It sounds like the "captain" was more worried about his boat being pulled into deeper waters than the welfare of his customers. First mistake was not training them properly. Second, going out into uncertain weather. Third, cutting them loose. Negligent and criminal in every way. Hope he gets his due justice....

This is a hard case. Yes the boat operator took these people up when he should have ceased operating due to excessively high winds but the mother should not have taken two little children up in the parasail. It was Obviously unfavourable weather and she should have known better. Cutting the line was possibly the best of the bad choices the boat operator had at the time.

The customer was on vacation and assumed if they were open that it was deemed safe by the company who she trusted. In what world does cutting that line make more sense? I've parasailed with my wife in slightly rough weather conditions before and my wife freaked out midair and began to feel weak. She was still holding on to the belts connecting us to the sail but said she was about to lose consciousness. I signaled the captain twice and when he realized what was going on he began retracting the line and we started descending. I can't imagine what this poor woman and kids went through but it must've been a terrifying experience. The fact that the captain decided to cut the ONLY connection they had to safety rendering them completely vulnerable and helpless is unfathomable and infuriating. No one in their right mind would ever make such a decision, let alone someone who does this for a living and is supposed to follow safety standards and regulations and act in a professional manner. This is a clear case of manslaughter but I would also look into other motives as well. Those kids are traumatized for life and the son will live the rest of his life without his mom. Manslaughter sentences do not reflect that and will never feel like justice has been done. Note: the captain of the boat did not attempt to follow them in his boat, he did not try to help in any way and, contrary to his claims, his phone records showed no 911 call attempt. He surely is a pos.

As an avid boater of 25 years who boats weekly in Pacific Northwest waters that are cold and deadly, this was outright negligence. This man was paid for this and should have known weather conditions! Every experienced boater knows to check wind strength, direction and all weather...including small craft advisories. When weather started to change since he was already out on the water, he should have gotten them on his boat immediately. Cutting the lines, he did not try to save them! The other boats had to save the boys and managed to. He deserves to be fined and jailed plain and simple! We have towed a boat in distress...my husband is coast guard trained. This is not appropriate boating behavior and is criminal in nature. Those poor kids and losing both a Mother to one and an Aunt to the other? NO words will suffice in this unnecessary tragedy!

I'm sum it up for you; murder ( regards of 1 2 3 degree ) is a intentional killing. e.g I get a gun and shoot cause you cuss me out , that equals murder Manslaughter is an unintentional killing. e.g I driving wreckless doing donuts in my car and my tire flies off an strikes a bystander in the head causing injuries where you die. That incident was an intentional killing act. or You step on my 2k USD pair of ostrich skinned boots and we exchange some ones and I punch you and you fall backward and your head hits the table and you die. Again manslaugher would be the correct charge. In most states and situations like this they will go with manslaughter since it would be easier to gain a conviction ( remember double jeopardy applies, so if they can't meet the standards for murder they can't retry with manslaughter ) Did Capt Couch make a bad decision? yes. Was it murder as in intentional? hello no. I do not think for one second the capt would thought the wind would drag them over a mile away into a bridge. I would also think any reasonably intelligent person would have came up with the same conclusion. We all could be made and upset, but that does not change the legal requirement. And if any other parasailer are called as witness and say will I would or have also cut my tie rope as a normal means to cancel a wing on flight, I would think. the state of FLA would have a hard time even gaining a mansalugher conviction. Let give you even more clues, the two quickest ways to get a sail back on the ground (water) is to 1> stop the boat 2> or cut the boat from the sail . In both case this stops the propulsion force that would keep them in flight. Me and you where not present an thy already have person ( witness ) who claim he did not see the event unfolding as alife or death emergency until it became a life or death event. 😃

Something very similar happened like this several years ago in NC. The families only got $100,000 because there is some crazy maritime law that limited this to be the max payout. People were outraged but there was nothing that could be done. The guy skated away with millions still in his pocket because he has a very successful business while he killed 2 people. There was even a small craft Waring out at the time they took people out and yet that still didn't matter in the settlement.

This is why I would never go parasailing. You don’t have any control in the air and have to rely on the boaters and I’ve learned more than enough in my young life to not rely on others if you’re not able to take any ounce of control.

The reporter isn't going to tell you they're harassing neighbors, but that's their MO.

I went parasailing in Florida once. Will never do it again. The captain of the boat clearly had a quota to meet for the day. He sped through the harbor and rushed our trip so that he could hurry to pick up the next group after us. Half of the boat got sea sick and other boaters in the harbor were flipping him off because he was driving so fast.

I live In the Keys. They should have never went out to begin with. We knew the weather would be bad the day prior and appropriate warnings were issued for marine crafts. It was the reason we didn't go out on our boat for Memorial day. But that being said I am told the entire family was still on the boat while it was being dragged down. Perhaps the captain was trying to save 10 other lives? Still a bad choice. Never cut the line. But we weren't in his shoes at the time.

Get my drift. You put your trust in the operator ie Capt to make what should be a professional decision as this is what he is supposed to be knowledgeable of not the customer

Those boats have at lot of power to at least hold position while reeling them back in or minimize back drift while still reeling them in. I ran parasail boats long enough to know how to read weather and when to stop flying versus making an extra buck. He should be charged and do no less than 20 yrs

Only two reasons for cutting a line. First reason, extreme wind gust or the towing craft was so small it was being lifted into the air from extreme wind gust. Both situations are caused by negligent operators who use to small of a towing vessel in regards to the size of the parasail and weight of the customer & craft. Also, not canceling when the weather is to dangerous to safely operate.

@@thefix2573 Good point! Yeah, I never brought my son surfing with me at 25’ Waimea Bay. However, we often surf together in 2’ to 5’ conditions at spots the have sand bottoms instead of reef. Sadly, many parents are unaware of changing weather conditions, (in regards to safety) or the potential of how dangerous certain “activities” can be.

I was at orange beach last week. It’s double red flags, one teen died who was in waist deep water due to insane rip tide. Another father and son almost died and had dry drowning. I have never seen waves, wind, or anything like the weather.

This can be a HUGE lawsuit. Also borderline criminal because of negligence on the part of the business ...anyone who knows about water sports knows the weather has to be VERY good in order to go para-sailing. I've done it before and felt very safe but it was also a blue sky/perfect sunny weather. 🎯

It included a psychologist, a clergyman, and doctors from 6 different institutions including harvard medical center and the mayo clinic and they examined 1800 individuals and by the end of the study they concluded that prayer works at the same rate as chance. This is just sad and ridiculous on the “captains” part in so many ways….for one, even if cutting the line was the “right thing to do” (absolutely wasn’t) what were they then gonna do…?? just let them go out to sea like pieces of trash and then have to get a whole search and rescue started…?? Every year a woman who I went to High School talks about the Parasailing accident(on Facebook) that injured her daughter and husband and warns of the dangers of it. I agree 100%. They weren't cut from their line or anything but they did slam into a building and were gravely injured. Makes you think. Is it worth it?
