Guns bought online already have to go to an FFL who runs a background check before the firearm is released to the person who purchased it

Why are we still calling the yard-sale loophole by the wrong name? The loophole is that you can sell guns to a random stranger as long as you don't do it too often. Yard sales, garage sales, party to party sales between people who met at a gun show or online forum, etc.

For how much they say they love the 2A, many of my fellow gun enthusiasts seem to have difficulty remembering the "well-regulated" part.

There is no such thing as a gun show loophole. What they want to do is force EVERYONE buying a gun to do a background check and EVERYONE selling a gun to obtain a federal firearm license. Both are a violation of the 2nd amendment as there is no historical analog to support it. Text, history, tradition. That is the standard.

We will need to take note of all the politicians that scream about how ‘ unfair’ this is… they lack the empathy to understand that in a democracy we the people should be free from fear of gun violence in our daily lives .

How this was a loophole for so long is beyond me. Selling guns in a gun show setting just seems so shady.

In Chicago you can take public transportation from downtown and ride outside the city limits to a gunshow, purchase a weapon and take public transportation back to the city.

There really isn't any loophole they search your driver's license for criminal history upon purchase. Both at stores and shows. Private sales possibly. But this reporter is spewing out lies.

I attended over 100 gun shows throughout the United States of America 🇺🇸, every vendor must have their ALCOHOL TOBACCO FIREARMS(ATF) LICENSE displayed where everyonw can clearly see it or else be arrested by local law enforcement officers and ATF AGENTS OPENLY walking around the gun shows looking for violators.

Loopholes for buying guns should have been closed 2 decades ago..Just reviewed how Americans feel.....Studies show ( there are several) 86%-90% want stronger background and gun laws....Friend in TX lives near one of biggest gun shows in the country. She told me there was 2-3 mile line of cars waiting to get in even after the show had been open couple hrs.

There is no "gun show loophole". Any purchase from a FFL dealer comes with a background check.

I think that we need some investigative journalism here. A journalist going to gun shows and trying to buy guns without a background check would be an eye opener for many people on the scale of this huge problem. How many gun shows have guns available for purchase without requiring a background check? All of them? 1 in 3? 1 in 10? How many will kick you out if you ask about it?

So at gun shows everyone can buy a gun? This is so cool! ❤ Unstable people who shouldn’t even be near any kind of weapon never have the chance to get a real gun in my country 😢

Hang on. The ATF says there's no such thing as the gun show loop hole but there's legislation being written to stop it? What are some of the examples of these on-line markets that don't require that they have the firearm shipped to an FFL where you then have to go through a background check? Private person sales require the transaction to be conducted through an FFL which again requires background checks. If any transaction avoids the FFL/background check, it's already illegal. Why are they writing another law? Does it make it more illegal? Does it someone compel criminals to suddenly follow the law? Once again, trying to fix a multivariate problem with a univariate solution that will fail. Why would they continue to do that?

We can argue the point back and forth but the real question we should be asking is who cares. How many mass shooters got their guns from a "gun show loophole? Is that where all the gang bangers get their guns? If gun show loopholes exist why didn't the hapless first son get his gun that way instead of lying on his Federal paperwork? Every time something happens the anti gun politicians propose a slew of new laws, none of which will do anything other than make it harder for law abiding citizens and they refuse to enforce the laws already on the books. We should put all our effort into mental health and elimination of gangs in the big city's, that is if the real goal is to reduce gun crime. People who's real goal is to ban guns don't want to see the violence end, so they do nothing but whine and complain and propose laws and regulations that again, do nothing. Just like store owners who put "No firearms" signs on their doors.

People at gun shows don't themselves need an FFL to sell their guns. They only need someone who has an FFL to cowitness and do the proper paperwork to ensure proper background check etc is done. Most gun shows already have a registered FFL dealer for this to begin with.

This would save hundreds of children lives. Its not meant to solve the whole problem, but its a great way to stop bad people getting guns. If you still want to buy a gun, great, go to the store, pass a background check and the gun is yours.

I have never purchased a gun from a gun show, so I don't know how that all works as far as background checks go. I keep seeing people say they are running background checks and people saying they aren't. Maybe it varies from state to state. Where I live, it is legal to sell guns at yard sales, and people do. No background check required because it is a private sale. Any transfer of ownership for a gun should require a background check.

As the ATF official pointed out, there is no "gun show loophole". That's a complete misnomer of what any new policies are trying to prevent. I've purchased guns at shows, brick and mortar stores, and via online auctions. ALL required federal background checks. The online purchase required the gun to be physically delivered to a federally licensed dealer who in turn executed the background check prior to allowing me to take possession. If someone is selling guns outside of that then it is illegal. I think there is a perception among some that gun shows presently do not require background checks. That is false. So , whatever Biden is trying to do should actually describe whatever new constraints he is proposing.

I was on board for Obama's first two terms but this term is ridiculous.

I support the President in his attempt to get some kind of effective gun control. However, this doesn't seem to be it. I've been to alot of gun shows. The vast majority of gun sellers are FFL dealers, there are some individuals who are selling from their private collections to other individuals for their private collections (cynicism allowed here). Again, the vast majority of sales are from FFL dealers, NOT individuals. I'd like to see the data that says individuals are selling more guns than dealers before I accept that claim. The ATF official is kinda sorta correct....however, the ability as an individual to sell a weapon to another individual at a gun show - that is allowed. What this plan seems to do is to force an FFL liscence, of some category, on every individual who desires to sell or trade, which would not only require the $ to get the FFL liscense & it's renewal, but also to set up the whole online background check (the cell, laptop, whatever w/it's internet connection). I think that is where this plan is gonna fail. I think the President was correct in his plan to get SN#'s on ghost & 3D guns (that Texas judge is way off track by saying those aren't "firearms"). I'd support an effort to get States to make 21 the minimum age to "buy" any weapon (hand gun or long gun). But his effort to force individuals to become FFL dealers is off track.
