What is considered normal wear and tear in a rental property?
This is a common question we get. Knowing the difference between normal wear and tear vs damages will help you when you do a security deposit refund. Reasonable wear and tear are things like wall scuffs, minor nail holes, normal carpet wear. There link to a list of normal wear and tear items and actual damage items you can charge for in the notes. Doing good property inspections before a tenant moves in and after they move out will help you document things that are different and then you can decide if it’s normal wear and tear vs damages. The cost to a landlord for normal wear and tear can vary but you certainly should budget for it when you have a tenant turnover.

How do you handle deciding what's normal wear and tear vs actual damages?

My landlord is charging us 1400 on top of keeping our 800+, they clain we damaged the living room carpet beyong repair, they claim we damaged the wooden floor in the hall and bedrooms, but the carpet rented carpet cleaners several times while we were there taking care of it, and the wooden floor was severely damaged with scuffs, iron burns, scratches. They want to charge us for taking the carpet off and refinishing the whole wooden floor all over the house. Batteries off a fire detector that they wrote on the move in inspection that they would fix but never did. A toilet seat. Window locks, we never opened windows. We knew they would most likley keep the deposit because we left without notice for personal reasons. The rent was 595 and they kept that, plus added tons of damage fees, we feel they are treating us unfairly. On their reviews we noticed a lot of people have gone through the same thing with them, and most are military families like us, is there anything we can do?

So I've lived here for six years and, the new ppl are money hungry. Is there laws that say it's wear and tear due to extended use? I mean honestly the only thing that needs to be done is painting cause yes there are marks on some of the walls.( Only surface deep not holes what so ever.) The carpet is fine but there's some yellowing of the wall corners and, the title lining in some areas have came off. Honestly the place was kinda like that. Does a security deposit cover this?

The best landlord I ever had produced a detailed document with all the wear in the unit when I moved in complete w/photos and had me initial every item. Might seem excessive, but it protected both of us and I was glad to have everything on record.

And here I am feeling like I’m over board for simply asking my landlord to be present for my move in inspection checklist that we both signed when she declined and acted like it was weird I didn’t think it was supposed to be a Scott’s honor type of thing…. More I’m unfavorably leaving the place and know she’s a less than honest landlord who made stuff up to violate me on my lease…. I’m Gina be VERY difficult about this move out and very particular at my next lease signing whenever that is cuz I’m now actually homeless….

Yeah a landlord who is looking to do things "off the record" or under the table before you even move in is definitely a red flag.

Our biggest problem is when a tenant moves we have literally have to repaint doors windows walls basebaord casing and cabinets even after a year and section 8 tenants are the worst. It costs a lot of money to repaint a property after a year. Thanks for the video very informative.

Good video! We tell our tenants that, *in general*, if it's worn out, it's a landlord expense, if it's broken, it's a tenant thing. BTW, our lease states that ANY damage or breakage of doors or windows is the tenants responsibility, period. Otherwise it would always be "someone else's fault". Agreed, a detailed inspection BEFORE they move in is important!

What if the floors just start failing and it wasn’t anything you did. My hardwood floor started to come up bend and crack that’s not me breaking it that’s a fail in the floor would landlord have to fix it.

Thank you for a helpful discussion of the difference between normal wear and tear and abnormal wear and tear or damage. I would like to ask about motor vehicle leaks. What is a tenant has a motor vehicle leak in the driveway. If the tenant pressure washes the leak upon moving out, but a sort of shadow remains after the spot is cleaned, is that considered damage or normal wear and tear?

Thank you this new appt owner came in and didn't have any info about any of the tenants. So they decided that we needed to pay 1500 for replacing the floor and paint even tho wee lived there for 6 years. The appt was already warn when we moved in. We did leave some trash like plastic and cardboard I don't mind paying for that but I'm not about to renovate there appt.

What was the outcome? I'm also moving after 6 years.. I was also under the impression that (here in ca) after so many years of tenancy that the OWNER has to repaint and replace carpet before renting it out again 🤔

Good info. It's always kind of a gray area. I do extensive pictures and have a checklist for existing minor damage, room by room. Tenants always seem to say "it was like that when I moved in". As a landlord, I am probably too generous when allowing wear and tear because I don't want angry confrontations. If they have kids especially, there is going to be more wear and tear and I allow for that in my evaluation. I don't want a departing tenant to feel like they are getting ripped off. My properties are slightly upscale, so I freshen them to like-new between tenants, I kind of feel like that's part of the business.

I have been a townhouse for about one month. I opened the kitchen drawer, and the face came off in my hand. I took pictures and asked what the landlord wanted me to do. They said that they would have their handyman look at it. The handyman took it, damaged the sides while putting the face back, and the landlord put a $150 bill in my portal.

What if you have rented for 8 years and many repairs and inspections were put off durning the pandemic? I want to continue to live here but all the appliances are old, electrical is questionable and the plumbing is constantly breaking, chipping bubbled paint, torn screens from birds picking at the windows. I’m so overwhelmed! I don’t want to get screwed for all of these things if we ever move!:)

at 9;40, you actually have a clause that says the gutters have to cleaned professionally and tenant has to pay? I can see the carpets, etc. but the gutters? I like it if you can get away with that one, I guess if you include that in the maintenance

I accidentally made some stain on the carpet in the living room (about 2 feet long) and I am having a hard time removing the stain. When my landlord came to my unit, she said that I would have to replace the entire carpet of the living room because it is one huge carpet they installed, which will cost a couple thousands of dollars. Is this reasonable? Why can't my landlord patch up the stained area, instead of replacing the entire carpet.

I recently moved out and I believe I kept the place very well but My landlord charged me $600 from $775 for having dust on baseboards and some dirt in between refrigerator and kitchen cabinets. Isn't that little too much? If I take them to small claims court, do I have a chance to get my money back?

I can't really give legal advice and it's hard because without seeing it, it's hard to give you really good solid advice. You might want to just talk to the landlord and see if you can negotiate something that is more reasonable.

landlords "never" want to give you your deposit back. You could have a professional company clean your place and they will still not give you back your deposit.

That's definitely wear and tear if tenant has been there for a decade and landlord hasn't updated condition of bathroom. Grout needs maintenance too. So tenant can only preserve it for so long before basic maintenance must be done.

If the broken window was clearly the fault of the tenant, then yes. But a receipt for the repair must be provided to the tenant when you use security deposit funds.
