The U.S. Supreme Court heard oral arguments in a historic case Thursday to determine if Republican presidential front-runner Donald Trump is eligible to remain on the ballot for the 2024 election. The justices are reviewing a decision by Colorado's high court that found Section 3 of the 14th Amendment of the U.S. Constitution makes Trump ineligible to run for office because he engaged in an insurrection on January 6, 2021. _The Nation_'s justice correspondent Elie Mystal responds to the first day of proceedings, saying he was disappointed to hear both liberal and conservative justices casting doubt on the Constitution's application in this case to avoid the political ramifications of keeping Trump from office. "They decided to lock hands and ignore that because it would be too messy for the country to apply the law to Donald Trump," says Mystal, who also explains Trump's far-fetched plan to claim immunity from prosecution until after the presidential election, the scandal surrounding Fulton County District Attorney Fani Willis during Trump's prosecution in Georgia, and writer E. Jean Carroll's successful defamation suit against the former president.

This country is completely lost. We have zero leaders. Not one. Our country has been completely turned over to lobbyists and giant corporations. We can't even get a platform to file the taxes we owe the government for free. We've been paying to pay back what we owe our own government while other countries have done it for free for 30 years. 🤦🏽‍♂️🤢🤡

True that! I'm buried in IRS BS and all I'm trying to do is pay my taxes, but not over pay. Due to the ACA and some other issues, moving 3 times in 5 years, amending my tax returns back to 2017 and some OTHER BS, I am now paying more in penalties and interest than I owe in actual taxes. I've been to three tax agencies, including H&R Block, AND a private tax CPA, and I'm still screwed. I'm going to file for tax amnesty and if I don't win, I'm leaving this BULL$H!T country.

I would like to see a documentary that follows a member of Congress around for a month to see what perks come with their positions because I think there's an illusion of power but it must be the perks that come with these positions that makes them fight tooth and nail and often stoop to unethical behaviors. When they walk into the Capitol Grill for dinner, do employees there fall over themselves to treat them "extra special"? I know airlines have an unwritten policy of giving them complimentary upgrades to first class, even jumping ahead of everyone else on the paid upgrade list. It's so ingrained in the DCA gate agents, that I've seen them downgrade a paying first class passenger to coach just so they can put a Rep or Senator in First.

We do have a couple. Please, I don't know your particular politics, but I offer this. It takes money to get elected, and even more to get re-elected. Candidates and incumbents that accept corporate PAC monies are in the pockets of said "Generous contributors" on Day 1. Picture the "Lobbyist with his feet up on your desk, stack of your first day duties collated into priority stacks. "Get me a cup of coffee, and here's your gratuity check for coming to the common sense solution to support our cause. Get to work "! They are not YOUR representative. The few who do not accept that kind of contribution include Progressives, that wish to curtail the influence of the Almighty Dollar on our politics. That causes our induvidual power to meld into the pot of corporate power, influence over our "Duly elected representatives." The 1%, know the incompetence of these elected stooges and more recently, the 1% have run for or been appointed to cabinet positions, "To do the darned jobs ourselves, examples, Mnuchin, De Vos, Bloomberg (at least until he was sure Bernie was screwed). Progressives, it is in the name! Conservative, sounds like they arranged it the way they wanted it, and put a padlock on it to keep it that way! If all stays the same all will be well, BULL! Harsher and harsher methods are required when the facade is important. They are past all that and say, we do it in public, how can there be anything wrong about it. Right? Wrong!

Assuming Judge KJB - in querying Trump’s attorney - wasn't just testing the water, she appeared to side with Trump's attorney in the belief that because the 14th amendment didn’t name the President or VP, it didn’t consider the President or VP as being bound by this amendment. How about this alternative reasoning: executives (e.g. President & VP) hold “offices,” whereas legislators hold “seats”?

They did also touch on Jefferson Davis as a persona non gratis included in the scope of the intent (of the Amendment). There would be a record of contemporaneous notes from debates, discussions and the bearing on how a general election poll would come under the effect of the Amendment per its intent, some historical context regarding Reconstruction after the Civil War, Amnesty, and stuff. Under this scope, the meaning is inclusive argues the one side, and the other (Trump party) argues it does not. The judges just wanted to hear the rationales argued pro and con, for and against, whether anything knowable in the contextual intent survives within the Present Day that is germane to the scope of their arbitration.

Right. States wouldn't be kicking anyone off the ballot who number one was at least 35 years old. Number two was born in the United States. Number three who did not engage himself or himself in an insurrection! They would never prove that on someone like Joe Biden with all his faults, so I found the supreme Court argument so weak and I myself am a lay person! Thank you for this broadcast. My heart is broken.

Yea, just one problem. the analogy just dont work. First, being 35 or natural born citizen are issues the person themselves have the burden of proof showing. Its a question of qualifying, not being disqualified. Im sure the subtle difference will elude such an elite brain as you posses. Second, your two examples are able to be proven beyond doubt, simple birth cert. will prove both, whereas Insurrection by anyone other than a wartime event, cannot be proven beyond doubt, and in fact, where Trump committed insurrection or rebellion is not with no doubt, simply proven by the fact that there is such a debate about it.

Trump is a talking snake. He SAID he would be in the front lines with his insurrectionists, HAS provided aid and comfort to them and their supporters, disappeared for 2-3 hours that the insurrection was violently occurring, and while disappeared he did not employ the national guard or military to mow down the insurrectionists like he would have if they were culturally progressive liberals or anti-liberal communists (historically the only type of communists that have been able to gain significant political power).

It seems that the Supreme(ly corrupt) Court believes there is no behavior that disqualifies a person from attaining the OFFICE of the presidency, not even fomenting an armed insurrection designed to prevent the passing of the presidency to the next duly elected OFFICER. Note that age, country of birth and number of terms are not behaviors.

I think once it got to the supreme court it quit being a state matter and became a federal decision. The decision of if he is allowed on the ballot goes for all the states, if supreme court says he was responsible for insurrection he goes on no ballots.

I tend to agree, except that the SC couldn't make the determination that an individual committed insurrection per the intended meaning, that would likely be Congress and only after giving the accused individual some measure of due process

It did not determine yet, eg. does the Amendment proscribe the candidature from eligibility through disqualifications such as does automatically apply regardez Age, birth, citizenship, or allow a candidate to run for election then be dq'd at certification in Congress (not my recommendation), or does Congress pre-emptively vote to remove such disability upon review after the judgement of the courts (guilt or no guilt on the crime of Insurrection), or does the DoJ kick it back to Congress procedurally after SCotUS delivers a finding...

they are only deciding whether the state of CO is enabled to remove him from the ballot via CO law. it would set a precedent but it wouldn't determine what other states do

The use of the word “officer” is tricky. For instance, not every member of the military is an officer. Being an officer requires additional training/schooling. While I realize they aren’t referring to the military, it does prove that officer has multiple meanings and does not always refer to everyone within a particular group.

Nope. Long standing court precedent has defined officer of the US as those appointed to authority within the government rather than voted into it. On top of that, the 14th never barred anyone from running for office and gave Congress sole responsibility for allowing them to take office. 63 confederates held legislative seats post civil war. All that being said, the definition of officer of the us is probably the least relevant thing regarding the problems with the Colorado decision

As a Canadian, who understands how my country's Supreme Court works, I can't believe what I am seeing in the US. Elie Mystal is a brilliant voice. Garland's DOJ should have listened to him years ago about before the statutes of limitations ran out -- which they did.
