This was waaaaaaaaayyyyy more civilized than when I took MY landlord to mediation. My landlord screamed and argued with our mediator. She lied like crazy, too, even when she was proven wrong. When I sat outside during her caucus, you could hear her through the door, and you could hear the mediator telling her to calm her ass down, lol. and so did everyone else who was waiting for their case. As for me, I barely had to say a word.

He impresses me as being entitled and a professional victim. He was more concerned about having cable and having gas for a car he can’t afford, when he is not paying rent. His refusal to pay late fees and the blaming the landlord for charging for court fees when he had no reasonable plan to pay the rent and had no intention of doing anything about it until he was forced to by the court. I don’t blame the landlord for pushing this action, especially with his entiled attitude and the fact that he still has cable and is driving in a car that could be sold to pay the rent.

Thanks for doing this. We are facing mediation soon with our landlords who illegally withheld our deposits, illegally removed our property, and changed the locks on our unit when we were still tenants and had paid the full month's rent. This helps give us an idea of what to expect.

Okay, as a former landlord, you have to find a way to make the best of the situation. He is an older man, no job, behind on rent, but has been in the apartment for the past 4-5 years. Perhaps, have him work it off being that she runs a business. Now, if he decided not to work it off, then she would have no other course of action but to evict him. Eviction is part of being a landlord. 🤷🏿♂️.

As a tenant rent is essential to be paid. Make payment arrangements BEFORE you get into difficulty. I can see both sides. The tenant is not being reasonable to be honest. You can't expect to stay for free and then complain when the Landlord gets upset about wanting their money. You go without cable TV and use pre-pay phone service. It can be done.

Hello folks, I'm currently undergoing training for mediation, and I would like to say that this was a very helpful resource to me, as I picked up a few things after watching this mediation. However, I would like to respectfully give a few points as to what I realized while watching this mediation, and what I would do or change given my style of mediation. Hopefully this could give you a different perspective on the mediation process. As most of us know, this was a mock mediation, and only serves to give people a glimpse of what a tenant-landlord situation would look like. As far as I know, a normal mediation would rarely take this little time, and could potentially be more volatile emotion-wise. Throughout the mediation, I enjoyed watching the mediator take a more passive but firm approach when talking to the landlord and tenant. But is it me, or was caucus called way too early?? I could see calling caucus early as an effective strategy to gain knowledge of the situation early without interference of the other party, but I wasn't entirely sure if it was necessary. It almost seemed as if both parties weren't able to fully explain their stories. Another thing I noticed was that the mediator rarely used reframing to clarify what was being said by both sides, but I suppose the matter was extremely clear to both the tenant and the landlord. These participants are most likely much much MUCH more experienced that I am, but one thing I noticed was that the mediator seemed to become less and less impartial as the video went on. You can notice the mediator remind the tenant frequently about potential repercussions and the chance of being evicted if he did not come to an agreement. And finally, when terms of the agreement were discussed, the mediator once again reminded the tenant of the consequences. All in all, they did a much better job than I would have ever dreamed of doing, but thankfully I am going to another training session to roleplay these exact kinds of situations! It's amazing how such an old video can still serve to be an amazing tool for mediators in training just like me.

It's actually pretty crazy that I'm re-visiting this video from a whole year ago, and it reminds me of when I first wanted to learn about mediation. However, life kinda changed for me, and I decided to study psychology at my university. Mediation/conflict resolution was definitely my second career choice, but I'm glad that I'll be able to help people in a similar capacity as a psychologist. Looking back in hindsight, I can say that mediation was one of the most enjoyable skills to pursue. As for you, keep at it! It'll be totally worth it :)

Homelessness creates debts for city and States, and when the the local City Police Commissioners don't agree to let the United States people to work because they don't like them or not able to control those United States citizens lives, homeless will increase and continue. The party that brought case to mediation, sometimes when court judge sends cases to mediation, he can decide if fees should be split or even waived. Some courts request that mediator work at least one case free of charge.

Renting shouldn't be a business, as housing is a necessity. I'm not saying don't pay rent or things like that, but the problem is that renting is considered a business, and landlords take advantage from this. In London, U.K., there are very few landlords who really "take care" of their business, such as fixing what needs to be fixed for a decent living, etc... If landlords want to treat renting as a business, then fix the shit that needs to be fixed. I'm saying they take advantage of this because they know that if they don't fix the stuff that gets damaged in time, and if the current tenants decide to leave the property, they will always have someone who will rent their place, as housing is a necessity. Also, how can you even compare it to a business when there are things to take into account such as problems that tenants can go through in their lives? I'm not saying being uncommunicative, but this system needs to go sometimes out of the long paragraphs from tenancy agreements to considerate personal cases. I'm a tenant in a situation where we were all evicted from our property because of a problematic and dangerous tenant, as we were all in a joint agreement. We have all moved out from the current property except for this problematic and dangerous tenant, and the agency and landlord wants money from us as they said “we’re all liable for the rent”, which is what the contract says. But in cases like this, there should be a way to solve this outside of the contract, as we cannot control this person. Not even the police can help. It’s the most stupid thing I’ve ever come across to. I know they want their money, but what can we do about it? We people who can’t afford paying double rent, but it seems that the law is still on the landlord’s side. We cannot even afford a solicitor. That’s why we pay rent, because we do not have saved money for a mortgage yet. And yet, we are only able to get a place through rent when at the end the money we’re paying in rent would be the same money we would be paying for a place that is ours. We tenants are paying landlords’ mortgages, which is unfair. Renting a place should be less than when you’ve bought a place. The scheme is the same as rent to buy anyway.

I see a lot of support for the landlord. Imagine being the tenant and losing your job. The first thing that goes into your mind is how your going to pay your rent. Your already hurting losing that job and now your going to be homeless? Coming back from losing the job is gonna be difficult. You feel too far gone when your homeless on top. This is a situation where I'm saying that this tenant never had problems before and always been responsible.

You know this tenant and your more likely to get all your money back as soon as they get back on their feet. Setting aside emergency money is always necessary and responsible. If the tenant is a good person they are aware of their limits. If they don't see the light at the end of the tunnel within reason, they'll vacate. You don't need to steal money from me, If have it to give...I will. But if your that type of person that always has their hand out...

We're limited to rent increases at 5% plus inflation or 10% which ever is less, why would I keep the tenant who's (Not) paying rent capped at $1700 a month when I can get rid of him and rent it out to somebody who can and will pay $2800-$3,000 a month. In my mind he's already stealing the difference between the $1700 month rental rate and market rate of $3000 each and every month, now he's stealing the rest of it too.

FYI Mediation is not free, This is designed to make a judges job easier and unclogged the courts.. once she said nothing leaves the room i stopped watching,, Mock Mediation - I would decline mediation and ask for the judge to hear the case. Why you ask well because my tax dollars pays for the judge not for mediation

Very good point, especially after filing costs and expensive attorney fees it should be presented in front of a judge. But this step is also helpful to self represented litigants who may not understand how to articulate their defenses effectively to a judge to get a ruling in their favor. It can be beneficial

omg the logic “no one’s gonna move in the winter so she’s gonna have an vacant apartment anyways so i might as well live for free”. well dude, people don’t only move when it’s convenient…. for example when you get kicked out and have to find another place you will be moving in somewhere in the winter…. doesn’t he get social security or have family or anything

It’s staged. 👌🏼😂 they’re actors and doing their best to be very difficult people from both sides so we can gain a better understanding of the side we may be on or the other side in a objective point of view. Normally, within mediation, nothing would leave the room & there’s no way a mediator would hold a meeting between two real people and then post it on KZfaq yall. 😋

The guy is old, will not be easy to find another job. If getting unemployment, why has he stopped paying the rent. Landlord is not a charity. I would evict. Will never get back rent.

Right, I'd give anything to find a decent place for 750.00 but even really undesirable places around here, go for over 1100.00 for a studio.
