Marie Smith he's trying to confuse the jury in hopes they disregard the prosecution's points. I hope this jury see's through the defense strategy, because at this point he is looking quite guilty.

If you have noted, that was simply a response to a prosecutor, who cannot state clearly that these are (as defense put it) "in chronological, but not, in the strictest sense, in sequential order" ( 54:40 ) Imagine if the defense would do something like this.

I doubt if the defense attorney is on the attack at this time...All he (def atty) did was narrating the time line on the pages...He should have attack the nature and ntegrity of the coded messages.

He just lost the Witness and me too! lol! To many numbers and no information. The judge should have stopped him! My head started hurting because it was redundant and a waste of my time! I know that the jurors are over there snoring 😴

He's a divorce lawyer. He's not experienced in cases like this and it shows. I'm sure he tries his best but it's not much when he's against two state attorneys with loads of experience and are smashing it.

I don't understand why people have any issues with this witness, I feel his role was critical in resolving this case. He seems genuine and terrified. I've been on the stand, and I was shaking like a leaf the entire time.

I have a feeling that the viewers here aren't the only ones annoyed by this defence attorney. The prosecutor looks really annoyed at times with his objections. It's like he's making them just to try to throw her off her game. I'm waiting for her to say something along the lines of, "I was practicing law when you were still in nappies!"

Defense attorney is wasting time...he made his point within the first 3 or 4 entries. He could have said ....would you please look through the rest of the document and see if there are significant gaps of time throughout this document.

Some people excel behind the scenes but freeze in the spotlight. Miss Van Waus is confident on the stand but this poor guy is overwhelmed. Doesn’t mean he’s incompetent just nervous. Practice makes perfect. I’m sure I’d be like a deer in the headlights up there but am super confident behind my screen with my keyboard hidden in the shadows!!! Defence is making a point of correspondence discrepancies but WHY have a burner ph & clandestine conversations!!!They’re loading the gun to pull the trigger on their own client!!!

Did you see the 54 video trial on NELSON? I watched that one for ten days and the very last hour they did not give the sentencing. lol I think all my hair turned gray and ready to fall out from the boredom throughout that trial. I bet this one is going to be a doozy. I think I will speed it up a little if it gets too monotonous. lol

Agreed. Both for use during the testimony and for review during deliberations. If the jury wants to see this evidence it will be like looking for needles in a haystack unless the prosecutor lists the text messages separately or highlights them on the zillion page Cellbrite report.

BTW Mark Sievers waived his right to a capital case ( death penalty) qualified attorney in a hearing . He fought to keep THIS attorney.

MYGirlsGJ B He waived the right to appeal for ineffective counsel. There is a video with the hearing in which Mark fought to keep THIS lawyer even though he is NOT qualified for death penalty cases .

This guy’s police interrogation is so disturbing and sickening and embarrassing it’s unbelievable. Watch it if you have the stomach. Just be ready to roll your eyes and say oh my god in disgust every 10 seconds for about three hours.

I don’t think he is a great witness but also prosecution should have made better exhibits. They should have had overheads with the text messages on it. Also prepped him that they were going to ask what exactly celebrite(spelling) is in laymen’s terms. I’ve seen it described really well in other trials.
