On the morning of December 3rd, 2023, at approximately 1:31 am, I, Patrolman R. Lujan III was on patrol in the City of Albuquerque, County of Bernalillo, and State of New Mexico. I was driving a marked New Mexico State Police unit, in a uniform, and clearly displaying my badge of office number 184. While on duty, I was traveling westbound on Interstate 40 near milepost 164, when I observed a black- colored pickup traveling in front of my patrol unit. While the vehicle was in motion, it accelerated and began traveling at a high rate of speed. The vehicle appeared to be exceeding the posted speed limit. Due to my observations, I activated my front (Eagle) radar device and looked at the display, which read ninety (90) miles per hour. The posted speed limit in that particular area is sixty-five (65) miles per hour. then positioned my patrol unit directly behind the vehicle and engaged my emergency equipment and conducted a traffic stop on the black-colored Dodge pickup truck bearing a New Mexico temporary registration on Interstate 40 near milepost 161. Upon exiting my patrol unit, I approached the vehicle on the passenger side and met with the male driver of the vehicle. I introduced myself, informed him the reason for the traffic stop and requested his driver's license and vehicle information (Insurance and Registration). The male driver was identified as being Mr. Edgar Madrid, date of birth 1992 (Defendant). The Defendant was observed to have blood shot watery eyes, and I detected a strong odor of an alcoholic beverage emitting from inside of the vehicle. The Defendant was unable to provide me with his driver's license or valid proof of insurance for the vehicle. I then requested the Defendant to exit the vehicle and to meet with me outside at the rear of the vehicle. While speaking with the Defendant outside in front of my patrol unit, I was still able to detect the strong odor of an alcoholic beverage emitting from the Defendant's person/breath. I was able to reconfirm that his eyes were bloodshot watery. I asked the Defendant if he consumed any alcoholic beverages prior to driving. The Defendant advised that he had consumed at least one (1) beer prior to the traffic stop. Based on my observations and admission from the Defendant, I had him perform a series of Standardized Field Sobriety Tests (SFST's). Upon completion of all SFST's, based on my training and experience and my observations of the Defendant's driving (Vehicle in Motion), I observed the Defendant to display signs of impairment and determined the Defendant was unable to continue to operate a motor vehicle safely. At 1:40 am, the Defendant was arrested for Driving while under the influence of intoxicating liquor, which he was then placed in steel handcuffs that were fitted and locked for his safety. I read the Defendant the New Mexico Implied Consent Advisory (Full card to include the consequences of refusal) and he verbally refused to be tested. I checked the interior of his mouth to ensure it was free and clear of any foreign matter, which was clear at approximately 1:42 am. He was then transported to the New Mexico State Police office in Albuquerque for processing. After a 20-minute deprivation period (0142-0213 hours), the Defendant's information was entered in the currently certified IR8000 breath-instrument, and the Defendant at that time did not provide any breath samples and allowed the instrument to time out with no sample introduced. No secondary test was requested. A tow inventory was completed pursuant to my department policy. Shelps Towing arrived and took possession of the vehicle. A check of Defendant's driving history in NCIC returned as a driver's license. The Defendant had no prior DWI convictions, making the arrest his first offense. The Defendant was released to the Bernalillo Metropolitan Detention facility staff upon the completion of the paperwork where he was booked and incarcerated without incident.

True that. No "Professional Curtesy" here, or "Don't you know my boss?" . That is one of the most disgusting things to see on these kind of body cam incidents. Lots of young (and old) folks get embarrassing DWI's. It doesn't have to end there. It didn't for me. Obviously, it's bad if you want a Law Enforcement career, but in a lot of states, it's still possible. If you go thru the program, get treatment, demonstrate a recovery (AA is usually preferred, but there are other options), it is still possible to be a LEO after a period of time. Maybe I'm optimistic, but if this guy still really wants a LEO position, and goes thru all the steps to prove he has changed his ways, it is still possible in another 5-10 years he could get another position. Not sure how the testing refusal plays into that in NM, tho, it could disqualify. But I know that in a lot of states, an honest first offense (off duty, and less than ". 15 BAC"), he could theoretically come back. Just depends on what he wants to do and how much of a recovery he demonstrates.

Actually, it was the best I have ever saw. Every officer I have watched in these videos, that have been accused of DUI, has declined the breath test. They must know something.

He failed the eye test as most intoxicated people do, though. His head movements on the horizontal tests are pretty apparent. He did passable on the line test, and the one-leg test was ambiguous. I think the officer went with the eye test and the apparant alcohol odor. I can't imagine this guy was more than .15 BAC. EDIT: I think this officer also factored in his driving. Aggressive passing and speeding over 20mph above the limit can be factors that cops will use against suspect drivers as well.

@@nickdubil90It’s not about his head movement. Everyone’s head will move a bit on HGN. It’s about sustained nystagmus at maximum deviation. Or in other words do your eyes shake when he gets all the way to the left and right with his fingers. The only person who can testify to that fact is the trooper. Without a .BAC this is a very weak DUI case. The trooper with a lawyer will almost certainly prevail here.

Always good to know that people watching through a tiny little screen and camera lens can see the eye movements and smell the strength of the odor so much better than the officer in the scene. Also funny that usually everyone is accusing officers of turning a blind eye and not arresting fellow officers, now you are suggesting he just arrested a fellow officer unjustly just for the hell of it.

I've seen loads of these videos where you know the driver is drunk in the first 10 seconds. Those drivers deserve harsh consequences. Then there are videos like this where the driver shows no signs of impairment.

There is no way to pass a field sobriety test. It's designed to fail and build incriminating evidence in court. The tests aren't even required. The only requirement is to submit to breath or blood. The BAC machine is not even admissible in court. However cops use it to gain more probable cause to arrest you on the scene. He may lose his license but I'm pretty sure he'll get this case tossed. He's smart enough to not blow in the machine not sure why he wasn't smart enough to decline the field tests. As a police officer he should already know he's going to jail regardless the cop had his mind made up he just needed more probable cause which the field tests gave him. Why help them build their case? Stay quiet and decline it all. I see why the officer towed the car being on the highway and no safe place to park the vehicle as I'm sure all the other passengers were intoxicated as well to drive it off. Main thing to take. Don't drink and drive.

I disagree..this is more than a simple mistake/s. When your job is to enforce the law, and you are out breaking the law, not only does that make you a hypocrite cause you're arresting people for DUI on a daily basis, but it makes you unworthy of a badge/your job. On top of DUI, he was speeding and driving with NO INSURANCE and no license...no excuse for that whatsoever! He more than knows better!!

Always refuse fields and the breathalyzer. It’s not to confirm your innocence it’s to bolster the officers preconceived suspicions. Nothing you do or say will change the officers mind once you begin FST. He already knows he’s going to arrest you. Best course is to ask to be taken into custody, say little to nothing, and refuse any and all testing. Your license will likely be revoked, and the courts move slowly, but the charge will almost certainly be thrown out. And most importantly, don’t drive drunk, whatsoever.

Former cop here: you can’t judge the FST’s unless trained and you can’t see his eyes during the HGN test - which is the tell tale. I’m not saying he was drunk, I’m saying you can’t judge them all from the video - plus he admitted it.

He’s arrested many people that pass the FSTs, so someone having 1 or 2 points deducted, when there needs to be at least 6 iirc for PC to arrest means jack. He makes up what he needs to for his report.

I don't consume alcohol....The reason I say don't do a road side test is because it is highly subjective and up to interpretation by the cop...Many sober people have been arrested and booked because they did a field sobriety test and the cop used that against them...A breathalyzer BAC will put all that to rest immediately@@Leotheconstructionguy

He did not do well on the tests. The first test, Horizontal Gaze Nystagmus, I can tell from here his eyes lack what is called "smooth pursuit", meaning they jerk as they move from one way to another. I'm willing to bet he also had onset of nystagmus prior to 45 degrees, and distinct and sustained nystagmus at maximum deviation, but the camera isn't positioned to see it. On the walk and turn (the second test) he misses two heel toe steps, 8 on the way out and 9 on the way back. On the one leg stand (the third test) he has to hop and keep his balance before the 30 second timer runs out, and it looks like his back leg is bent, but that may just be the camera angle.

Plus that off duty cop did really really freaking good at those tests! Most people even completely sober can’t hold still on one foot for that long. Officer Lujan gets a reprimand for this one. Madrid pretty much nailed the SFSTs. Lujan should have issued a ticket for speeding, a caution about drinking and driving, and had him on his way.

Dude, the officer wasn’t drunk. He passed all the test and still got arrested…. It’s worse than fair. Saying “excellent work” is beyond me. You’re just like the officer, your mind was made up. You just want him to go through the test and get him arrested already……. He should have just been let off with a warning or ticket for speeding. The guy did better than most people I know sober. He wasn’t drunk at all.

I have over 500 dui arrests, and probably 75+ let go’s who passed the test! Now where EXACTLY are you getting you opinions from? I was at a family bbq years ago, and this very topic was brought up, “cant pass it sober” bullshitt…..soooooo i gave the SFST to a 10 year old! Guess what…..he passed! Funny huh? Most in here do not even know what we are looking for in the test, and therefore are ignorant of the test….

And that's why nearly every defense attorney out there will tell you DO NOT do FST's. They're not to "prove your innocence," they can only be used against you. Burden of proof is on the prosecutor, don't make it easy by handing them evidence. Once the officer has reached the point of asking you to take FSTs, they've usually already decided they're going to arrest you for DUI. Don't make it worse. Not that I'm condoning DUI, fuck anyone that does that, but if you do happen to find yourself in a position where the police want to do SFTS, refuse.

He entered a plea of not guilty and a pretrial conference is coming up next week. My money says this gets either dropped/severely reduced.

He’s probably barely over, like .105, or something. He was smart to refuse the breathalyzer. Most likely, they won’t get a warrant for a blood draw, and his case will get dismissed for lack of evidence.

I think he did really good on his FST tho... but never fails, the 2nd they ask u to step out you're going to be under arrest. If he really only had 2 beers he woulda passed the breathalyzer. Im so glad i quit drinking! Just celebrated my 6th year 💞 Alcohol is pure poison

It doesn't take as much when compared to males weighing the same. but he's a male and obviously had more than a couple of coors lights. He also didn't have his license, no proof of insurance and speeding. If he wasn't speeding he probably wouldn't have gotten pulled over. Even if he keeps his job, it's gonna cost him major bank. court costs, insurance being raised etc. Idk if NMSP allowed him to keep his pay while on leave.

He likely thot he performed well enough on the FST to convince a jury that he wasn't intoxicated. Taking the BAC could have proven his guilt. If I were on the jury, and from what I just seen, I wouldn't be able to convict. Most people can't stand 10 seconds on one leg, none the less 26.

He did those tests perfectly. I could not do that and I don't drink. Once they take you out of the car they have already decided. Nobody can stand like that for 30 seconds. When are people going to learn not to answer incriminating questions, to refuse the FST, and only blow the breath test. Period. After seeing the FST, if I was on a jury, I would have reasonable doubt.

Former cop here: you can’t judge the FST’s unless trained and you can’t see his eyes during the HGN test - which is the tell tale. I’m not saying he was drunk, I’m saying you can’t judge them all from the video - plus he admitted it.

He should take this in front of a jury. Without a BAC to confirm he was above the limit there’s very little chance a jury would unanimously find beyond a reasonable doubt that he was too impaired. He aced the walk & turn. The one leg stand was fine. I can’t evaluate an HGN test. But the right expert can tear apart the value of the test in general as well as the particulars of his. Reasonable doubt is almost assured. I love seeing bad officers held accountable but this was not one of those cases

That was a cop of cops, what a dick sucker. He was so happy he could hardly contain himself, he repeated some things 5 or 6 times. Then not letting the wife drive the truck home just to make this hurt as much as possible for everyone involved was absolutely uncalled for.. what a tyrant. NMSP entrance and academy isn't easy. Just the fitness training alone is brutal at the academy's 7000ft altitude. This guy just pissed it all away. And starting pay is about to increase to $38 per hour.

Never take a field sobriety test and never allow a breath test. You only accuse yourself if you work with them. I never drink the night before I have to drive. And that is 5 evenings a week. So I am always sober behind the wheel. But I can't do the Field Sobriety test because I can stand alone and walk very unstable. So if I say yes to this test, I can give them a reason to arrest for DUI or DWI. Let them prove that you are under the influence. But do not participate in your own conviction.

He performed these tests better than anyone I've seen. I sense the arresting officer was pissed off that he wasn't confrontational. He was polite and not once did I hear the officer say he appreciated his cooperation. He appears to be one of those with a god like complex since he has a badge and gun. I'm sure he's really, really popular with his buddies.

NEVER EVER admit to drinking to a cop. I don't care if you had 1 or 10. It's the worst mistake people make, they think if they be kinda honest and say 1 drink the cop will go easier on them. No, now you've already admitted to drinking so it's full on DUI investigation time and cop now has reasonable suspicion because you just admitted drinking and driving. Drunk or sober, if pulled over -- 1) Don't admit to drinking anything 2) refuse road side tests and PBT 3) If arrested, don't refuse or take the station breath test, try and ask for a lawyer before deciding.

He passed field test. One leg lift test was perfect. He lost his balance in the end but was steady still before that. You have highway traffic in the background and it after 1am doesn’t help. That test is ment to fail and the arresting officer decides that.

I truly believe that old Lujan had a personal vendetta against Madrid. He had a very condescending and rude attitude throughout the whole ordeal. Madrid appeared to have done well enough on the tests to be allowed to drive home. Lujan is a Woman 👠
