She’s friends with his ex girlfriend, Stephanie. She invited Stephanie over and left Stephanie in his house with some man she’d never seen before. She told Stephanie to stay until she got off of work because Stephanie didn’t have a key to lock the door. When she came home Stephanie, the man, the televisions, computer, jewelry, and debit card was gone. Whose fault is it? It’s the defendants. She left her friend there and they burglarized the house.

I had a similar issue with a friend of an ex college roommate. She would come over while my roommate was in class wanting to wait for her. The thing is she would still be there when I needed to leave for my class and before my roommate was back. I let her stay to wait because she lived far from campus and didn’t have a vehicle. Her parents dropped her off. Then our stuff started coming up missing. Money. Jewelry. We couldn’t prove it was her because we had other people come around but we never had a problem until I started leaving her alone. We told her she couldn’t be there anymore unless one of us was there. If we need to leave then you’ve got to go too.

He is making a solid argument. He didn't give Stephanie access, the tenant did thus Stephanie was her guest not his, regardless of their prior relationship. The defendant had care and custody of his property

I can see the plaintiff's logic here. If the defendant was left in charge of the apartment, and then she invited the ex gf and some other man, while she is going to work, the defendant is liable for anything that has happened! It's like when a babysitter goes out to party while kids at home doing god knows what, the babysitter is responsible.

Even if the defendant didn’t take his things and Stephanie did, she is still responsible. She allowed Stephanie and her boyfriend into the apartment as guests while he wasn’t there. He’s right, she’s a tenant and the only one with the key at the time. It happened on her watch.

I'm really surprised that Judge Judy didn't pick up on two really glaring things: 1. The first time Judge Judy asked what happened to his property, the defendant didn't say ANYTHING about Stephanie, she tried to blame it on Savion, saying he also had a key to the apartment. The second time she asked, all of a sudden, Stephanie is in the mix. 2. The plaintiff said he got in touch with the defendant after getting out of jail THROUGH Stephanie, so it's clear the defendant and Stephanie are in close contact. The plaintiff dated this Stephanie person YEARS ago, but she gained access to his house through the defendant and had no permission to be there. Whether she took the property or the defendant did, it would still be the defendant's fault. P.S. I'm surprised this plaintiff is only a UPS driver. He's incredibly intelligent and well spoken. Not many plaintiffs would know to ask for "latitude." He's having some trouble being succinct, but I think that's just because he's trying to share all relevant information.
