Kohberger's attorneys have accused the FBI of "hiding" some of the IGG evidence that led to PhD student being identified as a suspect in the murders of four University of Idaho students. Prosecutors have argued against turning over the evidence.

This was a waste of time. They could've handled this via briefs. They wouldve has to wait longer for the answer but dang, a total waste. He said he was closing it...early on. She's pushing it bc she KNOWS he will continue to say no.

Defense knows the prosecution has something, prosecution doesn't want to 'show their cards' so the defense is showing some but not all too because the prosection still hasn't budged on these 1 or 2 things - both they obviously can't discuss, and we don't know what or why they can't talk about it...only they are privy to it, making that part confusing on our end. Usually this stalling is because one side or the other doesn't want the other to target that something, so they want to keep it to themselves as a lever. In this case, maybe it's flimsy, maybe it would be easily picked apart (since defense would see 'it' in advance, prepping their arguments against it)...defense has claimed that something the state has is exonerating, this thing might be it. If it is, obviously the state would not want to hand it over at all costs. It would mean this case, their jobs...etc. If it's not this thing, then it might be just flimsy where the state would like to over leverage it or pivot on it in their other arguments.

When I look back on this I believe the judge ordered FBI to provide….. idk maybe I’m wrong? Maybe he just did this for the IGG intricacies. Imagine it would’ve made the most sense for AT to submit a subpoena last year but it’s a clown show so yeahhhhhh

There’s no backbone in this case. It’s like they’re talking to a camp counselor on what he’s gonna do when he gets home. This is a joke. The gag order is a complete joke that has only resulted in more rumors of stalking, etc. judge needs to get this going or be removed. He’s not making any decisions.

They could just as well been discussing what their weekend plans were...The judge needs to put his feet down and get things moving. It's bizarre a suspect murderer is sitting there, whilst they're having an almost jovial chat..

They need to hide the who and how on the information. The FBI cannot turn over everything because of informants and ongoing cases and investigations. But somehow this info is used against an accused without proof shown of the information. Fingers need to be pointed Judge Judge

Totally agree I was married to a lawyer for 25 yrs he also sat in as a judge many times and could make decisions effectively and easily this judge appears to be not seasoned or ready for this big a case! He takes the weeny way out it appears! He should be replaced IMHO

No, she wants to cherry pick what she feels is favorable to her client and allow it into the public but doesn't want anything damning released either. You can't have your cake and eat it too. The defense is who originally requested the gag order and now she's not happy with it. Ask yourself why she wants one hearing open to the public but agrees that others should be closed.

The state is making it so that he's got to prove his innocence rather than them having to prove his guilt. They've painted him as guilty and have made a biased public opinion of him and subsequently made a biased jury pool. So yes, these hearings should be public 100%.

In my unprofessional opinion, I think she was minding her own business. Went to bed late & scared. maybe drank or smoked that night who knows. Probably was in denial when she woke up … and/ or was afraid of what she might find. Let’s have some compassion people! This young woman is a witness & victim. You can’t even imagine the trauma she’ll sit with the rest of her life because she SURVIVED. when the odds are, she should have met her roommates same fate just for being in the house. Unfathomable

They explained in this hearing why exhibits are sealed: 1. There’s a joint motion to seal all exhibits 2. Judge Judge signed an order to have all exhibits attached to motions for either side sealed 3. Expediency - It saves both sides time to not go through & redact and proof-read each time to make sure they’re ready for public viewing 4. Judge Judge thinks too much evidence should not be released to the public bc it’s not trial time yet

@@Jelly-Garcia It is the public prosecuting defendents and the public has a right to know and to ensure the public is not prosecuted in the name of the public without knowing what for. That is to say justly based on credible evidence. As of right now there is not 1 piece of provable evidence, only the sketchy unreliable touch DNA - that's proven to wrongfully convict the innocent. Thus, the absence of evidence not only is reasonable doubt but indicative he's being railroaded. Further, the state's claim it delays and seals to ensure the defendent's right to a fair trial has no merit when the defendent claims the complete opposite.

I tried to be the whole ok "he's innocent until proven guilty" but the DNA...I know they say blood and hair are better DNA then touch DNA, but I still believe it will be his downfall. Who is so unlucky that they get set up by the cops and find a sheath with their DNA on it, under a dead body? 🤔 I think you'd stand a better chance at getting struck by lightning twice

I like the judges personality but I don’t think he is decisive enough to be a judge in this type of case. You cannot make both sides happy so he seems to grant the defense their motions to make sure the defendant gets his way. It’s awful and makes me sick to my stomach to watch this

To be fair judge you have to think critically and make decisions that could be beneficial or detrimental to either the defence or state. Judges are supposed to be balanced and unbiased, and anyone charged with a crime is in fact innocent until proven guilty.

Funny how BK wanted this gag order in the first place. It was the defense who asked judge Marshall for it. 2 hearings ago, Ann Taylor admitted it was the defense who fought and wanted the gag order. So now in this time, this gag order worked 100% in BK's favor.. creating tens of thousands of people fighting for BK's innocence.. NOW, Mrs.Taylor, wants the public to know everything. He'll NO lady.. this case should have been open from the beginning, not now. JUDGE SET THE TRIAL DATE... NO MORE GAMES.. SET IT FOR FEB 2025... Enough of Bryan's rights. Where are the 4 young, innocent people, who were horribly slaughtered in their own beds, RIGHTS at?

It doesn’t prevent them from talking about evidence. If you look at point 2 on the non-dissemination order it lists all the things that they MAY disclose. It’s basically all the things that ppl always claim they’re not allowed to disclose.

AT constantly changing the narrative… yuck. Accusing the state of withholding evidence/discovery… I saw it - she straight said at a previous hearing it wasn’t the state/prosecution withholding anything; she didn’t believe they had received it from the FBI yet either! She’s a liar defending a waste of O2 who took the lives of four beautiful kids. Accusing the prosecution of being inconsistent - she’s a hypocrite! She previously admitted the defense fought for the gag order. Now it’s benefitted her client she wants everything public? 😂 Accusing the prosecution of wasting time… iirc the state said they’d be ready to go to trial by this summer (2024) - but AT has “so much discovery” and “so many witnesses to interview” she is nervous about even setting a date in summer 2025. She is a ridiculous hypocrite!!! “Bryan is innocent!” Yeah, sure he is lady 🙄 make that a ridiculous hypocrite and a bad liar!!!

I don't like the underlying tone to Ann's tone of voice towards Judge Judge. She has no respect for the courts decisions. She also interuptss the Judge every time he tries to take a breath.
