern. "the concessions will offer photo processing and a pharmacy" the right, given by a company, to sell goods, especially in a particular place. So we instantly understand that the concession obtained from the Sultan of Brunei by the Americans was commercial in nature and not a concession of land or property in terms of: - a thing that is granted, especially in response to demands. "the government was unwilling to make any further concessions" or - the action of conceding or granting something. "this strict rule was relaxed by concession" or - a gesture made in recognition of a demand or prevailing standard. "her only concession to fashion was her ornate silver ring" Furthermore: On 29 December 1877, the Sultan of Brunei agreed to issue three separate grants to Messrs. Dent and Overbeck encompassing a large area of North Borneo (some 28,000 square miles of territory) in exchange for a total annual payment of $1 5,000~~. (Since we know what "concession" meant in the original agreement between the American Consul and Brunei by Mr. Claude Lee Moses in 1865 it was for rights to trade and do commerce in the Brunei territories, the rights/concession of which would be later administrated by BNBC) We also understand what "grant" means in these above agreements between Dent and Overbeck. And they were not "land grants or sales of land" but grant in terms of making lawfully the Brunei lands available for the BNBC company to use. -a sum of money given by a government or other organization for a particular purpose. "a research grant" or - the action of granting something. "we had to recommend the grant or refusal of commercial licenses" Furthermore: Since this grant included a portion of territory along the east coast of Sabah which was also claimed by the Sultan of Sulu, Baron von Overbeck deemed it prudent to enter a separate agreement with that ruler as well. In the words of the British Acting Consul-General in Labuan, Mr. Treacher: "The Sultan of Brunei's territory extends, at the utmost, only to the West side of Malludu Bay, though formerly the Brunei kingdom extended as far as Cape Kaniungan, on the east coast, in latitude 1" north. (IMPORTANT PART --->)The remaining territory mentioned in the grants is actually under Sulu rule, and occupied by Sulu Chiefs, and it was only because the districts were Mentioned in the original American grants that they are again included, and Mr. Overbeck will now have to make a separate agreement with the Sultan of Sulu for them". On 22 January 1878, the Sultan of Sulu agreed to transfer to Dent and Overbeck for an annual payment of $ 5,000 a concession to the territory described as follows: ". . . all the territories and lands being tributary to us on the mainland of the Island of Borneo, commencing from the Pandassan River on the West coast to Maludu Bay, and extending along the whole east coast as far as the Sibuco River in the south, comprising al1 the provinces bordering on Maludu Bay, also the States of Pietan, Sugut, Bangaya, Labuk, Sandakan, Kinabatangan, Marniang, and al1 the other territories and states to the southward thereof, bordering on Darvel Bay and as far as the Sibuco River, with al1 the islands belonging thereto within three marine leagues of the Coast" Following these transfers, the Dent and Overbeck syndicate established a presence in Sabah. In early 1878, two "residents" were established on the west coast on the Tempasuk and Papar rivers and one on the east coast at Sandakhan Bay. I have proven without a doubt that these were "commercial grants" for British originally American syndicates, companies and commercial interests to use for an annual payment to use those lands for their commercial activities... after the companies left or disband the land would still belong to the Sultanates that gave them grants and concessions to use it.. These were not "land grants or sales of land in perpetuity" of any kind to the Americans or the British.. In the words of the British side... British Acting Consul-General in Labuan, Mr. Treacher: "The Sultan of Brunei's territory extends, at the utmost, only to the West side of Malludu Bay, though formerly the Brunei kingdom extended as far as Cape Kaniungan, on the east coast, in latitude 1degree north. The remaining territory mentioned in the grants is actually under Sulu rule, and occupied by Sulu Chiefs, and it was only because the districts were mentioned in the original American grants that they are again included, and Mr. Overbeck will now have to make a separate agreement with the Sultan of Sulu for them". Note here: Lord Salisbury Foreign secretary on North Borneo In September 1878, Count de Bylandt, the Dutch Minister in London, handed a note to the Permanent Under Secretary of the Foreign Office, Sir Julian Pauncefote, setting forth the legal rights of The Netherlands~~. Pressed fürther by Count de Bylandt with respect to the request for a Royal Charter by Dent and Overbeck and as to Britain's intentions concerning north-east Borneo, the British Foreign Secretary, Lord Salisbury, replied that his Government respected the rights of the Sultans of Sulu and Brunei and did not intend to do anything in derogation of those rights. Lord Salisbury added: "Probably, even if our response to Messrs. Dent and Overbeck was favourable, Her Majesty's Government would not go fürther than was justified by the precedents of Sir James Brooke at Sarawak, or of those chartered commercial companies which in former times it had been the policy of this country to establish in various parts of the world without any aim of territorial acquisition. CLEAR STATEMENT IS MADE IN UNAMBIGUOUS TERMS: "The object of Her Majesty's Government was not to set up any dominion, or to enter upon controversy with respect to territorial claims, but simply, if we saw an opportunity, to promote the development of the resources of the country under discussion"~ THERE WAS NO INTENT TO TAKE CONTROL OR RULE OVER LANDS ONLY TO DEVELOP LAND! FUTHERE MORE: In any event, the Netherlands Governrnent was not unduly concerned by the BNBC company's activities in North Borneo since, as the Dutch Colonial Minister noted in reply to an enquiry raised by the Parliament in 1880, this was "simply a question of the establishment of a private Company"(By the British). Sulu claim: History vs facts Stating any "historical events" based on many narrations that are in your favor is bias as there are also many narrations that stated the opposite. Legal avenue is the answer, and this is the basic principle in determining justice. It means that in any statement made, there must be an undisputable proof that cannot be denied before making any judgement. That is why for international legal issues, the Vienna Convention on Law of Treaties 1969 is the reference. Any agreement or treaty must be within the context and objective of the agreement. The choice of word and the sentence must clearly state as to give the true meaning to the objective of the agreement. That 1877 agreement consist of 4 agreements and was signed between Brunei and BNBC on the same date. All these agreements exist and kept at the National Archives in London. The word “grant” been used, and it has never been challenged or protest by Brunei, even when the British turned Sabah into British Charter (1881), Protectorate (1888), Colony (1946) and finally incorporate into Malaysia in 1963. On top of that, the signing of the Bases of Peace and Capitulation Agreement on 22/7/1878, Madrid Protocol 1885, Carpenter Agreement 1915 and Anglo-US Border Convention 1930 add up everything and overrule all others.

You came to Sabah to claim this and that, of course as a fellow countryman to Sulu, you will be side by side with them to gain their cause. But, matter of fact, the claim of Petronas asset its doesn't belong exclusively to Sabah, since Sarawak, Sabah, Kelantan and Terangganu is the one who contributed to Petronas revenue since independence. War in mindanao has happened before Malaysia existed, we all aware of that fighting that happened. Not sure was our Government play foul on that also, since I'm not the government. So better understanding is, asset of Petronas is not 100% came from Sabah, it was a collective from other mentiond states. You said you're the biggest, how about you topple the current government and install Visaya as main rather than Tausug. In Sarawak we do have Bisaya communities. We know history.

Why in the receipts of payment which is in Sulu possession did not state the money is for the rent or related to the 1878 agreement? Giving away money is not an offence.

We have this autonomous region of Muslim people in Philippines. They have their own law and forces. For a very long time, Malaysian government has been paying lease to the private owner of Sabah who are situated in Sulu which is a part of autonomous region of Philippines. And these private owners of Sabah are paying big taxes to the Philippine government because Sabah lease received from Malaysian government. I wonder why Malaysian people don't know about this. But Philippine heirs have kept records and evidences about the lease.

Any pro Sulu or PH claims on North Borneo, their primal source of reference will be the Sulu and British North Borneo Company (BNBC) agreement dated 22 January 1878. In this agreement, Sulu “lease” North Borneo to BNBC (Tausug version - missing during his majesty trip to Singapore) while the English version is “grant and cede”. This information will easily be cherry picked in any of their discussion or debate. But what they will not be revealed are those that can refute their claim. The followings are few of the information that had been kept secret: 1. The agreement between Brunei Sultanate that grant and cede North Borneo to BNBC on 29 December 1877 which is 3 weeks earlier than the agreement between Sultan Sulu and BNBC (22 January 1878). This will deny that North Borneo was a gift to Sulu from Brunei. If disagree, show undisputable proof that Brunei Sultanate (original owner) give North Borneo to Sulu as a gift. 2. On 22nd July 1878, Sultanate of Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain (Bases of Peace and Capitulation Agreement). 3. On the same day, 22 July 1878, Sultanate of Sulu wrote to Governor General of Philippines and Governor of Sulu terminating the 22/1/1878 agreement between Sulu Sultanate and BNBC. Thus, the agreement is null and void. 4. On 24th July 1878, Governor of Sulu wrote to BNBC concerning the Spanish sovereignty on Sulu and its dependencies including North Borneo and the termination of the 1878 agreement. 5. Governor General of Philippines wrote a letter on the same matter dated 20th August 1878 to the Spanish Government in Madrid. 6. Finally, the issues on the agreement between Sultanate of Sulu and BNBC and the status of North Borneo was settled through the Madrid Protocol (7th March 1885). North Borneo belongs to the British under this Protocol. 7. In addition, during the US colonization of PH, Carpenter Agreement (22/3/1915) was signed by the Sultanate of Sulu which relinquished its temporal sovereignty of Sulu and its dependencies. 8. Later, the 1930 Anglo-US border agreement acknowledge the boundary delimitation between PH and North Borneo that belongs to the British. Most of the above documents are kept either in Public Record Office (National Archives) in London or General Archives in Madrid. It can also be accessible from the Philippines Official Website with Spanish to English translation. Rebut my comment with facts and references. Not hearsay.

Lol this court ruling is not even a sovereignty issue its ownership issue. No international court could arbitrate sovereign rights (at least in our day and age). The heirs of Sulu sultunate is demanding just compensation for the rent of their property.

No no no, they brought guns because they intended to live peacefully and transition into their new lives. Then they suddenly got ambushed by the Malaysian police and army, but oh look! While living In their peaceful tranquil lives, they just very luckily happened to have some weapons laying around they could use to fight off the big bad Malaysians who nobody could expect or predict would react with so much hostility! The contradiction between their actions and their words is astounding... It's an invasion to take other peoples lives for themselves. If they wanted to genuinely make a better life for themselves, they'd either immigrate legally and eventually take Malaysian citizenship or they'd sneak in as illegal migrants, but blend in with society. It's hard for me to hate illegal migrants who are only looking for a better life, but I am more than happy that these invaders coming with weapons were driven away. I won't dignify their ridiculous claims that they own this land and therefore don't need to follow Malaysian immigration law.

@@mabellee1511 BNBC actually doesn’t have to sign an agreement with the sulus as the real owner of the land is Sultan of Brunei. But after BNBC signed a deal with Brunei, the sulu pirate began attacking villagers and make chaos. So BNBC had to make a separate agreement with the sulu so they would ceased harassing the villagers for a fee of 5000 dollars & cede the territory. In the subsequent agreement the term ceded was used and clearly it was not a commercial agreement

The dominion of that territory belongs to the Sultanate of Sulu. That's why BNBC went to the Sultanate to lease the land for BNBC to administer the land not to have dominion over that territory. Ceded to BNBC? Who was BNBC?, a sovereign state? BNBC was just a private company.

The decision of the arbitration court is final and binding. What happened your appeal in Luxembourgh Court? The Luxembourgh Court seized the asset of MalAysia in favor of the heirs of Sultan of Sulu.

@@fernandocruz4877 , you are wrong. The Paris Court ruling awarding the heirs of former Sultan of Sulu had been set aside and annulled by Paris Court of Appeal. Definition of "set aside" - declare a legal decision or process to be invalid. "annul" - declare invalid (of an official agreement, decision or result). When Paris Court of Appeal set aside and annulled Paris Court Decision, it meant that the verdict as well as the sentence were declared a invalid. For an example in a lower court, in a murder case, the charge was "murder", the verdict was "guilty", the sentence was "death penalty". Then the case is brought up in Court of Appeal. How can the judge of Court of Appeal decides that "you are still guilty as ruled by lower court" meaning the lower court decision was upheld, not set aside and not annulled. But the judge continue "I set aside and annulled the sentence of death penalty ruled by lower court, you are free". This was what you meant by saying the Paris Court of Appeal only set aside and annulled the compensation but not the arbitration decision or the findings. How could it be.

@@fernandocruz4877 , in Luxembourg Court , Sulu first attempted to seize Malaysian Petronas assets but was dismissed due to some technicalities. Then they attempt for a second time due for hearing in September 2023. The case was "a bid to enforce the arbitration award by Paris Court and to seize Malaysian Petronas assets as part of the enforcement". This means that the case is very much depending on the outcome of the judicial process in Paris Courts (the whole process from Paris Court (lower court) and all higher courts). Since the Paris Court of Appeal had set aside and annulled the previous Paris Court (lower court) ruling, it is very likely that the Luxembourg Court will also dismiss their bid. Now is already December 2023, still no news about Sulu's claim proceeding in Luxembourg Court. It looked like they withdrew their case when they acknowledged the Paris Court of Appeal decision.

So let me get this straight. So the Sulu cannot develop their own land and want to impose on other territories ( that was built on Sabahan own sweat and tears? ) If they are underdeveloped, ask the Philippine government to assist more to improve rather than impose your problems on somebody else. Furthermore, when Sabah was fighting for independence, I dont see the Sultan Sulu army or followers coming to contribute anything? The point of the matter is, no matter what all of us said. Sabahan (all of Sabahan) chose Malaysia for centuries. I know a lot of Filipinos back up the Sulu, but we have never tried to claim any of your territory? Why the disrespect? if we want to talk about history. Most of ancient old Sultans have been everywhere, claim everything. But does this hold out now??? This is not a contest, we have always respected both countries with our own borders and sovereignty. For you to claim something for the sake of being greedy under the pretense of a 1000 old agreement doesn't make sense. Again the Sulu even claim that they are Filipinos. It was 100 years ago, and the Sultan of Sulu does not have a rule over the Sulu local government anymore. Nor does it possess an army, PMCs have been becoming less and less. The issue was regarding the oil resources in Sabah. The Sabah people wish to be Malaysian, but the Sulu Sultanate wants the profits earned by Petronas.

This became the basis by Sulu to enforce the ruling for all their claims in other courts such as in France, Luxembourg, and Netherlands. But this do not hold water as the Spanish Constitutional Court on 2nd February 2023 rejected the Sulu appeal to the annulment of Dr Stampa as an arbitrator. Thus, all court cases (including in France, Luxembourg, and Netherlands) that relate to Dr Stampa is null and void. Just like in Spain, the latest Sulu claim at Luxembourg court will face the same fate.

Russia mostly claims Eastern and Southern Ukraine which are the Donbass and Crimean regions. Most of the people there have either Russian blood or they just identify being Russian. Ever since 2014, the Ukrainian government has been bombing and killing those people just because they are Russian and they are doing it despite the fact that Russia is literally next door to those regions which not only caused Russia to be empathetic towards those in Donbass and Crimea but also understandably felt concerned about security because there was conflict already close to them. Majority of the people of Donbass and Crimea voted to join Russia in a referendum but the Ukrainian government doesn't accept it. Since the people of Donbass and Crimea want to join Russia, it is technically the Ukrainian government that is invading Russia instead of the other way around. Meanwhile, the people of Sabah are actually treated well by Malaysia and also want to remain in Malaysia as well. I have seen comments from Filipinos saying the Sabahans should leave their own place because it doesn't belong to them before. At least Russia is defending the people in the Donbass and Crimean regions.

That is a false narrative created by the Sulu Sultanate. North Borneo (Sabah) previously belonged to Brunei before they ceded the entire territory to the British under the 1877 agreement, in the agreement it clearly states that North Borneo will be ceded to the British North Borneo Company (BNBC). However the Sultan of Sulu came along and falsely claims that North Borneo belongs to them, and to avoid a possible war in the region the British enter the 1878 agreement with the Sulu Sultanate which states that Sulu will grant and cede North Borneo to the BNBC which was the original meaning of “pajak”, however the Sultan of Sulu then twisted the original meaning and claims that the word pajak actually means “lease and rent”. The British then agreed to pay 5,000 Mexican gold coins annually to the Sultan of Sulu as cession money for North Borneo but the Sultan of Sulu twisted the narrative yet again and claims that the payment is “rent money”.

Bear in mind that Brunei (original owner) grant and cede North Borneo to British North Borneo Company on 29/12/1877. If you say it is a rent, then where is the agreement between Sulu and Malaysia regarding the lease and payment? Why in the 1878 agreement do not mention Malaysia as a party to that agreement? Why in the receipts of payment which is in Sulu possession did not state the money is for the rent or related to the 1878 agreement? Giving away money is not an offence.

That is a false narrative by the Sulu Sultanate. North Borneo (Sabah) previously belonged to Brunei before they ceded the entire territory to the British under the 1877 agreement, in the agreement it clearly states that North Borneo will be ceded to the British North Borneo Company (BNBC). However the Sultan of Sulu came along and falsely claims that North Borneo belongs to them, and to avoid a possible war in the region the British enter the 1878 agreement with the Sulu Sultanate which states that Sulu will grant and cede North Borneo to the BNBC which was the original meaning of “pajak”, however the Sultan of Sulu then twisted the original meaning and claims that the word pajak actually means “lease and rent”. The British then pays 5,000 Mexican gold coins to the Sultan of Sulu as cession money for North Borneo but the Sultan of Sulu twisted the narrative yet again and claims that the payment is “rent money”.

The Philippines claims Sabah on the basis that Sabah was said to be once under Sulu Sultanate. Descendants of former Sultan of Sulu claim that Sabah belonged to Sulu Sultanate because Sabah was given by Brunei the original owner to Sulu as a gift for purportedly helping Brunei to fight rebels. But Brunei refuted this claim and denied ever having given Sabah to Sulu. There was NO DOCUMENT regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans. In fact on 29 December 1877, the Sultan of Brunei ceded the whole of Sabah to BNBC/British and concurrently appointed Baron Von Overback, the co-owner of BNBC as Maharajah of Sabah and Rajah of Sandakan and Gaya. This cession agreement was documented. When BNBC went to Sabah to begin their business, Sulu claimed that Sabah belonged to Sulu. BNBC agreed to enter a "pajak" agreement with Sulu after they were advised by their fellow businessmen in Hong Kong who advised that Sulu would attack them if they didn't have a deal with Sulu. This "pajak'' agreement was signed on 22 January 1878. BNBC understood that this "pajak" was a "cession", so did early generation of Sulu Sultan accepted it as "cession". Only later generation of descendants of former Sultan of Sulu claimed that the "pajak" agreement was meant to be "rent" or "lease''. Still there was NO DOCUMENT regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans. The two above events led to an overlapping issue on Sabah. What ever it was, the above agreement and overlapping issue were superceded by later event. On 22 July 1878, the then Sultan of Sulu had relinquished all his possession and sovereignty of Sulu and it's territories including Sabah to Spain. The Sultanate of Sulu only remained as hereditary cultural and traditional entity without any sovereign territory. In 1885, to resolve overlapping issue on Sabah and other issues involving other islands, Britain, Spain and Germany arrived to an agreement known as Madrid Protocol in which Spain surrendered Sabah to Britain. As new owner of Sabah Britain had full control and sovereignty over Sabah and they could do what ever they wanted. Sulu could not claim anything because they had already relinquished the sovereignty of Sabah to Spain and Spain surrendered Sabah to Britain. What ever happened to Sabah after that was under British jurisdiction. Even though British had full control and sovereignty of Sabah, they still honoured the annual "cession money" payment stipulated in the "pajak'' agreement as consolation for the Sulu Sultan. So did Malaysia when formed in 1963, still honoured the annual "cession money" payment as consolation for the Sulu Sultan. The term "cession money" was used because to use the term "consolation" was felt to be too degrading. Thus the term "cession money" was continually used as used before by the British. Even the argument about the word "pajak" and it's meaning in the "pajak" agreement still favoured the British. The "pajak" agreement was written in classical Malay, in jawi script (Arabic alphabet). Malay is the national language of Malaysia and Brunei, and mother tongue of majority Malaysians and Brunei. In those days, Malay was also used by people of Sulu because Malay was the "lingua franca" of this region including the present Philippines. That was why the agreement was written in Malay. But over the years Sulu people had lost their Malay language (standard Malay) because of several reasons like colonisation by different European. This made Sulu relied on translation of the agreement. Things got worse when they translated it to Sulu's local language, be it Tagalog or Tausug, which was rather translation of another translation, that they translated it to their favour. The word "pajak" carried several meanings depending on the contact used in the sentence or passage. It could mean "tax, rent, pawn, lease, or cession". In the agreement between BNBC/ British and Sulu, the word "pajak" was used together with the phrase "selama-lamanya" which meant "forever". When "pajak" was used together with the phrase"selama-lamanya", in this contact the word "pajak" meant "cession". Cession means "the formal giving up of rights, property or territory by a state". When Sulu "pajak" Sabah to BNBC it meant Sulu ceded Sabah and it meant Sabah no longer belonged to Sulu. This was further clarified. There was a second agreement which was a supplementary to the first agreement known as "Confirmation of Cession of Certain Islands Agreement". It was regarding certain islands between Sabah and Sulu which they were not sure whether they were included in the first agreement or not. In this second agreement, the word "pajak" was no longer used because they thought it might lead to misunderstanding by later generation. Instead the word "menyerahkan" which meant "surrender" was used, and the annual payment was increased from 5,000 dollars to 5,300 dollars due to certain islands included. Another example where the Philippines generally or Sulu in particular misunderstood due to wrong translation or translation to their favour, was about the clause that the territory could not be transfered to another party. Yes, there was a clause that Sabah could not be transfered to another party "... without the consent of 'Duli Queen'...". The British translated "Duli Queen" as "Her Britannic Majesty", even though it was not correct literally but it was correct in the meaning. The "... Queen" was referring to Queen Victoria, the ruler of England / Britain at that time. But Sulu translated "Duli Queen" (or rather translated from a translation) as "Their Majesties' Government". This led to an understanding that "Duli Queen" was the ruler of Sulu. The question was since when Sulu as a Muslim state had a female as their ruler (Sultanah or Queen)? The above showed that North Borneo (Sabah) had indeed been ceded to Britain, that was why it could not be transfered to another party without the consent of 'Duli Queen' (Queen Victoria), the ruler of England/ Britain at that time. And further it was stated that any dispute about the agreement had to be referred to the "Consul General" being the Queen's representative in Borneo to be resolved. It meant that outside Arbitrator had no jurisdiction over the agreement. This fact became the main reason of judgement by Paris Court of Appeal in setting aside and annulling the Paris Court (lower court) ruling awarding the heirs of the defunct Sulu Sultanate. On 31 August 1963 Britain gave independence to Sabah and before that on 22 July 1963 Sarawak was given independence. The people of Sabah and Sarawak had exercised self determination to form Malaysia together with Malaya and Singapore. The sovereignty of Sabah and Sarawak as component states of Malaysia is intact and recognized internationally and recognized by the UN. This was confirmed and clearly stated in the United Nations Malaysia Mission Report "Final Conclusion of the Secretary-General", 14 September 1963. The last sentence of the report says: "I fervently hope that the people of these territories will achieve progress and prosperity, and find their fulfillment as component states of Malaysia". Full text of the report can even be accessed from the Philippines Government Gazette website. About the arbitration award by Paris Court to Sulu of US$14.92B, it had since been set aside and annulled by Paris Court of Appeal. Here is the latest situation. Latest as in June 2023: 1. June 6th - Paris Court of Appeal had set aside and annulled the previous Paris Court (lower court) ruling awarding the heirs of the defunct Sulu Sultanate. 2. June 27th - Dutch Court of Appeal in The Haque had dismissed a bid by eight descendants of former Sultan of Sulu to enforce the arbitration award by Paris Court (lower court) ruling, and dismissed an attempt to seize Malaysian assets following the Paris Court of Appeal decision. 3. Paris Court of Appeal also imposed on Sulu €100,000.00 (Euro currency) to be paid to Malaysia as legal cost. 4. Mean while in Luxembourg, a second attempt to seize Malaysian Petronas assets had been filed in Luxembourg Court due for hearing in September 2023 after the first attempt was dismissed. This will likely be dismissed too following the Paris Court of Appeal decision. Now is already December 2023, no news about Sulu's claim proceeding in Luxembourg Court. It looked like they withdrew their case when they acknowledged the Paris Court of Appeal decision. Malaysia had spent around RM32m, equivalent to about US$6.6m to deal with these Sulu claim cases in various European courts, in Madrid, Paris, Luxembourg and Netherlands. Apart from the €100,000.00 Sulu has to pay to Malaysia as legal cost, Malaysia is planning to sue Sulu for compensation for the loss of RM32m spent.

@ColoniaMurder20 , "....renting..."? Proof that the payment was for "renting". Show proof of any "renting" agreement document that the name of the country "Malaysia" written in it. You don't have to "wait until Malaysia will drop renting...". Malaysia had already stopped the payment since 2013 after the Lahad Datu intrusion. So, what are you waiting for. We had been hearing this kind of rhetoric since 30, 40, 50 years ago.

Or the other way around.. the bolkiahs are part sulu and tagalog. Manila was a bruneian city. And the rulers of sulu are bolkiahs too, the same as the rulers of Manila. Brunei relinquished it claims to sabah to sulu, in the same way that Manila and tondo were independent of brunei despite being ruled by the same family.. After all, england, scotland, and wales are different nations despite being ruled by the same monarch.. maybe malaysia can give back sarawak to brunei, sabah to the philippines, and we can call it even. 😅

the sulu migrants in Sabah are not happy when the sulu royal pundits come to sabah and threaten war. even so sulu did own half of sabah originally, the fact that they got ousted by their own phi government and lost all the sovereign in their land in phi. it is easy to blame Malaysia government for the suffering of the suluk community southern phi when they can't blame it to Philippines government who take awah their automomy malaysia government has be so accommodating the suluk people the alleged royalties by letting them staying on pulau gaya a part where historically no in the lease. Philippines people need to understand that the poverty in the southern Philippines are caused by the Philippines government not by the Malaysia government. The migrant sulu community knew pretty well that they live better as a illegal migrant than legal citizens in their own home in Philippines. They got to earn more money than their people at their hometown southern Philippines and even get better healthcare by the public hospital and ngos in sabah. The sulu royalties and especially Philippines government are to blame for the sulu community grievance for generations. Their refusal to have set up an office and help their own people in immigration matters make this harder for them because phi government in principal refused to acknowledge Sabah. The self claim sulu sultan should take sabah and Malaysia generousity and look at making economic plan than pressuring sabah into war for money If 200 people can go to war and die for you, why not use them to work on the plantation and factories made produce that they can sell. I felt that the real sulu community oppresor are the phi government and selfish sulu royalties pundits who living in a better life in their imaginary power while their people living in poverty. Philippines government and the sulun royal pundits should decide if they want to improve and empowering the sulu muslim community or just another greedy land grab of Sabah. Even if Malaysia return sabah to Philippines, do we really think the sulu royalties pundits will have the right to run the place? While the conflict between the rebels and phi government not settle, they will give it to more pro christian politician to run the country and the sulu community still be poor and neglected. Most of the sulu migrants rather risk of working illegally in Sabah and legally in southern phi because the peaceful surroundings created by Malaysia government These people run to sabah to avoid war and conflict. now seeing these sulu pundits and phi nationalist threaten Malaysia with confrontation are basically stupid and selfish. Malaysia governments give sulu community more opportunities than the phi federal government and sulu royalties pundits. if so the sulu royalties pundit going to create chaos in sabah i bet the sulu community in sabah will smashed them first because under sulu or phi government, nothing good come.

Sulu/PH need to resolve 2 legal aspects before making any claim on Sabah from Malaysia. Firstly, Sulu need to show undisputable proof that earlier, Brunei Sultanate (original owner) give North Borneo (Sabah) to Sulu as a gift for assisting in the Brunei’s civil war. This is to rebuke the existence of 29/12/1877 agreement (consist of 4 agreements) signed by Brunei Sultanate that grant the whole of North Borneo to British North Borneo Company (BNBC). These agreements exist and keep at the National Archives in London. The word “grant” been used, and it has never been challenged or protest by Brunei, even when the British turned North Borneo into British Charter (1881), Protectorate (1888), Colony (1946) and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia. Secondly, let assume North Borneo belongs to Sulu. Sultanate of Sulu signed many agreements to relinquish his territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and Carpenter Agreement on 22/3/1915 with the US. Later Spain and US relinquish North Borneo under the Madrid Protocol 1885 and Anglo-US Border Convention 1930 to the British respectively. At the end, Sulu has nothing. Rebut with facts and references. Not hearsay.

@@hopelope1703 they did show some kind of proof. Hence added to these issues. From memory, the state of Philippines has no play, because of "kingdom". It's the datu's of Sulu vs state of Malaysia. Then there are wordings based on British etc.. hence all these confusions. Personally, Sabahan chose to side with Malaysia, so they should be Malaysian BUT -- it displaces a lot of people.. the more I read into this, the more it's conflicted, hence where we are today. Ican only pray for the natural sabahan people and the sulu people. on another matter, malaysia, philippines, indonesians are of the same group of people.. we are one. (even to a point where i'm thinking all those 3 countries should be one).

@@JojieCerteza But all evidence shown by Sulu can be disputable in court. Furthermore alot of their evidence are merely hearsay. That is why they lost many court cases regarding their claim on Sabah. In my opinion if they just ignore the claim and come to Malaysia through a proper channel, easily they can find work. This will help them and their familes in PH. No need Malaysia to bring in workers from India, Bangladesh, Nepal and so on.

I was in Malaysia during that time, studied at Sunway University near Kuala Lumpur, I did not use a smartphone, and the way the news covered it (especially The Star - Malaysia) was like a full war, not a standoff, so I was thinking to fleet to Singapore or Thailand, drop half of the semester left.

On 29 Sep 2022, lawyers for the Sultanate heirs sought permission from a court in the Netherlands to enforce the arbitration ruling on Malaysia. Before it was in Spain, France, and Luxembourg. They been hopping from one court to another (Spain, France, and Luxembourg) trying their luck. If they have an arbitration agreement or clause, then one court is good enough as stipulated under the New York Convention 1958. 1. Earlier, on 29th March 2019, the Civil and Criminal Chamber of the Superior Court of Justice of Madrid rendered Judgment 11/2019 had earlier upheld the Arbitration Agreement. The High Court of Justice of Madrid (HCJM) was the Spanish court that initially appointed Stampa in 2019 and had on June 29, 2021, retroactively invalidated his appointment, and nullified all his actions as a purported arbitrator, including his alleged “preliminary award” that he had rendered in favour of the claimants in Madrid. Subsequently, Spanish Constitutional Court on 2nd February 2023 rejected the Sulu appeal to the annulment of Dr Stampa as an arbitrator. Thus, all court cases (including in France, Luxembourg, and Netherlands) that relate to Dr Stampa is null and void. In France which is on Stay Order by the French court is pending on the outcome of the Spanish court decision. 2. Paris Court: On 12 July 2022 Malaysia obtained Suspension (Stay) Order from the Paris Court of Appeal to suspend Exequatur Order issued by Paris Court. A Stay Order obtained in the French Court of Appeal pending application to set aside an arbitration award in an arbitration proceeding also to be filed in the French Court has a high probability to be allowed since the arbitration proceedings itself was held ex-parte (one sided) which is deemed deficient and defective. Also, this court has no jurisdiction on a sovereign state. Soon it will just be like Spain that rejected the claim in 2021. 3. French arbitration court: Under the French Arbitration Law, original arbitration agreement or a copy thereof must be provided when settling a dispute through arbitration in France to proceed. This is in accordance with the more precisely Article 1504 of the Code of Civil Procedure or CPC. This is also in compliance with Article 2 of the New York Convention 1958. So, is there any arbitration agreement exist between Sulu and Malaysia? If none, the court cannot proceed. 4. ICC International Court of Arbitration: It is just an institution for the resolution of international commercial disputes based in Paris. It operates under the auspices of the International Chamber of Commerce and consists of more than 100 arbitrators from roughly 90 countries. Contrary to what its name suggests, the ICC does not issue formal judgements. Instead, it just provides judicial supervision of arbitration proceedings. 5. Luxembourg arbitration court: Read the Luxembourg Arbitral Act particularly in Article 1224 to 1251 of the New Code of Civil Procedure (NCPC). Pursuant to Article 1226 NCPC, arbitration clause or arbitration agreements can be made before the arbitrators, by deed before a notary or by written agreement. Article 1227 of the NCPC provides that the arbitration agreement must specify the intention of the parties to submit their dispute to arbitration, the subject of the dispute and the arbitrators’ names to be valid. Do Sulu have that arbitration agreement? If not, then the court cannot proceed. Luxembourg court has sets aside Sulu claims. The hearing was done on 5th December 2022, but the judgement was delivered on 24 January 2023. 6. The New Dutch Arbitration Act entered into force (1/1/2015), replacing the Dutch Arbitration Act of 1986. The New 2015 Act is still contained in book 4 (arts 1020-1077) of the Dutch Code of Civil Procedure (DCCP). For an arbitration agreement to be valid under Dutch law, the dispute that must be settled must arise out of a contractual legal relationship (article 1020 DCCP). The arbitration agreement must be in writing. Inclusion of the arbitral agreement in general terms and conditions may not suffice. 7. Even under Section 4 of the RA 876, PH Arbitration Law require an arbitration agreement or clause between parties. Do Sulu, have it?

Why in the 1878 agreement do not mention Malaysia as a party to that agreement? Before MalAysia was created in 1963, the Sultanate of Sulu gave their domains and allegiance to the Republic of the Philippines. So, PH is the successor state of the Sultanate of Sulu. That's why the heirs of Sultanate of Sulu are filipinos.

What is now east Sabah was originally a Brunei procession. Sultanate of Sulu claim that brunei give it to them for helping them with a certain war. Which the Brunei claim they never received and thus they never transferred it sovereignty to Sulu. When the Brits arrived & wanted Sabah. they just paid both Brunei & Sulu who claim sovereign over Sabah. And in the contract they specifically said it's NOT a lease. Jump forward a few decade the then US which administer the Philippines & UK which administer Sabah sign a border delimitation agreement which is now the border between MY & PH. Sabah join Malaysia after a UN observed vote where the majority of sabahan voted for to join in.

Southern Philippines especially Sulu had never experienced so much peace before. Too many kidnapping, terrorism, and illegal activities were happening before. But when PH President Duterte took his office we saw significant improvement now. More entertainment, more tourism and other business activities. I could describe it like Japanese-Halal type of environment. At 7-8pm all activities are stopped and rest time occurs. It is more of a Modern-Muslim Organic Society. During marawi seige, many corpses are recovered and none of the residents there confirm their identity. That's where they found out that it is more a Malaysian/Indonesian decent dead bodies. And those who are funding the insurgency in the Southern Part of the Philippines are Malaysian government and Americans and west oligarchs. Sad to say, Sulu ancestors and its rightful people can only achieve this peace thru a bloody battle. And too bad for Malaysia they are a victim of British and Western Imperialism but they had their share of prosperity in the land century already. It is now a turnaround events for Philippines.

If this is historically true so this is a classic example of a renter of a land who never return that land to the rightful owner. If we could not call it a land grabber so what it is? Additionally, I could not understand a country, which majority of its citizens are from Muslim Malay descent, could not accept "stateless group of people', who are Muslims and have Malay descent too and who were living in Sabah for decades already. If they can accept Chinese and Indian descent individuals to join their citizenry, how they could not do it to their own look alike- brothers. Correct me if I got wrong..

The rulers of manila are bolkiah, the rulers of sulu are bolkiahs, even the bisaya are from borneo.. 😅.. have you asked grandpapa hassanal bolkiah if his ancestors did not give sabah? Oopss i forgot, you took a lot more from brunei.. brunei is not actively antagonizing malaysia because you sorround them.. but brunei has never opposed the sulu and philippines claim.. That said, while they might have different last names like kiram, macapagal, salonga or del rosario etc.. these prominent figures in philippine politics are all bolkiah descendants 😊.. malaysian are the interlopers in borneo.. Why not give back brunei’s territories and you can stick to melaka and the peninsula.. Also its not as if you treat the native sabahans well.. theyre marginalized and you look down on them.

No, the phillipines gives them standing. The sulu have phillipino citizenship and passports, and live in philipino territory. The reason the Phillipines even supports the sulu claim is cos money. Why wouldn't you support them? Even if their delusion and their claims are ridiculous, support them anyway and convince everyone to believe them. Myabe you can get a payout from Malaysia some time in the future.

Any Filipino and Sulu supporters would point to the 1878 agreement and claim that Sabah was lease to the British North Borneo Company (BNBC). But there are numerous evidence to point that Sulu did not previously own Sabah as the self-proclaimed Sulu heirs would suggest, the claim that the Sultanate of Brunei gifted North Borneo (Sabah) to the Sultanate of Sulu as a gift can be disputed and debunked by the following evidence: - 1877 Agreement Prior to the 1878 Agreement which was signed between the British North Borneo Company (BNBC) and the Sultanate of Sulu, there was an agreement that was signed in 1877 between the Sultanate of Brunei and the British North Borneo Company. Within this agreement, the word “grant” has been used numerous times. It’s also stated within the agreement that the entirety of North Borneo (Sabah) will be ceded to the British North Borneo Company (BNBC) for 15,000 Mexican gold coins . With these statements, it’s clear that the Sulu Sultanate did not own North Borneo (Sabah) and that the 1878 agreement is redundant. I would also like to point out that within the 1878 agreement, the word “pajak” was meant to be stated a “grant and cede”, and within the receipts of the so-called “rent payments” are listed as cession payment. Cession means to give something away. With that this proves that the 1878 Agreement wasn’t a lease agreement but rather a cession agreement. But let’s say for the sake of argument that the Sultanate of Brunei gifted North Borneo (Sabah) to the Sultanate of Sulu and that the Sultanate of Sulu did indeed own Sabah and that the 1878 agreement was a lease agreement. Yet the Sultanate of Sulu has signed many agreements which relinquishes their rights over Sabah. These are the following: - 1878 Bases of Peace and Capitulation Agreement This agreement highlights the Sultanate of Sulu’s surrender of sovereignty to Spain. This means that anything happens whether internal or external affairs is under Spanish jurisdiction. - Article III of the Madrid Protocol of 1885 The Madrid Protocol of 1885 was an agreement between the United Kingdom, Germany, and Spain to recognise Spain’s rule over the Sulu Archipelago. There is a particular statement within Article III which states that Spain will relinquish all of their claims on Borneo. This alongside with the 1878 Bases of Peace and Capitulation Agreement as stated previously shows that the Sultanate of Sulu now no longer have any jurisdiction over North Borneo (Sabah). This also means that North Borneo (Sabah) is now under complete British jurisdiction. - 1903 Confirmation of Cession This agreement was signed between the Sultanate of Sulu and the British North Borneo Company (BNBC) in which it states that the Sultanate of Sulu will grant and cede North Borneo (Sabah) as well as additional islands which is how the payment of 5,000 Mexican gold coins which at this point has switched entirely to the Malayan dollar increased to 5,300 Malayan dollars. - 1915 Carpenter Agreement This agreement was signed between the Sultanate of Sulu and the United States. Within this agreement it states that any power that the Sultan of Sulu has over his land has been given to the Philippines which is under American-rule. -1930 Anglo-US Border Convention This agreement was signed between the United States and the United Kingdom. This agrement also define the border of North Borneo (Sabah) and the Philippines with the agreement being that North Borneo (Sabah) will remain under British jurisdiction and the Philippines being under American jurisdiction. -1963 Malaysia Agreement Finally this agreement was signed between the United Kingdom, Malaya, Singapore, Sarawak, and North Borneo (Sabah) to form a new country now known as Malaysia. Now that North Borneo (Sabah) has gained it’s independence from the UK, they opted to join this agreement and with the previous agreements signed, it means that North Borneo (Sabah) now have self-determination. And with the UK approving this agreement under the Malaysia Act of 1963 which has been passed in the British Parliament. This agreement has also been recognised by the United Nations and agreed on by the UN General Assembly and the UN Secretary-General himself. This means that Sabah is now rightful Malaysian territory. With all of these facts in place, it’s clear that Sabah rightfully belongs to Malaysia and neither the Philippines nor Sulu have any legal claims over Sabah.
