CA v. Robert Durst Murder Trial - Murder of Friend Susan Berman
Witness:
Robert Durst stands trial for the 2000 murder of friend Susan Berman. The trial began just before the pandemic in early 2020 and was halted two weeks in. The restart happened May 17, 2021, with the same jury panel.
The defendant’s wife Kathleen McCormack Durst went missing in 1982. Evidence and testimony would show that Robert Durst killed her, the prosecutor said. The defendant allegedly told Berman it was an accident and asked her for help. She served as his alibi.
Berman, 55, was shot execution-style at her Beverly Hills home in 2000, and the prosecution suggested that it was because of what she knew about Kathleen’s death and disappearance. As defense lawyer Dick DeGuerin would have it, however, Durst is innocent. His client only came across the body, panicked, and fled, he maintained.

Section 767 - Permissibility of leading questions (a) Except under special circumstances where the interests of justice otherwise require: (1) A leading question may not be asked of a witness on direct or redirect examination. (2) A leading question may be asked of a witness on cross-examination or recross-examination. (b) The court may, in the interests of justice permit a leading question to be asked of a child under 10 years of age or a dependent person with a substantial cognitive impairment in a case involving a prosecution under Section 273a, 273d, 288.5, 368, or any of the acts described in Section 11165.1 or 11165.2 of the Penal Code. Ca. Evid. Code § 767 Amended by Stats 2004 ch 823 (AB 20),s 5, eff. 1/1/2005

“ The exception stated at the beginning of the section continues the present law that permits leading questions on direct examination where there is little danger of improper suggestion or where such questions are necessary to obtain relevant evidence. This would permit leading questions on direct examination for preliminary matters, refreshing recollection, and examining handicapped witnesses, expert witnesses, and hostile witnesses.” So basically this is the states witness on direct but he’s a hostile/adverse witness which allows Lewin to use leading questions as an exception to this rule

Lewan is about 10 times as annoying as DeGuerin with his over-dramatic and over-acting antics. I absolutely love how Oliver is wearing Lewan down and playing stupid at the same time.

@@perryjohnson8213 I’m not through the entire video yet but my impression of the the 3+ hours of testimony from this witness is that it definitely isn’t helping the defense. The prosecutor is truly annoying but this witness is absolutely the most ridiculous & frustrating witness I’ve ever heard testify in my entire life. (And that’s out of thousands) The jury won’t believe a single word out of his mouth. That said, IMO, Lewin went on WAY too long. He sure likes to grandstand.

In his mind, Kathie was nothing. They are superiors, they deem us just a temporary guests in their lives. I meet this kind of persons every day. Nothing could them be emphatic and correct. They do all the time calculations in their mind in favour of their benefit. He has any interest to say the truth since he eat a sweet bread from the Durst corporation. I served on a jury and the judge was listening to a Red Sox game during it. I could hear his radio from where I sat. He actually gave us the score once.
