I always thought Godzilla was *public domain* ; I mean, I watched the *original* Godzilla movie on HBO Max not too long ago, and I don't think it was Toho that produced *that* ! Knowing that that's *not* the case apparently, I wonder if that's the reason the Godzilla cartoon series from 1998 wound up being cancelled. I certainly don't blame Toho for wanting to protect their property, *especially* considering that there're corporations that wanna *steal* other people's property these days (I'm pointing my knife at *you* Whiffers of the Coast), but I honestly think that as long as you're not claiming that *you* made the character of Godzilla (which I don't think *anyone* Toho sued was), it should be *fine* to use him in a work; I mean *come on* it's *free advertising* for them!

I remember now. “Godzilla Heritage” was a fan film that Godzilla’s lawyers shut down and even though it’s completed it can’t be shown online, essentially making it lost media.

@@caucasoidape8838 The damage already happened when the creators of kong found out, so it didn't really matter anymore. That's why Toho got away with kong. It also wasn't toho's idea to so king kong vs godzilla, but a Toho employee who "borrowed" the script for a king kong vs Frankenstein movie. Toho just went along with the idea of the king kong vs godzilla movie.

In Austin, TX (where I live) there is a Pizza place called Mangia and for the longest time they had a mascot called Mangiazilla. It was a huge, green, theropoidal creature with plates down its back. They got sued by Toho and stopped using the character. Their C&D Letter is even framed on the wall of their main location.

I remember that mascot! I used to go to the Round Rock location before it closed. It was the reason I went there in the first place. There’s also another place in Round Rock that used a chibi Godzilla as a mascot, but I won’t say their name because it’s still being used.

In Seattle we used to have a used game store that opened under the name "Pink Godzilla" but they ended up having to change the name to "Pink Gorilla" after Toho contacted them and told them to change it or else. They initially had merch of their mascot though and me and my husband still own a Pink Godzilla plush somewhere.

@@UJEvans Not every movie they did or released was public domain. I do believe someone on the MST3k side talked to someone, not someone at Toho though, about the rights as home video rights are so bizarre that contracts made decades even before home video was a thing are still valid; I'm looking at you, King Kong versus Godzilla. A contract signed in the 60s is why "King Kong tai Gojira" has to be included as a special bonus feature in its own box set for BD release, wild yet dumb. There are some movies that are public domain MST3k won't release because someone said "no"... rhymes with "Susan Hart", spelled the same too... and there are truly copyright movies they released because someone said "Hell yeah!"

Another case I know about, is with the Anne Hathaway film, Colossal. In its early development around 2014-15, it was pitched around the Hollywood studios and the mockup poster they used in the pitch straight up had the 2014 Godzilla design and a Mazinger Z looking robot on it. Even its short description specifically mentioned Godzilla attacking Tokyo. Toho jumped into action really quickly and forced the creator of Colossal to stop pitching the movie for awhile until 2017 when there were sufficient changes in the story to not warrant the wrath of Toho. Honestly, this case should've made the list.

Toho to me is right up there with Nintendo and Toei as far as bloodthirsty legal teams go. They obviously have the right to be, but I also think sometimes they get a bit too carried away at times.

Nah I agree with being very tough on it, folk will always try though when you know there’s a good chance it’ll cost you in extra fees most will just opt for something that is a more generic monster. Like the old saying goes. Give them an inch and they’ll take a mile.

I'm personally fine with the way Toho is handling it since most of these were outright copying Godzilla so it's understandable why they're mad, Nintendo on the other hand just wants to sue anyone for even the slightest reference to a Nintendo game that doesn't even make money

@@ObsessiveGeek I do agree about the starting point being a legit motivation. Everybody needs money to some degree after all. But how far does that have to go until it becomes plain ol’ greed? That’s what Toho’s decisions at times reek of. Corporations that only care about making money at any means tend to lose their integrity. Case of point, fan works made by passionate followers of the brand for no absolutely no monetary gain being nonetheless taken down and nearly having their lives ruined because of it, all because a corporation went too far to ”protect it’s interests”. It does make you ponder how far is too far.

As someone who used to work in licensing, I appreciate that you included a really important facet of copyright protection- keeping ELEMENTS of a brand from becoming generic. The skreeeonk, the dorsal fins, the character shape, keeping all of these together as "godzilla" is important, otherwise knockoffs can really run rampant- especially if they're profitable. Good video!

Let's not forget that this is a Japanese company and Japan copyright law is HARSH. No wonder they'd be so overprotective of the American rights as well. Yet, considering how many Godzilla inspired (or just plain ripped off) kaiju/tokusatsu projects out there, I can see why they'd be that protective so their official brand doesn't get watered down. Like how relentlessly litigious Ross Jr. is about Alvin and the Chipmunks, there were a LOT of bad high pitched voiced knockoffs, such as Peter Pan Records' The Crickets. It's honestly hard to pick a side in this. A local company using the character as parody that could lose everything they have, or the company that fears a flood of bad, potentially dangerous products. Also, "Thanks, President Godzilla." So glad you made that reference here.

Sometimes it does seem like they are nitpicky about their lawsuits and copyright claims (I.E. on KZfaq)...but honestly they have to. You let a few do it and more people will follow. It's a slippery slope that they just don't want to even test how far it will go. So I can understand their wanting to protect the character.

Obviously while ToHo did more or less create the kaiju genre they don’t own it, only the characters they create, for example Gorgo looks a lot like Godzilla you’d think they’d get sued however due to their being various difference in both what was added and subtracted from the design so it’s complete legal. Isn’t the intricacies of of trademark law interesting?

Monster movies aka “Creature Feature” have been around for a LONG time, if anything I would point to Willis O'Brien, the pioneer in stop motion movies..most notably King Kong [1933] though to be fair Kaiju have a much stronger fan base than the traditional monster movie.

Ironically I feel Godzilla [1998] aka ‘Zilla is a perfect example of something that’s close but definitely not THE Godzilla and clearly Toho agrees with that. The “I will know it when I see it” statement rings true here, it’s easier to point towards what makes something Godzilla or not than to describe it, though it’s got a lot to do with attitude/presence I feel…you just know when you’re looking upon the face of the greatest monster of all time!

If you’re planning to make another Godzilla Copyright Lawsuit video, I got something that might be interesting for you. A rapper called Pharoahe Monch made a song called Simon Says. And he used Godzilla vs Mothra’s Main Title from 1992 in the song! And Toho sued him in 2001!

What I hate is that they even come after fan projects. There was this one really cool one that had live action suits and everything, but they got a cease and desist by Toho’s Lawyers. Now we’ll have to wait another 30 years to see it when Godzilla finally becomes public domain.

When that day comes, I want an Anti-Copyright lawyer team to fight on behalf of fans everywhere. In fact, make a Parody Kaiju movie about it.

There should be a second part to this, I remember when Pharaoh Munch, a rapper, got smacked for sampling the Godzilla March in a song, a hot dog stand for selling giant "Dogzillas", etc etc etc. Btw, how has the band Gojira gotten away with it for so long? Apparently, from what I saw a long time ago, they got into trouble at first for calling Godzilla, then changed it to Gojira and Toho was ok with it, wich is quite ironic that the americanised name is the one they care more about but then again it makes sense.

Part of the issue with protecting IP is it's kind of "all or nothing". If they don't pursue smaller or less clear claims, it sets a legal precedent that others can use that as a defense for their infringement.

I think that TOHO is over proactive with Godzilla and i think that toho needs to calm down when it comes to Copyright Lawsuits. Because even MLP FIM had Spike the dragon do a reverse role parody on both Godzilla and King Kong in the same episode.

In the comcast commercial, not only was there Godzilla on the TV screen, but if you look at the toys on the shelf at a couple points, it looks like a Godzilla toy on the shelf fighting another monster robot toy.

Reminds me of when Pixar was gonna have Frank from Monsters Inc have a Godzilla roar but Toho said no so they used a Chicken cluck instead. At least they tried to get permission instead of facing a lawsuit

A temp license to use the Big G is about....10 grand and even then? Toho will literally tell you yes no on what you can and can't do with the big guy....I know this from a friend Don Hillsman II he's a massive godzilla and toku fan and told me this story

Speaking of a dog's breakfast, you should have a look at King Kong's copyright status. If you thought Godzilla's was bad... Personal opinion: I don't think Toho is wrong to defend their copyrights and trademarks, but I also think that this point that ____zilla is clearly a generic term in parody or homage. Nobody is going to seriously confuse ______zilla with actual Godzilla. Hell, I don't even confuse official American Godzilla films for actual Godzilla. Oh yeah, another thing that might be worth talking about is the Aurora "Godzilla's Go-Cart" model kit from the 60's that Toho pulled because they felt it offended the dignity of their monster. Godzilla. In the 60's.

@@iluvyurbles As I understand it, Japan doesn't have a fair use or parody exemption like the US does. You do see these sorts of parodies in older anime, but apparently the companies were just looking the other way. In recent years, though, companies have been cracking down on this. There were several series of the anime Osomatsu-san that only aired once and were then banned and replaced with alternate episodes. Osomatsu-san is a sequel to the manga and anime Osomatsu-kun. In Invasion of the Astro-Monster, when Godzilla jumps up in the air and does a silly pose, he is copying a character from Osomatsu-san.

At one time Nintendo the maker of the arcade game donkey Kong was sued by universal studios because they thought the game infringed on King Kong but the courts ruled that the two can't be confused with each other

I find it fascinating when talking about Kaiju-related lawsuits. I remember I picked a report I had to do on the Lawsuit between Universal suing Nintendo for Donkey Kong. It was very interesting but also shows that people who own properties really abuse their power too much sometimes. Besides, why would Toho think some idiot would confuse Godzilla with a parodied character that looks very similar to him? It's just ridiculous sometimes. 😂😂But stuff like this really interests me.

This isn’t me defending Toho - I hate copyright laws in general - but the thing Toho fears most with Godzilla is genericization. If they let too many parodies/homages slide, it gets harder to defend the cases they defend because Godzilla’s key attributes become considered public domain before the character does. It’s what happens to companies like xerox and Kleenex. So, I get it. The only lawsuit in this video that I personally think was overzealous is the subway one.

@@MonsterIslandBuddies Another Godzilla KZfaqr I follow is PaperFinz. He made an interesting video on the whole copyright mishap on Godzilla VS. Megalon and how many people assumed it was public domain. He even talked about how Mystery Science Theater 3000 got it. kzfaq.info/get/bejne/hLR4lat3safWnmw.html But honestly, if it weren't for MST3K releasing their episode of Godzilla VS. Megalon on DVD, I may have never been the MST3K Fanboy I am today. I literally found the DVD at a goodwill in good shape many years ago. I could tell you an entire story on it. 😅

@America Chavez Toho actually distributed MHA: Two Heros and was involved in the production of the movie as well. As part of the partnership agreement Toho had with studio Bones, Bones was allowed to create a "Godzilla" Hero for the film.

I don't think it's really about how idiotic fans are to confuse any giant monster with Godzilla, i think it's more to combat setting a legal precedent that can be used against Toho in future lawsuits. Like, if they didn't go after Comcast, then a future lawsuit could use that as a basis in their legal defense. And seeing the trend of 'Mandela Effect' idiocy lately, people will remember that Subway commercial segment, forgetting it was a commercial, and relate it's 'cheesy, low budget look' as a scene from a Godzilla movie, which also promotes the late 70's, low budget movies, propagating the image that Toho has been desperately trying to escape.

Yeah I’m sorry, that Subway lawsuit is ridiculously petty. That thing barely even looks like Godzilla and is such a generic lizard creature it could fit to almost any giant monster of its variety. Might as well just sue Jurassic Park since T-Rexes “look too much Godzilla” as well.

I agree. Half of that case seems to be that the monster is in Japan, which is associated with Godzilla… but the city doesn’t look like Japan to me… so is the issue that the woman is Asian? That seems messed up to me.

The lawsuits sometimes go way too far TBH. Literally you can design a Kaiju and have to legit worry if TOHO is going to burn your house down because * gasp*....it's a lizard.

I remember when I was a kid, I was watching Billy and Mandy. There was this one episode where this dude mentions "Monster Island" and I was like, "Hmmm, I wonder if it has godzilla monsters". It did, Rodan, Mothra, and Godzilla were there, yet I don't know if any more were there. I wonder to this day... 1. What is the name of this episode I saw. 2. If the people who made it asked Toho for permission to use the monsters.

Not sure if this ended up as a lawsuit, but Canada’s Long & McQuade music chain must have had a run-in with Toho as well…their Toronto stores ran a month-long “Godzilla Days” sale in June in the early 90’s, with artwork treading that very fine line,, and it went national one year. Not sure how it changed, but my suspicion is - with British Columbia having a very large Japanese population, the national exposure got to Toho somehow, and the sale has been renamed “Monster Days” ever since.

I was waiting for mention of a case against a car wash in Jacksonville, AR called Gwatzilla, complete with a very godzilla sign. Later on, the sign was changed so that it showed a car going through the wash within a godzilla silhouette (or something like that)

In my school vr game originally there was a entire mission and campaign involving g force and the anti megalasaurus force heck even Goalius was supposed to have Godzilla atomic breath but in reality they had a lawsuit against both legendary films and toho at the same time and they ended up removing the 3 the anti megalasaurus force one was a huge hit on toho bank account sense if it would of been there toho would be fine so toho have to owe them 5 grand and for in law reason the anti megalasaurus force and g force was overshadowed and closed there doors by the ppdc and jerterk heavy machine brought the anti megalasaurus force assets but 1 escaped and for the breath thing Goalius wasn't 100% kaijun so it wasn't his in the first place and oh I almost forgot toho apologies by giving them promotion to use kiyru Godzilla king Ghidorah (only name for both of Godzilla and king Ghidorah) and orga but for orga case it had to be changed instead of being what it is originally before mutation to a heavily mutated nilego and that's not all the company got sued again for a line (marchel stacker pentagon: THIS BASTARD RIP OFF OF THE LEGENDARY KAIJUN SURE KICK ASS SO LETS KICK THIS ASSHOLE BACK TO JAPAN) that line got them in Cort and as a result it became a second lost toho sense marchel stacker pentagon voice actor told the judge that the kaijun was a category 6 and was a cut bit of concept of the very first Pacific rim movie that was cut due to issues

I'm from Guam, and for a small time there was a Mascot called "Guamzilla". I didn't think much of it but later on I saw that it got rebranded to "Gumamon" I'm wondering if Toho had anything to do with the change.

What I remember most about Subway's $5 Footlong campaign wasn't the jingle or that commercial, but rather a picture I remember seeing on PeopleOfWalmart of an enormously fat man wearing a t-shirt that depicted the phrase "Five Dollar Footlong" above an arrow that was (predictably) pointing down.

My family sold a loose leaf tea called greenzilla which ironically was a red roibios tea ( caffeine free w/oranges and lemons crushed into it ) It was our number one seller and house tea at our restaurants. It just had the zilla name added to green tea so not sure if on a bigger scale that would fly . We never had any issues

It's kind of funny that Warner Brothers kind of worked with Toho by allowing their partner Legendary to make Godzilla films. I guess those lawsuits were water under the bridge.

Okay first off Andy is super wicked adorable. Oh my gosh he's just so precious. That parade float is totally Godzilla. Lawyers are the only thing on the planet that's more frightening than Godzilla. At least Godzilla takes a break and goes off in the ocean to rest after doing his thing. And I know I'm totally immature but for some reason Bagzilla just made me giggle. Another awesome video, MIB!

Anyone remember the time that universal studios tried to sue Nintendo over donkey Kong, but the courts ruled that there was no way to confuse the game with King Kong because universal studios won a court case proving that he's public domain and then came the 1976 remake

I'm really not surprised with advertisers blatantly plagiarizing Godzilla in that Comcast ad, after seeing Hormel's "My Pepperona" ad. They just took the "Weird Al" Yankovic song parody "My Bologna" and replaced "bologna" with "pepperona". The guy in the commercial is even playing the song on an accordion.

Mystery Science Theater 3000 had to pull a Godzilla movie from distribution. It's the one with Jet-o Jaguar. But, the Gamera movies are still out there.
