I was arrested in California in a public park after closing hours. I was a passenger in a car, my girl friend pulled over because she lost her phone. And needed the light too look for it inside her car. I was on my phone got off to take the call I noticed a handgun by a tree and picked it up, we couldn't off been there more than five minutes. When the Pomona City Crash Unit drove up, asked us questions what we were doing there. When there where other cars there as well. As soon as they asked me for my i.d. which I wasn't carrying, since I had just lost my wallet the week before, plus I wasn't driving. That gave them a reason too get off there vehicle too search me. And I told them as they where frisking me, that I just found a gun and it's inside my right pocket. They handcuffed me,and and told me I'm supposed too turn in a found gun to the police department. I told them I had just found it. But they arrested me anyway.

Someone accused me of pointing a gun at them in GA. Several weeks later I was pull over and arrested. No gun was ever found. I was originally charged with felony Aggravated Assault. When they actually indicted me, they added possession of a firearm during commission of a felony. How is this even possible that they added possession of a firearm during commission of a felony but there was no other crime committed besides pointing the gun. Which would be only Aggravated assaulte. It would be different I I committed a separate crime while having a gun. But the only allegation was pointing the gun. Should my lawyer have had that charge dismissed? And shouldn't it be just Aggravated Assaulte? It seems like they are combining 2 charges from one act..Please let me know. Thanks

They have no video of actual possession either they have no body camera of arrest reason for stop they said they smelled weed on me and from a car that’s wasn’t mine I was sitting in for a sec but I don’t smoke and have drug test done by hair good for within 90 days proves negative

Tonisha Walker it depends on the situation. At times it can be unconstitutional to take you out if your car by illegally expanding the scope of a traffic stop for example. Other times they have a right to take you out of your car, for example to conduct a lawful warrantless search based on probable cause or the automobile exception, or because of an arrest warrant, or driving without a license, or a valid DUI investigation. There are many facts and scenarios that need to be considered to determine if it is lawful or unlawful for law enforcement to remove someone from a vehicle.

Unless you're using it to hurt somebody and if you just had it for self-defense then why do they care it's so stupid. I can name two cases where convicted felons and possession of firearms actually stopped crimes in progress. I'm sure these lawmakers would be singing a different tune if an armed convicted felon who had turned their life around and was carrying a gun for self-defense saved their life.
