IMO, both of those options are not in the best interest of my buyer. This would be weakening the offer on my behalf. From my experience the best way to approach this is to negotiate with the seller's agent BEFORE they are aware that your buyer is putting in an offer. TEXT or EMAIL: Hey "Seller's Agent", I noticed the commission split is 3.5%/2.5%. I understand that you are trying to make up for marketing costs, but this is too much of a difference for me. If I bring you an offer will you be good with x.x%/x.x%? When an agreement is reached, send them the commission agreement in writing with the offer and have them sign it, but don't mix this in with the actual offer. This has worked well for me. Just my 2 cents.
