If you are in California, you should always get the consent of all parties before recording any conversation that common sense tells you might be "private" or "confidential.", violating the California wiretapping law can expose you to a civil lawsuit for damages by an injured party, even in a public place.

But he has the freedom of speech. He did not say it to the public. He was not aware of himself being recorded. I get him not being an owner anymore, but a complete ban is excessive.

XxSuperstarGamingxX He has freedom of speech under the law, the NBA can hold their owners (and obviously do) to a different standard. They are a business first and foremost and have the freedom to act on this as they wish.

Hey, Adam Silver just earned his hood pass. Using someone's personal statements that were taped(probably illegally) in his own home against them. Hope this is a long drawn out legal battle. Free speech, what a joke.

The man had free speech, that's why he's not in jail. Free speech is given by the government, not an institution. If I made racist comments in my job and especially if I in a higher role, I'd be fired and banned too. The NBA like any employer has the right to have policies in place to run their company effectively. This cost them millions in sponsors and it would have sunk the franchise. This is not a free speech issue, I think you're confused. There were no police officers taking him to jail. This is what needed to be done to save the franchise, he's a great commissioner.

Leprechaun1981 Your the one who is confused. Mr. Sterling did not express his opinions in the work place. It was done in the PRIVACY of his own home. So your argument does not apply. There is a thing called the Constitution that supersedes the Mr. Silver and the NBA . Let's be perfectly honest here, this is a shady way to increase minority ownership. Take off the rose colored glasses, this is the real world we live in.

Privacy or not it effected the operation the franchise. Do you really think this was some back handed way to increase minority ownership? What does that have to do with anything?? I can't believe you just think this was planned to get a minority owner. What a stupid comment. Pirate or not it effected the team sponsorship wise, player wise. Players would not play for him white or black. This was in no way some secret way to get a black owner. What a stupid comment. Do you really think they'll stop any none black person from buying the team? That's just ridiculous. The guy made comments that cost the league millions and it was a business decision to him out plain and simple. All business have a money bottom line, not a race bottom line.

derek sun Ugh...auto correct kind of messed my comment up but I'm sure you get the point. I'm not going to argue because that could go on endlessly. But the point is, this whole race thing needs to stop. I don't know you and I don't even know what race you are but I can tell you one thing...if someone came at you in a negative light simply and solely based on the color of your skin, I'd defend you and have your back too. The color of your skin has nothing to do with who you are as a person and I'd have your back even if you wouldn't have mine because skin color doesn't automatically make you a bad person. I hope that we can all move forward....

Leprechaun1981 The NBA has been under extreme pressure for several years to have more minority owners. I do believe the NBA Commissioner and the NBA as a whole exploited this situation and will use it to increase minority ownership.First thing they did was put a minority in charge of day to day operations. All one has to do is see who the media is promoting as potential owners(minorities) when in fact there are also other non minorities interested in the Clippers, but I would bet they won't be truly considered. Also look how the players association along will marquee players like LeBron James and others are talking about a boycott if they don't get what they want in regards to ownership of the Clips. (and we all know what they want) A Minority owner.

2.5 Million - Wondering when this constitution was written as it appears it needs to be looked at again, most these owners make 2.5 every half minute, I think this should be raised, if it were 2.5 Billion, Mr Sterling would find it hard to sleep tonight, but sure he will anyways

you would have thought silver was up for the man of the year awards...truth be told, he holds no power, he needs 75% of owners to agree to get sterling out. do you think owners are comfortable knowing that something taped in bed by thier wife could take thier team away....we will see, for now silver has appeased the players union so the playoffs get done, this summer is when the real legal battle begins

You know he's going to challenge this on the grounds of the first amendment wjich in a way is very true shouldn't he be able to have his own opinions and speak them freely? Now with that said do I think his remarks are completely disrespectful and totally inappropriate on many many levels? Hell yes I do but he's still an American living in America where last time I checked we still have rights to say and feel however we'd like no matter how fucked up those thoughts are.

The freedom of speech amendments is something totally different in this case because when I bought this or any owner buys a franchise they sign to uphold the NBA constitution and by laws, just like buying a home in a gated community if you do or act in a way that's detrimental to the rest of the associates by that owner agreeing to the contract prior to purchase a majority have the power to vote you out of their community or in NBA vote you out as a team owner.

WeGiveYou ReferralsInc Ok I totally understand that but just because you sign something doesn't take away the rights that your born with as an American and like I'm not in any way or form sticking up for or approving of his comments at all but what I am sticking up for is his right to feel and speak how he feels I mean who's the nba to tell people how to feel about different subjects or what they can and can't say I mean I just don't think it's right to be told how you can or can't feel. And one more thing how can they make him sell his team I mean it's HIS team I could understand telling him sell it or remove it from the league but how can they make someone sell their property

Matt Todd No one is denying Sterling's right to his opinion. But his opinions make him unfit to be an NBA owner. (Imagine a Christian Scientist seeking employment as a hospital administrator). Given Sterling's hate, there's no way any black employee could be confident of receiving fair and equitable treatment from him. And there's the rub. The normal employer/employee relationship does not exist in the NBA (or anywhere in professional sports) for the players. Players frequently don't have the right to choose their employer. They get drafted. Their contract is traded to another team. They cannot negotiate a salary without interference from a third party, the league. When Sterling bought the team, he was fully aware he was buying a business that puts limitations on both employer and employee. And when he bought the team, he agreed to those limitations. It's not a freestanding business. His ownership is irrevocably linked with the other owners in the NBA. He has to be able to meet the standards of all the owners; otherwise, he has to go.

rudymill ok I get that but I just dont see how its ok to force someone to sell thier property over how they feel thats like you owning a jag but everyone else in your neighborhood owns a benz so they all get together and determine that because you like jags they not only dont allow you in the neighborhood anymore but before you leave you also gotta sell the jag how is that right? I know that the subject at hand is totally different from my example but you get what I'm trying to say I hope. I mean banning him ok I get how the nba has full power to not allow him anywhere near anything nba but how can you force a man to sell his team
