I have an old japanese Jujitsu book and this technique is called Ashi Kubi Gatame. He didn't invent it. Nice that he brought it to MMA though.

Funnilyf, funnily enough, in a professional fight against a muay thai fighter he missed a high kick on purpose to land on the floor and bait a kick to the face, which obviosuly failed like others before and became yet another submission.

Seems like but nope, go watch professional strikers try that and see it fail again and again as they get submitted. It's even a bait, some pros noticed last second and tried to advert the kick but then it was too late to not get submitted.
