That marwaadi in your example has done wrong by availing ITC without receiving the goods and using the same is not allowed. Moreover, if he is caught by authorities, then he has to pay back the ITC with interest and penalty. So this method is ver risky. Similarly, depreciation under income tax will also be disallowed and so income tax benefit availed will have to pay back with interest.
