If a merchant accuses you of Theft by Deception due to a credit card chargeback, is that criminal or civil? Can you counter sue because they actually didn’t deliver the complete services?

Which is common law. So what kind of case is a traffic ticket? Writ of Assistance / Bills of attainder? Who is suing who? Who is hurt or broke a contract? uhm
