The plaintiff says he rented a four-bedroom apartment from the defendant, but it was infested with bugs and she refused to hire an exterminator. He stopped paying rent, put the money in escrow, and moved out. He’s suing for his security deposit. The defendant says the plaintiff complained but never let the handyman in to fix anything. She’s countersuing for unpaid rent.

idk considering how many times shes said "You only have to prove that it was more likely than not" you'd think the plaintiff would have been awarded for damages. considering that the place was so bad it was literally deemed uninhabitable, it wouldn't be a stretch to assume any mattresses in there would get damaged.

I don’t agree with the way that JM seemed to be dismissing and diminishing the plaintiff’s experience. She keeps saying *”You got to live there rent-free”* but she’s ignoring the fact that the man says he had bedbugs, roaches, heating issues, water issues, etc. Would SHE consider living anywhere under those circumstances to be fully compensable by not paying rent, and therefore, she need not complain? Also, if the place was actually found to have bedbugs, then *of course* he would have gotten rid of some items…I know I would have, and since he didn’t have proof of the actual amount of loss, she should’ve done a bit of a that “rough justice”, and awarded him *something!* Preponderance of evidence? 🤷🏽‍♀️

Judge Milian explained in the "After the Verdict" segment with her husband that he was given an award by not having to pay rent elsewhere. He had a choice, move out earlier into an apartment that was not infested and pay rent, or stay where it was inhabitable for 5 months and not pay rent. He made his choice, so he already benefitted.

JM was having a really bad day. Living in a place for 3 months with no heat and no cold water is ridiculous. He was willing to pay her as long as she fixed the issues. He wasn't getting over on anyone. And the judge should know plenty about bedbugs and how hard it is to get rid of them. I wouldn't have taken the furniture either. She was just upset about something else and showed her emotions through this case.

Because he had no proof of his damaged furniture, it was explained that his "compensation" was the fact he didn't pay rent while staying at the place FOR MONTHS. Yes the place was gross AF, but he *stayed there*. Having to ditch his furniture was the price he paid for - ideally - saving up money that would have gone to rent. Did you not watch the ending where she discussed the case with her husband??

There was literally no proof of bedbugs or fleas and no proof anything was damaged or discarded and judges deal in proof. It was already explained in the case.

He was rude as all get out trying to railroad the judge and speak over her. He wouldn't even answer her questions. She doesn't need the filler, yes or no and move on.

Smh 😔 so disappointed with the judge for the way he handle this. The guy had a video of the flees like wtf if the previous judge deemed it uninhabitable then how tf you don't think that his stuff will be ruined.

@@hillaryconsultingservices Iwas just about to say this. Judge Millian has shown a few times how nasty she might be. First, she expected the lady to wash white towels she used to clean sewage back up in her bathroom (no compensation), then she couldn't understand why a man would leave his property from a flea infestation and refused to compensate him, and then there was another case that had me confused. I would never eat her food at the company pot-luck!!!

The disgusting defendant literally had that man living in a rundown barely habitable shack because she knew it was what he could afford. She didn’t care about anything, and the judge clearly found the place uninhabitable. The Plaintiff should’ve got the security, but also the fees. Milian can be so tight on the People’s Court wallet sometimes. Also, they really need to get back into the courtroom. They can barely hear each other and the delay makes it hard for them to communicate without talking over each other. That’s getting annoying quickly, not just to them, but also to us watching them interrupt each other.

Yes and the judge never seems to comprehend or take into consideration the fact that there will be lagging or a delay in the connection but yet she always seem to say “ok stop talking!” She sure is moody half the time.

It makes me curious if she feels like she needs to be a bit more like JJ now that her long running show has ended. I also agree about getting back in the courtroom. The restrictions have been lifted in most places and lots of other live shows have started back up. I always think it’s weird when she gets snappy with them because I live where there’s bad internet and phone connections and know how delays and cutting out can happen.

I agree. And by looking at the landlords appearance w the hair towel on her head shows she has an "I don't care attitude" because even though it's on the remote system, it's still court & that isn't court appropriate. Plus the background of wherever she's online, is terrible. She knows she's a slum lord. And the Judge knew it was unlivable so she should know his belongings would be unusable. He was only asking for $400, she should've given him that.

The judge is so disrespectful to the plaintiff, she accuses him of talking over her, but in fact she keeps shouting over him, and where does she get off accusing him of living there 'rent free' when the place was infested and considered 'uninhabitable by the courts. And it goes without saying that when a place is 'infested' you throw all bedding away, would the judge use her same bedding after it has been infested. I'm sure if the plaintiff had been a different colour she might have been more understanding and awarded him damages...

They really need to get back to doing the cases live. Trying to do them over video-conference creates a delay, and issues with communication. They’re talking over each other, not knowing when to stop, and not knowing when to answer because of the delay from the webcam and the fact that they aren’t in the same and can’t see other live. I mean it’s cool, but it’s kinda contributing to making the communication messy and more abrasive than it needs to be.

The plaintiff is a youth development specialist in Syracuse NY. He was on the show another time. I think it was regarding a used car sale. I remember him, but not the case. It will come to me. In this case, Marilyn was very rude to him. No surprise there.

Everyone is mad at the judge for not awarding the case to the Plaintiff; but he had no physical proof of the damages to his furniture Edit: and the judge explained all the way at the end that because the guy wasn't paying rent while still living in the gross apartment - THAT'S his compensation

I see many comments slamming the judge for not letting the litigants finish sentences...come on now, the judge is asking direct questions and the litigants keep talking like they don't hear her....is it a technical issue or just both of them trying to lay out as much information even though the judge doesn't need to hear it?

I think those complainers don’t understand how court or life work. Someone in a leadership position asks for information and you are supposed to give that information, not talk about what you want or give the speech you practiced. Plus, I think there may be some unconscious bias in these complainers.

Plaintiff says that he had to have someone at his place 24/7 because there were no locks. Then he said the handyman felt uncomfortable working at his apartment when no one was there. What happened to whoever was sitting there in place of installing a lock?

That's why i always ask about bug's before moving in even if the place had bugs year's before but clean now i still wouldn't move in I have a huge phobia to roaches and don't take any chances once they're in those walls they're there forever no matter how many times you exterminate

I've been renting for 15 years. Dealt with a roach problem once; I'm forever phobic "lol" - the landlord wasn't doing sh*t, the exterminator barely helped, so I bought construction foam and filled EVERY space and crack... Never saw a roach again for the rest of the lease

These zoom cases frustrate me. Not because of quality of the video or anything like that. Thank u for the uploads. Over the computer there can be a delay. So it may take the plantiff and defendant an extra second to even hear a question or hear that the judge started talking. Then she is telling them to stop talking. Then just a bunch of her yelling stop talking and them still talking

Agreed. In Syracuse, you can kill people by shutting off heat in winter. I lived there for years. It's definitely illegal to shut off anyone's heat for any reason.

It's wild to me she states he was ordered out by a judge. He was *allowed* out because it was uninhabitable. They were both annoying with how they wanted to stick to their stories instead of just answering questions, but judge really didn't handle this properly imo. She was pretty rude. I don't understand why she wouldn't award him for his things, either. Bedbugs alone are a nightmare to get rid of, plus fleas?? Some people throw away all of their furniture after dealing with bedbugs for a while.

Neither one of these people could answer a straight question. Every answer he gave started off with "ok so" and then he proceeds to give her more background instead of answering. The defendant was no better, she kept just trying to get her story out as well instead of answering.

I feel that the judge was racist in how she treated the plaintiff. No one else will say it but I will. She had no excuse repeatedly interrupting and yelling. In addition, she has done enough of these cases that even given she is privileged she should know by now that bed bugs ruin mattresses. Very disappointed in her.

If the renter/court says a place is uninhabitable then the tenant should have to be out in 5 days. Not a month or more. If it was so bad why did he not move immediately???? No he didn't pay rent for 6 months and that's ok? No. She should have gotten rent since he stayed and lived there. Ridiculous tenants know what and how to play the system

How did he testify first thing saying that the place had no locks and that he had to have someone there 24/7, then he used the excuse that the handyman was unable to fix anything because "he's a working man" and no one was there to let the handyman in everytime he came by..... uuuuhhhh, which one is it??

Yall forget roaches are common pests depending where you live, it doesnt make it inhabitable or slummy.. #1 , #2 bedbugs can legit come from anywhere places like NYC have them even in bougie hotels, too many damn buildings and ppl in one area i guess. So you can’t claim damages on that.

When someone asks you a question, just give them the answer and ONLY the answer. The plaintiff tries to complain about something and then talks about 4 or 5 unrelated things. She's trying to drive the train in a straight line and doesn't need to be clouded with a bunch of useless information. She'll get to it when she gets to it

Oy! Another litigant who uses only pronouns. "On eleven nineteen he went to his house but he would not let him in." People don't seem to have names to such litigants.

Hmm well he's getting the 800 and I get she would've given him the 400 if he had photos or sum kind of proof of wat was damaged. Reading these comments fig it'd have been her going off on him but. Really just seemed like her being her and was trying to get to the point only time she really got upset was when he was over talking her. And she even said he kept his money he would've spent on rent so yeah I understand her judgement on that.
