I think a lot of times when people are on vacation they seem to have a false sense of security as far as danger is concerned.

The moment I saw in the surveillance video that he leaned out the window before this fall happened, his guilt was established in my mind. I think he screwed up. He did not expect her to wriggle or something and he lost his grip and she fell. Either way, he knew the window was open.

My family member was driving with her grandchildren, and through a mistake of her own rear-ended another vehicle, causing the death of one child and seriously injuring the other... I never want to be at a funeral like that again. The incident completely changed our family dynamic, she has since passed away, but I never saw her smile again in the 20 years after the accident, I'm sure he isn't lying when he says there is no worse punishment available than being responsible for the death of his granddaughter

This man made an awful decision in lifting his granddaughter up to the open window. Can you imagine living with knowing that little girl died because of one stupid decision? I don’t believe he intended to harm her in any way.

I've sailed with Royal Caribbean. The spacing and height of the railings and windows is enough to deter any normal, rational person from falling overboard. I remember this because was trying to shoot some photos at an angle, but it was too much of a hassle. Even if the man was colorblind, he'd still be able to feel the ocean breeze coming through the window, as it was the only one open on that part of the deck. The windows are also tinted, so he'd be able to notice the change in brightness. Then there's the surveillance footage, which clearly shows him leaning over the railing and sticking his head out beforehand. He knew the window was open, and then leaned _even further_ out the window when he was holding his granddaughter. There's just no excuse.

I think the man living with this guilt is even harder than going to prison. I would feel like a complete failure of a human being, I would feel unworthy of living.

I'm interested in how "he let Chloe bang on windows all the time" was established -- just on the family's word? Even if it was a family bad habit, the fact remains Sam held her to the edge, and then let her go, whether she was banging or not. IMO, this is more likely: he leaned out, saw how high up they were and wanted to thrill Chloe by showing her the drop. He dangled her near the edge, but couldn't keep hold of her, and let her fall. Probably not intentionally, but highly, highly reckless. I have no sympathy for people who sue for damages which are obviously their own fault.

I'd heard about this case, but not the part where Chloe was used to banging on glass at hockey games (also probably not a good idea). I get where she might want to do it on the ship's window, but the grandfather should have said 'no.' Banging on or leaning against any glass is not a good idea at any age. Perhaps Anello was so interested in the view and wanting the baby to see it, that he just didn't realize he was leaning out of a window, but he shouldn't have been doing that in the first place. It's a sad story, nonetheless.

Great summary and analysis. The family contacted a lawyer within a few days of Chloe's death, and the lawsuit was filed well before Aniello was charged. The judge threw out the suit recently, but the family has filed an Appeal. They seem determined to seek monetary solace for their grief, instead of facing the facts that point to the real cause of their child's horrible death. The parents have admitted to not viewing the video of Sam's negligence. I've always liked the "reasonable person" standard and this case is a good example of how that standard really cuts to the substance of the matter. One more thing... The row of windows were located in an area with bar tables and chairs, and there was a bar serving alcoholic beverages located at one end of that area. The opposite side of the ship had the same setup. The "kids splash zone" was located in the center of the deck. From the beginning, the plaintiff's atty has stressed that this "hazard" was located IN the children's play area, and the media has run with that narrative, even though it is, at best, a major exaggeration, and at worst, a self-serving falsehood.

Excellent. I learned some new information about this case that changed my opinion! When my first child was just a few months old there was a tragedy at the local zoo that was similar to this. My husband and I acknowledged that we, as new parents, were bound to make stupid mistakes, but we made a pact to "never hold the baby over the alligator exhibit"--meaning never intentionally do something so stupid it could reasonably lead to our child's death. It's actually come to mind a few times and made me change my behavior--I've been grateful. What a tragedy for this family to live with. 💔 Edited for clarity: so i don't sound like I'm the person whose child died at the zoo.

We went on a 5 day cruise out of in the gulf, Mobile to Mexico & back. There was an autistic teenager traveling with caregivers-not his parents-who disappeared off the boat, believed “to have jumped.” After a lock down and search of the boat, he was never found. Another passenger got stabbed by his wife, airlifted from the middle of the ocean. Crazy it did not make the news!!

It's like that time when the late Micheal Jackson dangled his infant son over the balcony of his hotel so everyone could see him even tho the baby was fully covered under a blanket. So, not much to see really except Jacksons very poor judgement. Thankfully his strength didn't give out.

There is an oceanside cliff in Santa Cruz, ca, very scenic and fenced off by the state or city. I was there taking in the view and a man went over the fence, which was designed to be kind of part of the rustic scene, with a little toddler boy and proceeded out onto the out-cropping cliff which was very slippery from the mist as the waves crashed below. And the little boy ran around on this outcropping while the man casually walked behind him. We drove off. I don’t know what happened, but what was that guy thinking letting the kid near the edge of a slippery rock cliff?

Your conclusion is spot on. Personally I think the guy got away with homicide because he risked her life for his own amusement. If he truly loved that girl then he would be begging to go to jail, or would have lost his sanity and be committed to an institution. I read the statement he gave after he pleaded guilty. The first two things he said was he was glad there is no jail time and that he doesn't have to admit the facts.

I’ve been on lots of cruises and I don’t know how you can possibly think there is a window where there is none. Glass is never as transparent as a clear opening, so the difference is obvious, and there are always breezes coming through open windows.

Thanks as always, Dr Grande. One of the most tragic, needless losses I've ever heard, God bless the family and the spirit of the little girl. My Dad's brother was killed age 4 in a strange and unlikely accident when a bicycle handlebar hit him in the temple. The tragedy of his death ruined not only my Grandparents' lives and the lives of the cyclist and his family, it has echoed through our family ever since. It had a dramatic effect on my Dad's childhood, on his parenting of us and how my sisters and I parent. I honestly believe that my sons are unusually alert and fearful of danger and that they will possibly pass this on to their children too; a little extra caution is not a bad thing to learn but I hope they are spared even a glimmer of the unbearable grief that such a needless and seemingly preventable accident caused. A few seconds of thoughtlessness or lack of concentration can cost the most precious, irreplaceable being in someone's world and I pray to God to please never let such a loss occur again. I know it's something of a hopeless prayer but I mean it with all my heart - I wouldn't wish such pain on the worst person on this earth.

Pleaseeee look into the case of Gabby Petitos dissappearance. Her "boyfriend" drove her car all the way from Wyoming to his parents home in Florida without her, got a lawyer and wont speak to police. She's missing in an area that is close to the "Zone of Death". Also there were 2 murdered people in Moab around the same time thwy were there and the Moab Police received a call about Gabby and her boyfriend having an altercation. Everything is SO WEIRD in this case

Once I've actually BEEN THROUGH the portal and back, I'll let ya know:) This was incredibly sad. And Sam's excuses about colorblindness, stating he thought a window closed, that he just put the upper 1/3 of his body through, were just the coping skills he had at the time. In many ways, his responses had an almost child-like naivete to them...everyone suffers here.

Cruises sound amazing. On a regular vacation you might be able to get Covid-19, contract a disease that causes diarrhea 30 times per day, or get thrown 100 feet to your death. But only a cruise can offer all three in the same day.

I would be incapable of forgiving my father if this happened to me. When you are caring for any child, you have a clear responsibility to keep that child safe and alive. I just can’t imagine surviving this incident. I have one child after years of infertility. He is 29 and I kept him safe. I took nothing for granted. I knew my role was to raise him to understand safety protocols and use good judgment. I may sound selfish but that is too high a price for me to pay to lose my child over such stupidity and severe negligence. No one will ever be the same. He inflicted life long agony to his family. He should be in jail!

Imagine being grandpa the first seconds after Chloe fell and having to tell her mother and father what happened.... He should have taken the blame on him, in my opinion, out of respect for the little girl.

This is perhaps one of Dr Grande's better videos because it covers a topic that really grinds my gears; the public's perception that someone else is always financially responsible for a careless mistake. I can't imagine losing a child or grandchild. How do you wake up everyday knowing they are not there? Not sure I could do it. But I don't think I would sue a company that had no cause in the accident. Like Dr Grande pointed out, warnings are for "mouse traps"; a term we use at work for hidden dangers. Signs were never meant for warning people not to eat AA batteries. Nor were signs meant to warn people against sticking their hand under a running lawn mower. I also don't need a sign warning me that the hot water inside my new water heater will burn me. It is absurd, yet they are all the results of successful law suits by people with no sense of resonsibility. I work as a mechanic for a large public utility that has a legal department that spends a lot of time fighting frivolous lawsuits. In a recent lawsuit, the family of a man sued the utility after he broke into a vacant building and tried to steal copper from a panel energized with 480 volts. By the time the coroner arrived they literally had to sweep up his ashes. The family argued that the panel the guy cut open should have been de-energized if the building was vacant. So what do we tell the building owner? " Thank you for paying your bill, but we are going to de-energize the panel anyway because some people are stupid enough to cut into it" You ever notice that you seldom hear of Walmart being successfully sued? Their legal department vowed to fight every lawsuit regardless of how much it costs. They will spend $10K to fight a $500 lawsuit. Try to find an attorney willing to take on Walmart. Not going to happen. That's how all companies should be

From the beginning I've had the sense Anello unconsciously sabotaged his own happiness with his decision to dangle his tiny granddaughter out an open window 150 feet above concrete. The timing of it was very significant - the whole family together, about to set off on an idyllic cruise. Maybe he deep-down felt he didn't deserve that much happiness, maybe he had an infantile jealousy of another infant getting more attention than he was among loved ones. What I know for certain is that innocence and evil often go together, and there was something evil in grandpa that destroyed the innocence both of little Chloe and of the entire family. Further evidence of that is the way the toddler's mother so angrily defended the very man who killed her daughter. Yes, he was her father...but that crusading degree of defending him was downright disturbing. There was no hint of Chloe's mother being sad or even disappointed in her father for destroying so much so stupidly. Perhaps there was evil in Chloe's mother, also?

Even if this was negligent, I still have compassion for him. How can you not? i am baffled when people say they have none. My God. The pain and guilt he must carry every single day of his life. If people look at him and he cries, doesn't that suggest some sort of deep distress inside? I'm baffled at some of the reactions to this. I'm not sure that he should get a punishment--his guilt is more than enough.

Sam says, "The wall of protective glass disappeared." He doesn't mention that Chloe also disappeared. The statement honestly should be, "The wall of protective glass disappeared and so did my marvelous granddaughter. She fell to the deck." That would indicate an honest appreciation for the situation that he created for no good reason. In the latter statement, Sam would be held accountable to himself rather than to the law. So, Sam is basically lawless and reprobate. There's no such thing as an adequate defense for those who are on their way to hell.
