If Superman enters the public domain, it's going to feel like a game as a service. Every other year, new characters are unlocked, and new abilities are being added.

Alot of companies in the past were given extensions by Congress in the late twentieth century. Long story short, I think Disney and other studios being partisan is why SteamBoat Willy was not renewed.

@@Brakdayton yes. theres already a steamboat mickey horror game i belive coming out soon. might me an animated cgi cartoon, but i think its a game. and its only the SteamBoat Mickey version and not the other stuff that has come after. Just the version in the first cartoon the character was introduced. Just like When Batman gets put into the Public Domain. It will be for his first appearance where he had the purple gloves and not the mordern streamlined version. It's the same as Dracula or Frankenstein. Anyone can make movies or cartoons with those characters because the books have been in the public domain for years. You just cant make them exactly like the Universal Movie monster movies. those are trade marked. So the version of Superman people will be able to use is the one out of the first comic he was in... the one with the black logo where superman doesnt fly, his earth parents are both dead, no one knows his secret. No Kryptonite, No Lex Luthor, No Lois Lane. Superman cant fly.

In 2033 the 1938 version of Superman goes into public domain. And the 1938 version couldn't even fly.

Technically 2034, as it only goes into effect at midnight on new year. But indeed, flying will be off limits for a little while. Not long, though. There was one comic where he flew pretty early on because an artist misinterpreted the instructions. He wasn't officially able to fly, but the existence of that comic makes the idea public domain when that specific comic's copyright expires. Or so it could at least be argued in court with a reasonable expectation of winning if you've got a good lawyer and a reasonable judge. But there are a lot of things that will be off limits for much longer. LexCorp, for example. Smallville, also. The first names of Jonathan and Martha Kent. Most major villains. Stuff like that. There are some things you might be able to sneak by as fair use if you're approaching it as a parody (which is already the case, as we've seen with so many unaffiliated Superman spoofs and deconstructions), but a straight adaptation would have to stick to pulling from early comics (and eventually the radio series when those copyrights expire, and so on). Any established later version of the crest should also be avoided. There are also trademarks to consider, in the contexts in which they apply (which would mostly be outside of story, in titles, merch, etc). The smart approach would be serial. Start it out basic (he's unusually strong and can jump high and run faster than a bullet) and don't mention any of the things that came in later, but then year by year bring in more elements as they become available. Structure the story around when copyrights expire and fill in the gaps with fresh ideas and redesigns.

There’s still elements of Superman that have become “foundational” that weren’t there in the beginning. Plenty of aspects people want are still copyrighted come time for public domain

Apparently you don't get it either lol. Also, it's in 2034 or something, honestly, that's an honest mistake but whatever lol. It it's gotta be that first ever version of Superman, that means, no Kyrptonian stuff I think, no flying, none of that. And DC had trademarked the Superman S and Batman Bat logo, so, people won't be able to use those lol. Hell, that was a big thing a while ago this year or late last year lol. So, it's like, yeaaaaa, you can, but there's no point in it. And there's already a killer Superman movie. It's called Brightburn which was produced by James Gunn I think lol.

so what exactly is allowed vs not allowed? because some of this falls under copyright, but doesnt some fall under the trademark also? and it seems like there are little technicalities, like Superman in the begining run fast, jump far maybe not "flying" yet, maybe no heat vision, freeze breath etc...like things were added over the years either for reader pleasure (or because of behind the sceens planning for this copyright stuff)..like you can only use the likeness of back in 1939 or whichever, but not the way he currently is?

I have suspected for a while now that the real reason DC and Marvel are obsessed with doing race swaps, gender swaps and young characters taking up the mantle of classic heroes and villains is because they're worried about the original versions becoming public domain.

No it's a dumb move because your only allowed to adapt anything that has entered public domain. Meaning you can't adapt many characters and storyline as it is simply not under public domain. You can't use superman powers like superman can't fly or use heat vision. You if you want to use a character like doomsday you will have to make some parody of doomsday. Simply put you are very restricted in what type of superman movie you can make. If you decide to write a superman movie you are walking on eggshells. Because wb/dc will be meticulously going through your film to make sure you didn't adapt something that is still under copyright and if they do find it they will sue you. That's why it's safer to do a Winnie the poo horror story because they don't have to worry about tip toeing on the copyright

I'm working on the concept for a "Superman" like superhero who works with other superheroes in a "Justice League" like team setting and on his own. The characters are racially, ethnically, and culturally diverse and representative of contemporary American society. The good guys will no doubt be good, moral people. The bad guys will be bad, evil doers. And, there will also be some gray characters. But, my protagonists & storylines will definitely be guided by our good guys acting with moral authority and clarity. It will be basic stories about Good vs Evil!!!

All classic comic characters should be public domain already. The creators of Batman, Superman and Spider-Man are all dead. Corporations should not own exclusivity to those characters. Not on the page nor on the screen.

No, that’s not how it works. It’s 100 years after the original creator dies, not after creation, Jerry Siegel, the last of the two creators to die did so in 1996, meaning Superman won’t enter the public domain until 2096, long after you are dead Armin. Also if it was 100 years after creation it still would be 2038 which is more than 10 years away.

*Shamanspointofview* Aight 😒🙈 I'm tired of explaining this to people who think they're comic fans. Uhh Zack Snyder took aspects from John Byrnes Man of steel comic books in the late 80s. In that book Superman murders zod and his crew exposing them to rays of kryptonight while they begged him for mercy. Superman cried and said he was sorry. In MOS the movie Zack makes him have to chose between his life and a family. Zod dies in both interpretations but differently. That is Zacks interpretation. They weren't the same but Zacks was more heroic. The fact that you say his Superman is dark means that its his own version but really you misinterpreted it. Donner showed you a troubled teen who struggles with keeping his abilities secret from his classmates and then he finds the fortress of solitude, then the scene fades to when he's a fully developed man bright and optimistic. The comics followed suit of that rehashing the same story. But Zacks man of steel shows what happened in-between the time of his unruly teenage adolescents. It didn't fade to when he was grown, bright and happy. It answered the question. What did he do at the farm with his mother after his father died, how did he integrate in society?? How many jobs did he have to take or quite when his cover was blown, what was it that that convinced him to be Superman. Zacks Superman was leading up to the bright Superman in the 80s MOS comics. Zack showed you everything Donner or the comics books did not. The studio didn't allow him to cook and fans like you trope falsehoods.
