I have an idea about squatters..... as soon as a property is vacant, landlord should be able to register the property with the local police, declaring that no valid lease exists on the property. Preemptive action against potential squatters. When police show up, they would have valid reason to remove the trespassers.

Yep, more info in Penal Code § 602. Make sure to put up lots of "no trespassing" signs.

What about unicorperated areas like East Los Angeles 90022? I believe its county unincorporated. We don't apply to rent control right?

It is illegal to take your property back, but it is not illegal to not pay your rent.. California is done for small mom and pop's

Not illegal to take your property back, just need to follow the law to do it. But yes, being a California landlord is not for the faint of heart!

There are so so many tenant cases in Encinitas , Carlsbad, Cardiff S.D. of landlords never claiming exemption and just giving 30 day notice to tenants. That "power " still exists. There has to be a way to educate or advertise court cases where landlords get in trouble for this behavior.

That power does still exist for some landlords depending on when the renter signed the lease and whether they received any renewals since then.

Hi, can you help me?, I got serve with 90 days eviction notice 3 times before this 2 in may 8 and may 15 2024 in the same month, total of 5 eviction notice it would be nice if you can respond to me about this problem thank you

You might be able to make a case for harassment, reach out to a local legal aid attorney.

Hello Chris and panel, I was able to see the video after Hurs and I got the answer I was looking for, looks like the issue with my month-to-month exempt condominium rental unit could be solved if I just issue a 60-day advance notice of termination. Thank you, these videos are awesome!

Right. As long as you put the exemption wording in the lease. If they have been there over a year it's 60 days. Under a year 30 days.

my dads house sat vacant for over a year LA county while going through probate,,,I was so scared sqatters would come....since i live in OC I could not be there everyday...so the neighbors were great...one parked his extra truck in the drive way, the other neighbor mowed the front lawn for me, one neighbor walked the backyard to check no one back there. plus I left all lights on inside....I lucked out....and sold the house ASAP after probate

@@WIREassociates yes everyone liked him. plus they were helping me out...and did not want the property to look abandoned most of the people there had been there like 40 years like my dad,,,I lost sleep worring about if scatters would come. sold the property on the first open house...all cash buyer in 2022

Hi Christian, I would like to see more eviction hour like this. Also want to know more about tenancy at will. We were helping out a family friend who fell on hard times and had him live in our Corona, Riverside home rent-free. Then he brought one kid over, then his 2 other kids to live in our home without us knowing. He refuses to leave. What can we do?

Hi there guys, im watching the video, not sure if its live or not but i have a question. I live in San Diego. It was march of 2021 and we had the covid-19 eviction moratorium still active. I was living at a residence inn. I was about to start a new job but the work got canceled due to we later called the Omicron wave of covid infections. For this reason i had applied for rental assistance with the San Diego Housing Comission (SDHC). This isall relevant to the question i ask now. On a friday march 25 2021 i was evicted by my landlord for being late on my rent payment for just one week, one week. My rental assistance application was being reviewed by SDHC and my landlord was aware i had this going on. On my eviction i had my locks changed and all my property got locked in my unit and i was only able to retrieve it two days later on the next monday. Also, that eviction made me lose $5400 in rental assistance (SDHC denied my request stating i moved away from the unit, this is absolutely incorrect). What can i do about this?

Hi Dan, sorry to hear that you went through this! Is the landlord still trying to go after you for the back rent? If so, I would definitely use this to defend yourself against having to pay it all back...

@@WIREassociates Not really, but i feel i need to seek compensation for what he did. The eviction shouldn't have happened. I later learned that landlords arent allowed to change the lock on eviction and he did it as well. I need to find a lawyer to help me seek justice for the abuse he did to me.

Your a perfect example of all the shenanigans going on. You need to take them to court. As long as you have good documentation a lawyer should be able to point you in the right direction. I would like info for these lawyers today as well.

Great info! My lanlord filed an unexcuted lease for an eviction. I sent him the signed lease renewal. I have a copy. He wanted me to leave for unknown circumstances. His 60 day notice said, no fault just cause for demolish and remodel but his fictitious estimate for plumbing said, 23 days work for repiping no permit listed. I'm trying to prepare for trial. My lease expires 3/31/24. I moved out 1/31/24 He wants relocation reimbursed He withheld my security for cleaning

Wait for court. Stick to the law. As long as you have Receipts your good. 23 days is not 30 days. Read the law and then read it again. You will start to understand it. Good luck.

Haha! 😂 Hey, be nice! It's a few different things: 3 guests is a lot so they're not sure who wants to answer, it's their first live (it's tougher than it looks), they are being thoughtful in answering, and I need to do a better job of picking someone to answer.

why are we still so behind the times? if you text AND email a notice to raise rent, AND the tenant responds, that is insufficient notice. if you first class mail, you don't know if the tenant even received the notice. They can say they did not receive it. Email and text have paper trails. This is so backasswards. I send tenants documents through docusign, which uses email. So electronic notices being unacceptable is absurd.

It's true. And DocuSign is legally binding, but still not valid for delivering notices. BTW, even if not required, Registered Mail is good way to mail notices. There's a tracking number, but they don't have to sign for it, like certified.

Attorneys have not figured out how to advise their clients and potential clients on best practices and not to be so unhelpful when a squatter has taken possession. I suggest creating a digital guidebook. I’ve been on both sides of the problem and disappointed with most of the U/D specialist firms. I’ve been dealing with landlord/tenant matters since before any of the attorneys here were born.

Ya, I have found that as well. Once I started reading the law I started to figure it out. Everyone is still stuck in 2018 ,no one wants to change. Unfortunately everything has changed. But if landlords would do a proper lease, and obey the rules they can maintain an upper hand.
