Chretien correct he was arrested by a cop having a power trip over the fact that a citizen (who was acting lawfully, by requesting a ride home and not driving drunk) didnt want to answer his questions. Shane Campbell that’s funny because he wasn’t charged with public intox because he was arguing in public, he was charged with public intox because he was about to go drive off in his car. You actually think someone can be arrested for walking around drunk and arguing on the phone? I’d hate to live in your neighborhood you probably sit in your window calling the cops on the neighbor kids for riding their bikes in the road.

Facts. Lmao, no it isn’t. “Public intoxication charges, often called being "drunk and disorderly," is a legal charge alleging that a person is visibly drunk or under the influence of drugs in public. It is usually a misdemeanor crime under state and local law. Public intoxication laws exist to prevent people from disturbing others in public and to remove people who appear to be unable to stop themselves from hurting themselves or others.” Let’s say that again, *a legal charge alleging someone is visibly drunk* and *Public intoxication laws exist to prevent people from hurting themselves or others* The cop literally stated that he talked to his wife and that it would have gotten physical, and he was, in fact, visibly drunk.

When they get involved in domestic disputes... Cops actually take courses for dealing with this stuff.. They're first on the scene..."first responders"...and they have to defuse the situation before it gets out of hand... Same thing as a medical emergency...cops have to know first aid...stop the bleeding until EMS gets there...

Like he said his girl was coming to pick him up. Clearly the cop had his ego affected because the guy doesn’t have to answer his questions. By that logic a tired drive can wipe out yours as well. Even an elderly folk driving down the wrong way which is quiet common as well. I’m not condoning drunk driving btw....

I thought this dude handled the cop appropriately but if you notice the cop got his pride hurt because he wouldn't obey the officer and answer his possible incriminating questions he went ahead and took him to jail for a trumped up charge. Not even sure if he gave him a field sobriety or a breathalyzer.

Preventive policing? So invoking the 5th amendment is "not cooperating" and being drunk without driving and calling someone to pick you up is public intoxication so he will go to jail for "preventive policing" This is why people are starting to not call police. The 5th amendment only applies if you are under arrest and if the cop is going to ask you something that might incriminate yourself. Asking somebody what they are doing or whatever the case may be is a factor in what investigation may lead to like an arrest.

@Gundam sandrock Regardless, by not admitting to the officer that he was intoxicated it gives your lawyer a lot more leverage in court. The failure to comply by refusing to answer the officers question would not apply here as that is protected by your fifth amendment right. If he would have admitted everything, the court would have used his own words against him and the public intoxication charge would stick.

I mean obviously you have a right to remain silent, but at the same time it’s also just perceived as disrespectful by some cops. Obviously not all cops thing the same, and some probably think it’s rude to basically ignore their questions and refuse to talk because they don’t immediately assume that you’re drunk they want to hear what you have to say.

Cooperated or not, there are laws to abide by under the constitution. Just because you aren't "nice" to the police officer doesn't mean the law will be bent to your favor. Look how it works. You Don’t cooperate which is LEGAL because no CRIME was committed. No test were performed, he never said how much he drank. A SIMPLE public intoxication is not SIMPLE when you want to get hired. He was not disorderly. That’s why he wasn’t in cuffs really ever!!!

I am not sure of what counts as public intoxication in the US, given that I live in Europe, but I believe that the cop is being a little silly, the guy was pretty much coherent throughout the entire conversation and was pretty aware of his rights and what he said, I think that this cop is abusing his power a little
