The plaintiff bought a puppy from the defendant. She says the puppy was taken from her mom too soon and the puppy ultimately died. She’s suing for the cost of the puppy, vet bills, and cremation. The defendant argues the plaintiff did not listen to him about what to feed the puppy and it’s not his fault the dog died.

I agree with judge Milian. It was both of their fault. She should have brought the puppy back after the first day of not eating. I wouldn’t have waited that long AT ALL! but he did sell it to early. He should have taken it back for a couple more weeks and then gave it back to her when it was old enough. Poor puppy.

I would've asked for a sample or a pic of the food when the dog was old enough... And she's right. She's not ready for another puppy yet...

Agreed. I got the sense that the plaintiff was so invested in 'being right' about the dog being taken from its mother too soon that she was willing to participate in the killing of the poor dog just to prove that point. (yes, the plaintiff was right the dog went too early, but all of her actions after that... UGH! Great! You were right! The puppy is DEAD. Because you BOTH KILLED HER.).

The defendant kept saying the puppy was "licking" the puppy chow, not eating it. He should of never sold that puppy that young, and be reported to animal control.

The only one I feel sorry for is the puppy. Her innocent life was in their hands and neither of them took responsibility for taking care of her.

5 weeks is WAY too early to take a puppy from it’s mother. 8 weeks is normal and in many places it’s illegal before 8 weeks

I got mine at almost 5 weeks, the mom died, so my cousin gave me one of two puppies, I bought formula and puppy canned meat that was ground with gravy, mixed it with the formula when Puppy turned 6 weeks, She was eating okay, I had to give her up though because Neighbors complained she was loud, she cried alot at night and I didn't know why, I was 14 years old when this happened so my father decided to take the pup to the shelter, After that I Never wanted Another dog Again, you get Attached and then for it to be taken Away, Hurts!!! Especially when I tried so hard to make the Best of a bad situation but I was delt with the jack a$$ father who cared about saving money more then taking the pup to a vet, so to a shelter she went, until this day I don't know if she was taken care of or killed, that was back in 2004 😔 some people Shouldn't have Pets if They're not going to have the Animals Best Interest at Heart!!!

@@DBDG0499 In your case no one had any choice in the puppy losing her mother. You did the best you could with a terrible situation. The reason the puppy cried so much was likely because she lost her mother before she was emotionally ready to leave. She was crying from grief. This is another reason puppies should never be taken from their mother before 8 weeks. It causes them emotional trauma. Some experts say it may even cause PTSD for both the mother and the puppies. As far as the puppy being adopted goes, odds are she found a home. Puppies usually get adopted quickly.

I've watched a lot of People's Court. This is the first time I was fully yelling with the judge. Make them both pay full price and donate the money to The Humane Society.

The plaintiff surely had a nasty attitude to say she knew she was taking the puppy too soon and wasn't feeding it. The defendant was very nasty too until the judge made him pipe down. Poor puppy.

My doberman puppy, 8 weeks, didn't want to eat for the first two days. I'll tell you what, those two days were a nightmare. There was pleading, sobbing, bartering. Turns out, he hated the Victor food brand. I ran out and tried Purina pro, which he still eats, and he took it immediately.... after he managed to yank the bowl off the floor and spill it. 1 year old this month and he still knocks over his bowl. I don't even bother. Straight in his kennel it goes. At least he gets most of it that way lol.

That website clearly said weaning STARTS at 3-5 weeks and takes several weeks! I agree that they both killed the little puppy

As a vet tech I personally) like to have them stay with the mom 10-12 weeks. And I've fostered/bottle fed puppies that young. She should have been bottle feeding :(

Absolutely! I have fostered many mom's and pups. I would NEVER EVER give them adopt them out until they were fully weaned, Vet visit, Playful and Healthy.

I’ve bottle/syringe fed kittens and puppies when mothers weren’t feeding or if something happened and the mothers weren’t around anymore. This is absolutely sickening 5 weeks old? There’s no reason these people are stupid enough to have been trying to feed puppy chow🤦🏻‍♀️ they eat every 3-4 hours that young. It takes a simple GOOGLE search

Exactly. My dog, a stay we took in, was pregnant. She wanted nothing to do with the puppies at all after a week. She was a 50lb dog with puppies that we learned came from the rottie up the street. We had to bottle feed those 10 puppies around the clock. I'm just glad I didn't have a job then. I always had a puppy in hand.

I think she did give the dog raw food. The vet doesn’t write down things that you didn’t do, what would be the point?

Exactly!! I believe the puppy would have been ok if she didn't get her sick trying to feed her raw food. If she really cared the puppy would have been alive. Lots of puppies lose their mothers and rescuers nurse them. She gave the poor puppy an infection. 😡😡😡

Raw feeding is one of those things that has to be done right. Puppies can thrive on it, even at 8 weeks. But 4.5 or 5 weeks, that puppy specifically was not ready for it. They're not ready for anything non-milk until they have teeth. That baby didn't have teeth. And the fact that it was licking food... it was thirsty. It needed milk. I fed raw with outstanding success. I would never have given it to that puppy.

I don't understand the plaintiff. She knew that the puppy was to young but decided to still get it. she knew it was still to young and still decided to feed it solid food. I may not be a dog person but I'm pretty sure the food should still be liquid base. also did she not think there was something wrong if the puppy did not eat for a single day? bad seller and bad buyer!

That dog, I've reared puppies from birth, should have been on solid milk. He had no teeth. No teeth, no solid food. My pups got moistened with milk replacer puppy food when they had enough teeth to pinch. Not one or two, a mouth. That man shouldn't have sold the dog. Period. But he, her I blame the most. She claims to have so much experience, she could have quickly researched it. Got the bottle, tucked the puppy into herself, and fed that baby round the clock. That's what it takes.

She's absolutely right. 5 weeks old is WAYYY to early to take a puppy away from their mother. They are NOT ready to leave at 5 weeks...they are still nursing and learning valuable education from Mom. They can START weaning at 5 weeks....but as the text said it takes SEVERAL WEEKS to wean them and they are still being supplemented with the nursing from the mother. In my experience (having supervised MULTIPLE breeding with my dogs) its usually 8 to 10 weeks before the puppies are ready to be adopted out. With ours, we waited for the 10 week mark, and made sure our pups were healthy and thriving and that their new owners were able to care for them properly. Only once did we ever renege and take the puppy back (and that was for her own protection. We wound up keeping her). This guy is CLEARLY an irresponsible breeder if he thinks its fine for a puppy to be adopted THAT YOUNG and be put entirely on a solid food diet. He CLEARLY had no clue. I'm shocked the mother didn't attack him for taking her pup. My question to her though is, IF YOU KNEW that this puppy was far too young to leave her mother, and she wasn't eating, WHY THEN didn't you either leave her with her mother....or go to the vet IMMEDIATELY and explain the situation and ask the vet for formuIa to feed this toothless baby? Or take her BACK to her mother after the first day when you clearly see she is not eating and INSIST that you will come back for her at 8 weeks when she's weaned properly. I guarantee you the pup would have had a better chance at thriving if she had been left with her mother until at least 8 weeks of age. I've done bottle feeding before. Its hard, but when you make stupid choices like KNOWINGLY taking a baby from its mother too soon....this is what you have to do. The puppy has no teeth yet.

My cat's mother was feral. She hated being in a home & abandoned her 3 kittens at 4 1/2 weeks when she ran out a window through a screen. We immediately consulted a vet & got formula & bottle fed them. Tiny teeth were there but they were not ready for solid food even with teeth.

@@zombie5017 You lucked out but that doesn’t change the fact that it is healthiest to leave babies with moms until a minimum of 8 weeks. It’s actually the law in most states. Just because it worked for you, doesn’t mean it’s what should be allowed to happen

She should have also insisted on waiting until the puppy was 8 weeks old. As she put down a deposit, it's not like he could have sold the puppy to anyone else without her suing for her money back and winning since he would have breeched the contract. Not to mention that she was a complete idiot for putting the puppy on rare food, especially as she had just admitted that you're not supposed to change the dog's diet right away. She could have spent $10 for a bag of puppy chow and did what he said. If they puppy didn't eat then, then go to the vet and get medical proof that he did wrong. As the other puppies that we can only assume were given away at the same time are alive and doing well, we can safely assume that the plaintiff did the wrong.

I've had 2 litters back to back. this guy was in it for the money because of the demand of the pandemic so he rushed it all. gotta at least bottle feed it everyday until its 8 weeks old if its not gonna be on the moms milk. even when the pups on mom i still bottle feed.

I thought it was common sense that 8 weeks is the earliest a dog should ever be taken away from its mother, unless the mother stop’s nursing. I have a cat that the mother did not and would not nurse her kitten. It is possible to still feed a cat or dog if the mother won’t but should be done in the correct way. I agree with earlier post’s that neither one should own an animal let alone breed them.

Absolute fair judgement!! They both contributed in the death of this poor puppy. It truly was too early to let that puppy leave the mother. If the puppy was not eating the food my first thought would be to bottle feed. 5-6 days this woman sat and did nothing. I hope she would have enough care to know a human baby would need serious attention if it wasn’t eating in that length of time. It’s always hard for me to really pass judgement on some of these cases sometimes. I have to remind myself not everyone thinks as I do. Not even implying my way is correct because I can be wrong, too. Just seems in a lot of these cases people do not think at all. Anyways, I agree with JM here. Feel so bad for that poor puppy.

IMO the plaintiff is the most at fault. One for taking the puppy when she thought it was too early. She could have said she will pick it up in 3 more weeks. And Two because she let it go without eating for more than 24 hours without contacting anyone. She should have got zero back.

He could have won outright had he just said, "Look you can still have the puppy on the 10th, but its not completely weened off its mother yet. You'll have to bottle/syringe feed him everyday for a couple of weeks. Otherwise, it needs to stay with its mother a little longer." She could have won outright had she have just followed his instructions. He said the dog was weened, and to only feed it a certain type of dog food. She was too cheap to buy the small $10 bag of food and wanted to feed it whatever she already had. The puppy probably still woulda died, but it would not have been her fault. She also didn't do herself any favors by lying about feeding the puppy raw food when the vet said multiple times that she told her she did in fact feed him raw food. They're both assholes. They both had a hand in killing that pup. They both knew it was too early to take that pup away from its Mom and they both did it anyway. Plus they both up in the courtroom talkin over the judge, arguin, gettin sassy, she rollin her eyes, etc.

Right? I didn't intend for my doberman to stay on Victor. I like Purina pro better, nutrient wise. I still paid 60.00 for the bag so I could get through the first two weeks and wean him off. Little did I know he wasn't going to touch it... at all... I donated it. Lady told me she didn't have any money at all for dog food, so she really needed it. I love those days. I also love days when my dog doesn't slap the food out of the bowl.

I feed my dogs a raw diet and 5 weeks is too early. Their ph level in their stomach hasn’t dropped low enough to accept raw food and kill any salmonella or other stuff that they might get.

The plaintiff knows NOTHING about puppies because when she said, (At 3:00) well as long as the puppy isn't nursing then I will be fine', WHAT? of course the puppy should still be nursing and if it stayed with its mother it would be nursing well past 12 weeks. At 5 weeks old, she would have to have given it a puppy milk formula in a bottle, every few hours, AND kept it warm, so what's she talking about weening it off! What? And then she didn't realise it wasn't eating for a few days. WHAT? She should never be allowed to have a dog ever again. She was ignorant and He just wanted his money. They should both be ashamed of themselves. I hope someone calls animal control on both of them...

This is one of the best rulings I have seen from Judge Milian in a while. I feel like we’ve been seeing a lot of the same over and over again but this… She was on the nose with her decision. I think both of them were at fault and contributed to the death of this puppy but at the end of the day though I am willing to bet that the plaintiff was the main contributor to the puppy getting sick. I believe that the woman did feed her puppy small quantities of raw food like it stated in the limited vet notes that the judge received. This puppy was not old enough to leave its mother and was probably not even weaned yet. A puppy of this age probably has little to no immune system yet and if it was being fed a raw food diet then it would take very little raw food which is typically teaming with bacteria to cause an infection in its digestive system. Older dogs and older humans are able to process and digest this same bacteria with no problem because of their mature immune system but a puppy of this age is definitely not prepared to break down raw meat or bones of any type and it definitely cannot fight off even a couple bacteria on those raw foods.

The plaintiff should have been 100% responsible. Could the dog have lived after being sold? Yes! We don't know if he sold it too early if she didn't feed it what it she was supposed to!

I'm early. 😀 I would never have taken a puppy at 5 weeks old. If for some reason I had a puppy that young, and it was not eating for one day, I'd be looking for a solution. She waited until 6 days to take a puppy who wasn't eating to a vet? She starved the damn dog to death. And he's so money grubbing that he sent that puppy away before it was ready. This was a good decision. The judge was right they both killed that puppy.

So sad. I have shih tzu too and they are the most wonderful pets in the world. I got tears over the death of this pup. Never got to experience life. The joy of cuddles and warm blankets walk in the park. :’(

The puppy died because of something it ate that caused the gastrointestinal infection, not because it was sold too soon. True that if it was nursing, it wouldn't have gotten infected, but can't blame the defendant for letting it go after it was eating soft food.

Unfortunately, I also fell victim/idiot to getting a puppy too soon (if I can recall, he was 7 weeks at the time). It was my first time buying a dog and first time from someone off Craigslist. I was immature and very unknowledgeable. I trusted the “breeder” was right that the puppy was ready to leave it’s mom. But after day 2 of the puppy not eating, I immediately took him to the vet, in which the vet informed me he was a few weeks shy of being away from his mom, and gave him softened dog food which he immediately ate up like a starving hungry animal would. He also came to me with flees and worms which the breeder didn’t share. Mojo is now a healthy almost 10 year old (7/4/12 is his birthday) pug, who loves our family and everyone he meets, to pieces. Lesson learned and all I can say is, buyer beware of buying puppies from so called “breeders” off Craigslist. They are not all legitimate, as I can sense this “breeder” wasn’t. I agree, they both were culpable in this puppy’s demise. The defendant for releasing the puppy too soon and the plaintiff for not acting sooner and most likely giving the puppy raw food when it wasn’t ready. Shame on them and I hope they learned from this.

My daughter is a dog rescuer and has had abandoned newborn pups than she tube fed every 2 hrs. Threading a long, narrow tube into its stomach and introducing nutrients. She’s also fostered an abandoned, pregnant pit bull and then it’s pups. People are terrible to dogs.

This is tragic, I wish we could establish guidelines or require a test of proficiency for dog owners. No matter how it came about; she brought a 5 week old puppy home!! Than allowed the poor little one to starve to death. Absolute shame on him for being an incredibly irresponsible breeder, he shouldn’t be allowed to breed or even own dogs. 5 weeks? Even if the puppy had lives, it likely wouldve been sentence to lifelong behavior problems that no amount of training can put a stop to it I always recommend 12 weeks! There’s so many important behaviors they get to learn through mom and litter. It gives them a chance to learn dog body language, and be corrected by their mom. The 4-16 week mark is such an important stage in their development!

That so sad for the puppy. The defendant has no business being a breeder. He doesnt know how to care for animals and is doing it just for $. Both are dumb ...she knew it wasn't right and took the puppy anyway. She shouldn't have taken the dog and waited a few more weeks.

The plaintiff should’ve had more discernment to not take the dog before the 8 week mark. She has more than one dog of the same breed, so she should’ve known. The defendant should’ve known as well but he shouldn’t be breeding dogs.

i think they both contributed in killing the puppy but i think the plaintiff should be 100% responsible for the expenses associated with the puppy’s death. Why’d she take the dog in the first place, why didn’t she take the dog back to the mother, & why’d didn’t she make sure the puppy was eating ?? it was her puppy and she knew it was too young so i don’t see why she doesn’t have to pay the whole amount.

No, most likely the new owners are not as clueless as she is and did around-the-clock care for their puppies. Agree, both are responsible.

I got my puppy at 7 weeks but I visited the breeder and witnessed the puppy eating. Five weeks is definitely too early! My guy just turned 14 last month

Some dogs take even longer to wean fully. I had a dog who who took 12 weeks to fully wean so I had to wait to get them. I would NEVER get a dog that early.

He should not have sold the puppy so young, but she also should have not accepted it that young as she apparently knew already that it was too young, and also knew that she'd have to wean it off the existing diet. Why not insist she get a small bag of food? or insist the puppy stay longer? even if she had to pay for the first 6 week vacc, the pup should have stayed with Mother longer. She knew in advance.... that she was taking the puppy too young, and not keeping it on the same diet. she knew in advance, that it hadn't eaten in four days and had failed to take it to the vet. The deposit she had left would have secured the puppy for a further two weeks that it could have stayed with the breeder. I kind of believe him when he says she wanted to take it then and there and give it replacement milk, which is never as good as mothers milk. I also believe she was trying to feed the puppy small amounts of raw food, which is harder to digest than processed food. to me, she is far more to blame than the breeder.

Lessons: 1. Never buy a puppy from craigslist. Ever. No reputable breeder sells on craigslist. 2. Never take home a puppy that is less than 8 weeks of age. Ever. 3. If a really young puppy isn't eating, do not EVER wait 4 days until the puppy is already on death's doorstep to do something about it. Seek veterinary care immediately. 4. Raw food diets are not appropriate diets, especially for a 4 week old puppy.
