To qualify for TDIU is having either one disability at 60% or higher, or having multiple disabilities that equal 70% with one disability at 40%. This is just the regulations for qualifying, there are a few more but I am talking about the ones that I know. Anyway, when you apply for TDIU, you can select one disability, which does not need to be the highest rated, it just has to be reasonable to show that your one disability is causing you to be unemployable. A quick example is you are a landscaper, construction worker, laborer, and you have a SC back condition or knee condition at 10% or 20% and this impacts your ability to work, then you may qualify for TDIU under that disability. Then you also have a mental condition at 70%, you then will be able to qualify for TDIU with SMC-S or also known as housebound for additional money. This is just an example, every situation is different, but I just wanted to give a little example. I also will say that one of the other interesting things about TDIU is that if you are able to work, and you do not work a full 12 month calendar year, you are able to keep working, even if you surpass the income threshold, mainly due to not being able to maintain steady employment. So income threshold can impact your TDIU but it also has to be shown that you are unable to maintain steady employment to not have it impact your TDIU, if that sounds like that makes sense.

finally hit 1year at my bank job that is $69,500 a year salary. I'm (80%) TDIU 100% P&T. This my first year working for a company so hope my 100% TDIU P&T doesn't go away because I'm also tax free and go to the local commissary. I know when the guidelines that gives you 1 year to try your new job and hold employment but it should really be a 3-year grace period

Craig, my recent VA decision letter stated there was a duty-to-assist error for my TDIU claim. I've met the requirements for it. Does this mean future C & P or will they review existing medical data? Also, can you submit new VA medical evidence while their deciding? Thanks!

I was granted 100% P&T recently and am in the reserves. While I genuinely enjoy what I do as a reservist (IMA & only go to annual training once a year for 3 weeks), it's not physically demanding, so part of me wants to stay in. Though, my primary physical issue renders me useless when I have a bad flareup. I am wondering if I am risking losing my rating if I stay in the Reserves since I have a little over 10 years before I can retire. Can you recommend an attorney who is well versed in my situation? Thank you!

I have everything the va needs never missed a cpu have nexus letters plus voc experts report but I've been denied tdiu 4 times what gives?

I have 70% TDUI and recently received a 30% rating for another condition now I have a combined rating of 80% do I get backpay for the 30% or for the combined 80%

Yes it does because you can work or not work and you aren't held to a standard. Unless you are signed to a contract for a formal company where you are held to a standard such as: "KZfaqr must make 2 videos a week for X amount of weeks" etc

I am TDIU, I have 50% depression, 50% Sleep apnea, 10% tinnitus. VA is giving me meds for vertigo. Sometimes, the vertigo is so bad that I have to crawl to the bathroom, which is 15 ft away. can my wife get aid and attendance? About once per month, I truly do need the help. I puke in bed if i just turn my head too quickly. Thanks for your reply

I heard something today wanted to ask if anyone has TDIU and SSD. I have TDIU and waiting for a SSD claim go thru. I know you can have both, the question is. Will they lower how much someone gets from TDIU once awarded SSD.??

Technically you can on scheduler. It is risky for certain jobs like law enforcement, EMT, Firefighter etc. It is how you explain it to your employer. As they might see it too risky to employ you. Also, how the VA sees it as well. They might look at your job and use it against you. Again, it is how you explain yourself. It is a touchy subject when you’re 100% for MH alone. Good luck man.

Thank you, I work for the government so I don't see them firing me for disability. Luckily I work from home with my job so I don't have to be in public as I'm a danger to society. So I just never leave my house. I get anxiety being gone for more than 3 hours a day. There's so much more to it. But it's pretty severe. Well see how my evaluation goes. Trying to go from 70-100 for mental health.

​@@nicko8570 I started a job too with federal employment under 80% TDIU P&T 100%. you have a one year grace period but then who knows after that? I think they monitor your taxes and social #.

So can Hill and Ponton help me with fighting the VA when they send that letter to remove TDIU in a year? I just got my training and certificates done for an old job I used to do. When I start working let's say June this year, I have "up to" one year that they'll send me the letter to challenge that TDIU removal. Within the year I'm working, I plan to build in roads and relationships with my direct supervisor about my disabilities etc, if he's willing to sign/furnish documents to help me argue a case to keep TDIU on the basis of (I wouldn't be employed anywhere else with the same leniency because of my veteran status at work) do we have a path to success or should I keep biting the bullet and stay home? I need more money than the TDIU alone is worth, even with the property exemptions etc I can get back to work making 75k + the 90% I'd be at regular combined total which should be enough to cover everything and them some.

I called hill and poton. The woman that answered the phone asked me questions and told me she could not help me, because I'm not in as shelter or protected work environment. The definition I was given is exactly what I Working under. I don't get the catch 22 the sectary said one thing here on this video I'm getting different information.I almost feel this company doesn't want client.

Great question! I miss filling taxes cause it's like a savings account you can only touch once a year. Last time I was able (prior to COVID) to file was after my deployment and a year of unemployment. I had them taking taxes out of my unemployment so I could get a big amount back when I filed, plus got the taxes they owed me from my deployment pay (cause they take out taxes, them give those back, but tax those taxes as well 🤔 government math 🙄😵‍💫), and the rest of my sign on bonus from enlisting. But then I ended up having to get out early due to my unit not telling me I'd have to go thru another physical, ahead of time enough time for me to be there, like when you enlisted after I came back from medical leave after the birth of my daughter (5th child) so I now owe part of the enlistment bonus back to them and they took what would have been my 2nd COVID tax check and what little taxes I was supposed to have gotten back in prior years. Still owe on the enlistment bonus even though I didn't even want to get discharged. Wish they would have taken all I owed out of my disability back payments.
