He needs to go to the police department, with his hospital paperwork showing they did not diagnose him with anything, and perhaps his dad will be arrested for making a false report. His father broke the law, it's not just retaliative.

My brother did the same thing to my sister. I wrote the hospital and told them she was taken there against her will. She did not want to be there and she received no treatment. They wrote off the bill.

What horrible advice…. If he told the cops and hospital this was a false report then he is in his right to sue. Sue and have dad pay court/lawyer fees and the bill.. we’re talking $16k not $1k…. I’m not being the bigger man over $16k - the relationship is over why are they concerned with burning it further? Stupid call

She's not saying be the bigger person over 16k. She's saying be the bigger person so that 16k doesn't become 30k, 50k. His dad is petty and would rather make his son broke just to come back. A restraining order is best and then he could use the restraining order to assist in winning his suit against his father.

If he followed all that advice. And still felt bad about it. Then he can absolutely take him to court bring his proof and receipts and be reimbursed. I don’t even think he’s telling the truth though. Isn’t that what gamers do to other gamers? Don’t they call that swatting? 😂 calling the cops and lying that someone is going to unalive themselves or drug dealing, with the intention that the call will affect or ruin their life against their will has got to be some jail time. That’s far fetched professional narcism. That’s some 48 laws of power movement.

My grandson has a dad like that. My grandson was in the hospital when his father called them to say he was suicidal. He was not.

I don't know why they are saying it isn't worth suing. It's 16 grand. That's more than enough to be worth suing over. It can't make his relationship with his father any worse.

If it costs $10K to force the sale of a house (per Dave many times in other videos) then an adversarial court case is going to cost upwards of $16K for sure.

@@curiouscat3384 Forcing the sale of a house is far more expensive than suing someone for $16k. There are very long processes to go through with lots of checks and balances, since you are throwing someone out on the street and they could lose $100k from the price on foreclosure being less than the market price plus all the fees they'll be lumbered with. For $16k, you can just go to small claims court on your own (if the small claims limit is less than $16k in your state, just sue for the limit and write off the rest). You don't need a lawyer. There will be a small filing fee and that's it.

@@ebransc09 There is no need for it to take years. Small claims cases usually take a few months. And just because his business is failing doesn't mean he has no money. If the business has only recently started to struggle, he's probably got plenty saved up from when it was doing well.

I think the hospital will help with a set payment plan. Sometimes they might even give you a 20% discount if you can pay it out immediately. Maybe get it reduced to about 12k

There's clearly more to this than the caller is claiming. They don't just put you on a 5150 hold if they show up and you are perfectly normal and you are not threatening anyone else.

I second this. In this day and age the hospitals don't want you. Unless you present with a likelihood to act now on ending your life they will likely turn you away. It's far more difficult to get your rights stripped like this than the caller is indicating

SUE HIM. Insurance or not this is completely and totally on the father, and he should be forced to pay the whole bill and double for putting his own child through that. I really don’t understand how they could possibly tell him to pay.

Why would the cops call the ambulance? Surely when they arrived they saw he was fine? And surely he explained the dynamic? There has to be more to the story. Anyhow I disagree with the advice that he should just pay. I’d sue his parents if I were him. At least try. Definitely see an attorney and dispute with the hospital. And get a restraining order on Dad for sure as well as criminal charges.

Cops don’t diagnose anything. They called the ambulance and they took the man into the California 5150 hold. And then sent him the bill.

@@sarikagoode1505 I know they don’t diagnose but they can assess and didn’t have to call the ambulance. I’ve seen people weaponized welfare checks to target estranged family members and they don’t all get baker acted. The caller IMO should get a good attorney and go after everyone including criminal charges on Dad and a restraining order. But it’s ok if you disagree.

Bad advice all around. Negotiate with the hospital for a much lower bill. Then get on a long term payment plan. Pay it off and consider it an expensive lesson for staying so close to what was clearly an unstable person. Change your phone number, move on, and never think about dad again

I’m sorry, but I don’t know why they repeatedly mentioned that he’s at fault for not having insurance. He’s free to choose not to have it, but it’s not his fault that his father is abusing the emergency system with fraudulent claims that have fallen on him. That was just dumb to mention multiple times.

Hmmm free to not have insurance. So what happens when he breaks his leg doing some outdoor activity and goes to the hospital. It will be thousands. Do you at least believe he should pay the bills? The bills will be extensive? How long do we give him to pay? Months, years, decades?

Unfortunately it's not that easy. My dad has threatened to psyche hold me in the past, and I've moved twice without giving him my new addresses. He pulled it up off the voter rolls and sent me an Amazon package just to prove he could still find me. I have multiple friends available to vouch for my mental health and safety at any given time, but I still have to budget around the potential. Nothing short of changing your name and giving up your entire life frees you entirely and I have too many other people I care about that I don't want to leave behind. The medical system in the US is messed up in a lot of ways, but one reform we absolutely need is zero charge for mandatory holds. It's completely unethical to force someone to pay for a service they directly refuse. If the government has decided they need the evaluation, the government can pay for it.

The fact is I can either pitch my life down the drain or accept the risk that he tries to psych hold me. I choose to accept the risk and budget accordingly. Anyone who claims it's easy to get away from an abuser like that is not realistically considering how much you have to uproot your life, and how easy it is for them to find you again in the age of the internet. It's totally valid to do your best to disappear, but it's not easy or necessary to deserve sympathy for your circumstance.

It’s called the 5150 hold in California. Involuntary admission if the authorities believe you could commit harm to yourself. Unfortunately the person admitted gets to pay a steep bill for this.

Couldn’t agree more with both of you. It’s called a 10-13 in Georgia. You don’t get hauled off by simply saying “Joe said he was going to harm himself”. Meanwhile Joe is calm, no evidence of wanting to harm himself, and denying said claim. At that point, Joe can’t just be hauled away(legally).

I used to work in a hospital business office- as long as you don't wait until they turn the bill over to a collection company they will work with you on payments. I do not know how it is now but when I worked there they did not charge interest. Set up a payment plan and stick to it! Also- good advice about the protection order - go to the police station and explain what happened -take the copy of the bill from the hospital and the medical record as proof that there was nothing wrong you in the first place! That way if Daddy tries to do that crap again then maybe the police will put him in jail for falsification!

There is more to this story, I asked my brother who is an EMT if they can just take someone against their will when they are clearly fine. Here's what he said: No we do not, if they are alert and oriented to what's going on around them they can refuse if they're over 18. Tim is hiding SOMETHING on this call.

That woman in SC, Mica Miller, whose death is currently being investigated by the FBI was involuntarily committed by her cheating husband, and she and her family said she was held against her will. I believe this is a type of 'lawfare' that's not all too uncommon.

I guess it is a California ordeal from what I heard. I know where I am, even when the parent and family knows issues with the person, if they are over 18, they have to petition the court for a court order to have the child placed into mental health facility and even that requires multiple people to collaborate to the judge that the person is in danger of self harm

Yes, they absolutely do! They did it to my sister based on a spiteful call from my brother. The cops even stood there and belittled her at the hospital trying to make her mad. She didn't say a word.

I recently had a $5100.00 hosptial bill voided because I applied for financial aid. Go for it. Tell them about the circumstances too. It all goes to why you ended up in front of them. So sorry for your situation. It will get better. Take care of yourself.

The word “unalive” to refer to death by suicide or homicide was coined by social media users as a way to fool algorithms on sites and apps that censor posts containing violent content. “Unalive” refers to death by suicide or homicide. The use of algorithms is getting out of control. That being said, I’ll be surprised if this comment appears for anyone to read. Using terms like ‘un-alive’ downplays the seriousness of suicide. I believe society is tip-toeing around serious, tragic subjects by treating them as if they are every-day occurrences, somewhat like, “Oh, he had a migraine, he’s be okay” to “Oh, he un-alived himself, but all’s okay.” I’ve heard young people in the hospital waiting room (while waiting on the outcome of a friend, who had actively ‘un-alived’ himself awhile earlier) talk about how their friend didn’t really mean to to it, and can somehow be magically re-animated. Worse yet, attending a funeral where they continue to casually discuss how their friend ‘un-alived’ himself at such an inconvenient time for the group to deal with (I guess timing is everything). The finality of suicide is diminished with the use of the more palatable ‘un-alive’ words.

The caller is a lying. They need to corroborate the callers statement. They can not haul you to the hospital based off a third party statement alone. The caller either texted his father a bunch of suicidal comments or he admitted to suicidal thoughts to the police. Stop spreading this false information.

Unfortunately, they can. Most people in a psychiatric ward did not check themselves in. They were put there by their family or doctors. If they feel you are crazy or going to do something, then they will arrest you. Obviously, in this case, it was a false accusation, and the father should be thrown in jail for a fake 911 call. But if they would have felt that he was a threat to himself or others, they would not have let him walk out of the hospital that same day.

This situation illustrates why people have concerns about red flag laws. If a red flag law doesn't require due process, a family member or someone else with a grudge could make stuff up, have your firearms confiscated, and then you have to spend money on a lawyer to get them back.

It's California, so don't expect the laws and their enforcement to make sense. His Father likely took advantage of the 5150 hold in the Lanterman-Petris-Short act governing involuntary commitment to a mental institution to do this. However, I wasn't there and don't know, so take this with a very large grain of salt. But the laws there are whacky, that I'll stand behind.

I feel for Tim. I had a dad that did crap similar to this if you didn't do exactly what he said. He was a "my way or the highway" type of guy. I had this happen to me several times. It's humiliating!! He would call the police. Tell some sort of lie. They would come. Take me out in handcuffs in front of all the neighbors, like some common criminal. Of course, by this time, I'd be hysterical! Then, I'd spend about 2 weeks in the local hospital's lockup ward. Then, things would be great for awhile...until something else would set him off. This happened 3 times before the nurses came to me one night and said, "This is abuse. We know you were planning to move back to LA. We want you to pack when you are released, leave immediately and never look back." I can never thank them enough. Right now, I don't have alot of money, and that is a good thing, because otherwise, I'd fly back to Poughkeepsie and piss on his grave. Some people are just truly warped.

Take your father to Small Claims Court. No lawyer expense. Make sure you can prove he is the person who made the call. If the in your state the small claim limit is $10,000, sue first for the ambulance then sue again for the hospital bill.

That's easy - Police have an insane amount of leyway in what they can say to convince you to do an action. So it was probably a scenario where the guy "allowed himself" to be checked in instead of being 5150'd - which is an involuntary and usually 72 hour hold. I'd have simply had my attorney meet me at the hospital, given a temporary power of attorney to be released or threatened to sue the hospital for malpractice and police for unlawful detention under color of law.

But if an involuntary hold turns out to be a "false alarm", then yes, I would argue that the taxpayers should foot the bill on that.

Yeah, there's way more to this. The cops don't just go off of what someone else says for mental health calls. If you were fine when they got there, and you didn't otherwise meet the commitment criteria, there wouldn't have been grounds for an involuntary evaluation. If they put him in a room, had nurses and doctors talk with him, took his blood pressure and temperature and heart rate, had him pee in a cup, gave him a meal from the cafeteria… I think $16k was them giving him a discount. ER costs are outrageous for the simplest care.

depending on how far the ambulance took him, it could easily run to 4k. One day in a hospital, and an ER visit, 16k would be easy to see. Most places will settle for less, but because of government, prices are that high.

not having insurance isn't an error. there is no moral or legal obligation to have health insurance, and even if he did his plan might still have landed him with a big bill. that bill is not his responsibility morally or ethically.

I want the exact opposite, and insurance is not assurance that it happens that way. insurance means responsible people paying for irresponsible people. the most responsible person gets injured less often or not at all. and their premiums pay for the injuries of less responsible people. a thin person pays for the self-inflicted problems of the obese person. a safe driver pays for the injuries of a reckless driver. a sober person pays for the damaged body of the drinker. YOU want irresponsible people to be covered by responsible ones. a responsible adult ought to have a fund that can cover medical expenses whether or not insurance is a sensible choice available to them. you're either an insurance agent or a socialist. both can be true of course.

I would have this guy call the hospital and tell them that at the time of his hospital admission that he was uninsured, most hospital have a ways to greatly lower the cost of the bill. Once you settle this with the hospital, I would take the father to small claims court.

I wouldn't want to either. Maybe if I could haggle the hospital down, but 16k is too big of a bill for most people to just eat. I don't imagine suing family is fun, but it's totally valid to not want to live on lentils to pay off someone else's petty actions. The son is in a tough position, and there's no guarantee that being the bigger person will stop the dad from escalating anyway. People like that don't tend to want peace

If he doesn't take it to court, the dad will keep falsely calling the police. I'd take it to court to protect myself in the future. A judge would want to know why the caller didn't address this through the legal system if it was a false allegation. You can have a lawyer send a letter to dad as a way to settle out of court. Restraining Order is a great idea. Poor guy. I'm praying for him.

You're not going to an emergency ward for an evaluation, if the police didn't see any reason to bring you in. Depending on what the police report says, he may not even win a law suit. But I would definitely look into suing anyone who would pull that swatting kind of bull crap on me. At the very least, it was a faults report to the police.

Caller is lying. He either texted his father a ton of suicidal things or told the police he was suicidal when they arrived. Police can not haul you to the hospital based on a statement from a third party alone. They need to corroborate it.

how did you end up in a hospital as a person above 18? you can simply state you are non suicidal and don’t have a weapon or plan. they can’t take you in. i feel there might be more to the who entire situation. and is dad calling the police since the kid was 10? why mention his own youth stating at age 10 when he is currently 28 and far removed from being a minor. something does not make sense here.
