The Constitution in Section 178 is silent(moot)in this regard.The impeachment of Dr Hlophe was political and unfortunately and unfortunately the MKParty used a legal loophole in the Constitution to push a political matter. His impeachment made him not a judge anymore and section 47(1)of the Constitution provides that every citizen who is qualified to vote for the National Assembly is eligible to be a member of the National Assembly and if his party feels that he is the person to serve their interests in the JSC,why not? It is a matter of morality and unfortunately in Law,there's that thin line,as values,morality and religion are not necessarily embraces by Law.
